BE IT ORDAINED by the President and Village Board of the Village of Oak Brook, DuPage County, Illinois, that. AN ORDINANCE establishing regulations for the subdivision and platting of land; de- fining certain terms used therein; for the preparation of plats; for the reservation and accept- _ ance of land for public use; for the installation of utilities, roadway pavements, and other es- sential improvements; establishing procedures for the approval and recording of plats in the Village of Oak Brook, Illinois, and in the unincorporated area one and one-half miles beyond the village I imits; imposition of final plat approval fees; providing the means of its enforcement and imposition of penalties for its violations; in accordance with authority vested in the munic- ipality under the provisions of the applicable Statutes of the State of Illy ^'s be and hereby is adopted as part of the Official Plan of the Village of Oak Brook as follows. SECTION I PURPOSE AND JURISDICTION Because each new subdivision accepted by the Village becomes a permanent unit in the basic physical structure of the future community, and to which the future community will, of necessity, be forced to adhere, all subdivisions hereafter planned within the incorporated limits of the Village, and within the unincorporated area lying one and one-half miles beyond, shall, in all respects, be in full compliance with the regulations hereinafter contained in this ordi- nance. These regulations are designed to provide for the orderly and harmonious development of the Village, for the coordination of streets within new subdivisions with other existing or planned streets, and to secure a uniform system of utilities and services, and otherwise to pro- mote realization of the Official Plan. SECTION II RULES AND DEFINITIONS A. RULES The language set forth in the text of this ordinance shall be interpreted in accordance with the following rules of construction: 1 . the singular number includes the plural and the plural the singular; 2. the present tense includes the past and future tenses and the future the present; 3. the word "shall" is mandatory, while the word "may" is permissive; 4. the masculine gender includes the feminine and neuter; 5. whenever a word or term defined hereinafter appears in the text of this ordi- nance, its meaning shall be construed as set forth in the definition thereof; and any word appearing in parenthesis directly after a word herein defined shall be construed in the same sense as that word; and b. the following words and terms, wherever they occur in this ordinance, shall be e construed as herein defined. - 1 - _ 3r7 B. DEFINITIONS 1 , ALLEY is a right-of-way which affords secondary means of access to properties abutting upon a street. 2. BLOCK is a tract of land bounded by streets or by a combination of one or more streets and parks, cemeteries, shore lines of waterways, corporate limit lines, or other lines of demarcation. 3. BUILDING INSPECTOR is the Building Inspector of the Village of Oak Brook, Illinois, or his duly authorized representative. A. BUILDING SETBACK LINE is a line within a lot or other parcel of land so de- signated on the preliminary plat, which denotes the area between such line and the adjacent street right-of-way line where an enclosed building and other ob- structions are prohibited, except those obstructions that are permitted by zoning ordinance regulations. 5. COLLECTOR STREET is a street within a subdivision which has wider right-of-way and roadway widths, and which is a prime entrance or circulating street. Its primary function is to distribute and collect traffic to and from the minor streets. b. CUL-DE-SAC is a minor street with a single outlet. 7. EASEMENT is a quantity of land set aside over or under which a liberty, privilege, or advantage in land without profit, is dedicated and is distinct from ownership of the land, is granted either to the public, a particular person, or a combination of both 8. FINAL PLAT is a map or plan of a subdivision and any accompanying material as -° described in Section Vl. 9. FRONTAGE ROAD is a minor street which is parallel to and either adjacent to or within the right-of-way of a thoroughfare. 10. HALF STREET is a street of less than the total required width along one or more property lines of a subdivision. ® 2 - _ } V 11 . LAND IMPROVEMENT is any sanitary sewerage system, storm sewer system, water supply and distribution systems, roadway, side-strip, sidewalk , pedes- trian way, no-access strip, off-street parking area, or other improvement which the Village of Oak Brook may require under this ordinance. 12. LOT is a portion of a subdivision or other parcel of land intended for transfer of ownership or for building development. 13. LOT, BUTT, is a iot at the end of a block and located between two corner lots. 14. LOT, DOUBLE FRONTAGE, is a lot which has a pair of opposite lot lines along two substantially parallel streets. 15. MINOR STREET is a street of limited continuity. Its primary purpose is to serve abutting properties. 16. "NO-ACCESS" STRIP is a land area at least 12 feet wide along the rear lot line of a double-frontage lot and abutting a thoroughfare within which no vehicular driveways shall be permitted. 17. OFFICIAL PLAN refers to the composite of the functional and geographic ele- ments of the comprehensive village plan, or any segment thereof, in the form of plans, maps, charts, text of reports, and the Official Map, as adopted by the Village of Oak Brook. 18. _OWNER or subdivider shall include any firm, association, partnership, private corporation, public or quasi-public corporation, or a combination of any of them, or other legal entity having sufficient proprietary interest in the land sought to be subdivided or divided to commence and maintain proceedings under the provisions of this ordinance. 19. PEDESTRIAN WAY is a right-of-way across or within a block designated for pedestrian use. -� 20. PLAN COMMISSION is the Oak Brook Plan Commission. 