G-4 - 08/12/1958 - POLICE DEPARTMENT - Ordinances JEB:KM 8"5-58 1 & 7 coo PeLic�a DEF �cE f�O�1�Apli�fe��-Ch►F,F CRES�F7ioN�Q�E° , 8 12,-,5g ORDINANCE CREATING THE OFFICE OF POLICE CHIEF AND PROVIDING FOR A_POLICE DEPARTMENT WITHIN THE VILLAGE OF OA%BROOK, ILLINOIS 11WEMEAS, the Village of Oakbrook is a newly formed municipal corporation in the County of Du Page and State of Illinois; and WHEREAS, it is the opinion of the President and Board of Trustees of the said Village of Oakbrook that it is necessary to provide for a police department for the preservation of public peace, health and general-welfare within said village; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the said Village of Oakbrook: Section 1• There is hereby created in and for the Village of Oakbrook the office of Chief of Police, which office shall be filled by appointment by the President of the Board of Trustees and confirmed by a majority of the members of said Board of Trustees. Section ^z. In addition thereto the President, with the con- currencemajority of the members of the Board of Trustees, shall have the power to hire and employ additional persons as shall in their opinion be necessary to act as policemen or patrol- men within the Village of Oakbrook, it being the intent of this ordinance that such policemen or patrolmen shall not be deemed to be "officers" of the Village of Oakbrook and shall not be required to reside therein. Section 3. The Chief of Police and policemen or patrolmen shall evote their time and attention to the discharge of their duties required by law, and the ordinances of this Village. They shall have the power and it shall be their duty in said Village to serve and execute warrants and other processes, for the appre- hension and commitment of persons charged with a violation of any village ordinance, or any crime or misdemeanor, or offense against the peace of the village or state, or held for examination or trial, or taken in execution for the commission of any crime, or misde- meanor, or violation of any laws or ordinances of this Village. The Chief of Police and policemen or patrolmen shall have power and authority, and it shall be their duty to serve and execute any civil process, issued by any Magistrate or Justice of the Peace, in any case wherein the Village is a party. And while serving or executing any such warrant or process they shall be vested with and have all the powers and authority conferred on Constables at common law and the laws of the State of Illinois. Section 4. The policemen or patrolmen shall be under the directio supervision upervision of the Chief of Police. The Chief of Police shall be under the direction and supervision of the Village President. The Chief of Police shall have such further power as may be conferred on him by the ordinances of this Village. It shall be his duty to have general charge of Village property and to keep the same clean and ready for use, and to have charge of persons confined in the jail during the hours he is on duty. Section 5• The Chief of Police and all policemen or patrolmen shall serve at the pleasure of the President and Board of Trustees. Section 6. Any person who shall in this Village resist the Chief o e ice, or policemen or patrolmen in the discharge of their duty, or shall offer to attempt to cb so, or who shall is any manner assist any person in custody of the Village police to escape, or attempt to rescue any person in such custody, shall be fined not less than Three ($3.00) Dollars, nor more than One Hundred ($100.00) Dollars for each offense. Section 7. It shall be the duty of all persons in this Village, when called upon by the Chief of Police, or any policemen or patrolmen, to promptly aid and assist them in the execution of their duties in preserving peace and good order, and in the apprehension of offenders; and any person who shall neglect or refuse to give such aid and assist- ance shall be fined a sum not exceeding One Hundred ($100.00) Dollars for each offense. Section 8. Any person who shall within said Village falsely re- present hiase to be the Chief of Police, or policeman or patrolman, or who shall maliciously or with intent to deceive, use or imitate any of the signs, signals or devices adopted and used by them in the dis- chargd of their duties, or shall wear in public the uniform or badge adopted as the uniform or badge for such Chief of Police, or policeman or patrolman, or after ceasing to be same, shall be subject to a fine of not less than Five ($5.00) Dollars, nor more than One Hundred ($100.00) Dollars. Section 9. Unless sooner terminated by action of the President and/or-­T97iFJ--oT Trustees any appointment to the office of Chief of Police shall be for a period of one year from date of such appointment.
