AN ORDINANCE LICENSING PEDDLERS AND
SOLICITORS WITHIN THE LIMITS OF THE
VILLACE OF OAKBROOK,, DU PAGE COUNTY,$
ILLINOIS
BE IT ORDAINED by the President and Board of Trustees of the Village
of Oakbrook:
Section 1: Definitions. For the purpose of this ordinance the words
given below are defined as follows:
Peddler. Any person not having a specific place of business
in the Village, who shall sell or offer for sale., barter or exchange,,
at retail, any goods, wares or merchandise, which said goods, wares
or merchandise is delivered to the purchaser at the time of said
sale., and which said person travels from place to place in, along
and upon the streets,, alleys or public places of the Village.
Solicitor. Any person who., without having a specific place
of business in the Village, is engaged in the business of calling
from house to house and soliciting orders for any kind of goods,
wares, merchandise or services, as distinguished from a solicitor
for charitable causes, which said latter term shall for the purposes
of this ordinance be construed to include any person who solicits
among the inhabitants of the Village support for any religious,
charitable or educational organization.
Section 2: Solicitors--Licenses. No person shall engage in the
business of a peddler or solicitor in the Village as defined in this ordinance
without first having obtained a license so to do*
Section 3& License Application. Application for such peddler's
or solicitorts license shall be made to the Village Clerk and shall state the
name and address of the company or firm whose merchandise the applicant proposes
to sell, or for whom he proposes to solicit business, and shall describe the
particular sort of merchandise or service for which he proposes to solicit
orders or to sell.
Section 4: License Content. Each license issued shall set forth

the kind of goods, wares, merchandise, service or property which shall be
sold or for which orders shall be solicited., and no such license shall be
valid for peddling or for solicitation of orders or any other type of
property or service.
Section 5: License Fee. The fee for such license shall be Five
Dollars ($5.00) per year.
Section 6: Peddling and Soliciting on Sundays Prohibited. Peddling
and soliciting on Sundays shall be prohibited and any person who shall on a
Sunday engage in the business of peddling or soliciting, as defined herein2
shall be guilty of a misdemeanor and subject to the penalties provided in
this ordinance.
Section 7s Soliciting for Charitable Causes. It shall be unlawful
for any person to solicit for charitable causes without first having registered
with the Clerk of the Village of Oakbrook.. Illinois, and having obtained a
permit so to do, unless said person is licensed as a peddler or solicitor under
the terms of this ordinance.
Section 8: Bond. At the time of making the application for such
permit the applicant shall deposit with the Clerk of the Village of Oakbrook
a cash bond in the amount of Fifty Dollars ($50.00) conditioned upon such
person complying with all of the ordinances of the Village of Oakbrook, and
upon said applicant's not committing any offense against the people of the
State of Illinois within the Village of Oakbrook.
Section 9: Return of Bond--Forfeiture.. Upon the completion of the
solicitation for charitable causes,, such solicitor shall return his permit
to the Village Clerk who shall, provided none of the conditions of the bond
have been violated, return the bond deposit to the holder of said permit, and
in the event any of the conditions of the bond have been violated, such bond
shall be forfeited and the bond money shall be delivered to the Treasurer of
the Village of Oakbrook, and shall be transferred to the corporate fund of
said Village.

Section 10. Permit or License to be Carried on Person. Any
peddler, solicitor or solicitor for charitable causes shall at all times
carry upon his or her person the license or permit issued by the Village
Clerk and shall exhibit same upon request to any police officer or to any
person upon whom he or she calls in the course of their business.
Section 11. Consent of Occupant Required. It shall be unlawful
to enter any residential or business premises, or to remain therein, for the
purpose of selling or taking orders for any commodity or service, or for
soliciting for any charitable cause without the express or implied consent
of the occupant of said premises regardless of whether or not a permit has
been issued.
Section 12. Penalty, Any person who shall violate any provision
of this ordinance shall be fined not less than One Dollar ($1.00) nor more
than Two Hundred Dollars (3200.00) for each offense. Each day such violation
shall continue shall constitute a separate offense.
Passed and approved by the President and Board of Trustees of the
Village of Oakbrook, Illinois, this 14th day of February, A. D. 1961.