21 . PRELIMINARY PLAT is a tentative map or plan of a proposed subdivision as de- scribed in Section IV. 22. ROADWAY is that portion of the street designated for vehicular use. 23. SIDEWALK is that portion of the street designated for pedestrian use. 3 C-5 L/ 24. SIDE-STRIP is the unpaved strip of land within a street right-of-way and is parallel to the roadway. 25o STREET is a right-of-way which affords primary means of access by pedestrians and vehicles to abutting properties, whether designated as a street, avenue, highway, road, boulevard, land, or however otherwise designated. 26, STREET WIDTH is the shortest distance between the right-of-way lines of a given street. 27. SUBDIVIDER is any owner commencing proceedings under this ordinance. 28. SUBDIVISION is a described tract of land which is to be, or has been, divid- ed into two or more lots or parcels, orany division of land when a new street is involved, for the purpose of transfer of ownership or building development. The division or subdivision of land into parcels or tracts of five acres or more in size and not involving any new streets, easements or access, or the sale or exchange of existing parcels or tracts of land, or the division of lots and blocks in record- ed subdivisions when no new street is involved, shall not be deemed to be a sub- division . The term "subdivision" includes resubdivision and, where it is ap- propriate to the context, relates to the process of subdividing or to the land sub- divided, 29. SUBDIVISION DESIGN STANDARDS are the basic land-planning principles es- tablished as guides for the preparation of preliminary plats. 30� THOROUGHFARE is a street with a high degree of continuity and serving as an arterial trafficway between the various districts of Oak Brook and its environs. 31 . VILLAGE is the Village of Oak Brook, Illinois, 32. VILLAGE BOARD is the President and Board of Trustees of the Village of Oak Brook, Illinois , 33. VILLAGE CLERK is the Village Clerk of the Village of Oak Brook, Illinois. 34. VILLAGE ENGINEER is the Village Engineer of the Village of Oak Brook, Illinois, or his duly authorized representative. SECTION III PROCEDURE Before subdividing any tract or parcel of land in the Village and the unincorporated areas one and one-half miles beyond the Village limits, an owner or subdivider shall submit a preliminary plat and a final plat to be acted upon by the Village authorities in accordance with the follow- "' ing requirements. (Prior to preparation of final preliminary plat drawings, it is recommended that the subdivider consult with the Plan Commission and other Village officials to determine .� 4 - G all. _ �- conformity to the Official Plan, Zoning Ordinance, and compliance with this and uther appli- cable Village ordinances.) A. SUBDMSIONS OF NOT MORE THAN FIVE LOT'S _ 1 . When an application for approval of subdivision plat containing not more than five lots and located within the Village limits is submitted, the Village Clerk shall refer such plat to the Village Board and upon its consideration thereof and after receiving a report from the Plan Commission, finds that the intent and purpose of this ordinance is not violated, the Village Board may approve such plat without further procedure. 2. The plat of such a subdivision submitted by the subdivider for approval shall be in the form of a certified survey map and shall conform with the following. (a) _ to the extent reasonable practicable the survey map shall comply with the pro- visions of this ordinance relative to subdivision design standards and if applicable, required land improvements; (b) the survey shall be performed and the map pre- ,_ pared by a registered surveyor; (c) all corners shall be monumented as required by this ordinance; (d) the survey map shall be prepared in accordance with ap- plicable statutes on tracing linen or equal and all lines shall be made with non- fading block ink to a scale of not more than 100 feet to 1 inch; (e) when such subdividing is not served with public or community sewerage and water systems, percolation tests and subsequent plans for individual sewage disposal systems and private wells shall be submitted in accordance with requirements of the DuPage County Department of Health and other governmental authorities having jurisdiction; and (f) the survey map shall include such certificates set forth — herein, Section V1, subsection C, paragraphs 1 through 8 as required by the Village Board. Upon approval of the survey plat by the Village Board, the Village Clerk shall thereafter comply with the regulations herein in this Section, subsection C, paragraphs 4 and 5. B. PRELIMINARY PLAT 1 . The owner or subdivider shall file an application for approval of the prelimi- nary plat with the Village Clerk. Five copies of the preliminary plat and the required filing fee shall accompany the application. 2, The Village Clerk shall refer five copies of the preliminary plat to the Plan Commission, at least ten days in advance of the next meeting of the Plan Com- mission. 3, The Plan Commission shall notify the owner or subdivider as to the time and place of the Plan Commission meeting at which he will be afforded an oppor- tunity of being heard. 4. The Plan Commission shall approve or disapprove the application for prelimi- nary plat approval within 90 days from the date of filing the application or the 5 filing by the applicant of the last item of required supporting data, whichever date is later, unless such time is extended by mutual consent. 5. When the preliminary plat has been acted upon by the Plan Commission, it shall be referred to the Village Board. If the Plan Commission approves the plat it shall so indicate on the plat, and if it disapproves such plat it shall furnish the i Village Board and the applicant a written statement setting forth the reason for disapproval and specifying with particularity the aspects in which the proposed plat fails to conform to this ordinance and official plan. The Village Boardshall accept or reject said plat within 30 days after its regular stated meeting follow- ing the action of the Plan Commission. 6. Upon approval of the preliminary plat by the Village Board, the following Notice of Approval shall be stamped upon four prints thereof, and required signatures of- f i xed: NOTICE OF APPROVAL OF PRELIMINARY PLAT "Notice is hereby given that the preliminary plat of the subdivision shown hereon has re- ceived approval by the Village Board of the Village of Oak Brook, Illinois, and upon compliance by the subdivider with requirements of qualifications governing the approval of preliminary plats and with other revisions and stipulations that may be required, the Village Board will receive the final plat for consideration when submitted by the sub- divider in such form and within such time as required by this ordinance." The five prints of such approved preliminary plat shall be distributed by the Village Clerk as follows. i a. two prints shall be retained by the Plan Commission; b. one print shall be sent to the Village Engineer; C. one print shall be sent to the Village Clerk for filing; and d, one print shall be returned to the subdivider. 8. Approval of the preliminary plat by the Plan Commission and Village Board shall be conditioned upon stipulations as set forth in Section V of this ordinance. 6 - IN-1 C:3� _ 3 C. FINAL PLAT 1 o Within one year after approval of the preliminary plat by the Village Board, the owner or subdivider shall file an application for approval of the final plat with the Village Clerk. Such application shall include the original ink linen drawings, one transparency print, five contact prints of the final plat, and four copies of all supporting maps, drawings, and all other required documents. 'The final plat shall retain the design characteristics of the approved preliminary plat, except that the Village Board may require such changes or revisions as are deemed necessary in the interest and needs of the community, in keeping with the provisions of this ordinance. Accordingly, the Village Board may by resolution refer the application for approval of the final plat to the Plan Com- mission for recommendation and report relative to design characteristics of the final plat. 2, In case application for approval of a final plat is made for a part or parts of an approved preliminary plat, the VillageBoard mayextend the time for appli- cation of approval of final plats for other parts of the approved preliminary plat until a later date or dates beyond the foregoing one-year period. 3. Within 60 days from the date of filing the last required document or other paper or within 60 days from the date the application for approval of the final plat was filed with the Village Clerk, whichever date is later, the President and Village Board shall by resolution approve or disapprove such plat. Upon the adoption of the resolution approving a final plat, the Village Clerk shall certify such approval and affix the corporate seal of the Village on the final plat. 4o Upon approval by the Village Board, the Village Clerk shall secure one trans- - parency print and three contact prints of the approved final plat, and three copies of the approved supporting documents. The cost of such prints and copies of documents shall be paid by the subdivider. (a) one contact print shall be delivered to the Plan Commission; (b) one contact print and all specifications, drawings, and estimates shall be delivered to the Village Engineer; and -- (c) one transparency print and one contact print and all other support- ing documents shat I be retained by the Village CI erk. 5. The final plat in exact form as approved by the Village Board shall be filed for record by the Village Clerk. The Village Clerk shall secure three print copies of the recorded plat. The subdivider shall pay recording fees and the cost of the print copies. ® 7 - G -37 SECTION IV PRELIMINARY PLAT SHALL SHOW FOLLOWING: The preliminary plat shall be drawn on tracing paper or tracing cloth in a manner that clear and legible prints can be made. Graphic (engineering) scale shall not exceed 100 feet to one inch. 6> North-point (designated as true north). 7,. Dote of preparation. B IM, STING CONDITIONS 1. Boundary lines of proposed subdivision in accordance with44'."above. 24 Total acreage therein. 3. Existing zoning districts in proposed subdivision and adjacent tracts. 4. Location, widths, and names of all existing or previously platted streets or other rights-of-way showing type of improvement (if any), railroad and utility rights- of-way, parks and other public open spaces, permanent buildings and structures, easements, and section and corporate I ines within the tract and to a distance of 100 feet beyond the tract. 5e Location and size of existing sewers, water mains, culverts, or other underground facilities within the tract and to a distance of 100 feet beyond the tract —also _ indicating such data as grades, invert elevations, and locations of catch-basins, manholes, and hydrants. 6n Location map, if required by the Plan Commission, drawn at a scale of not less - - than one inch equals 1,000 feet, showing boundary vines of adjoining unsub® divided or, subdivided land within an area bounded by nearest arterial streets or other natural boundaries, but not less than one-half mile beyond the sub- division boundaries in subdivisions located beyond the village limits, identify- ing type of use and ownership of surrounding land and showing alignments of existing streets. w 7e Topographic data including existing contours at vertical intervals of not more than two feet, except in unusual topographical conditions; such vertical inter- vals may be required to be altered as determined by the Village Engineer. Topo- graphic data shall refer to the Village of Oak Brook Datum. The location of water courses, marshes, and other significant features. Soil boring data and seepage tests may be required at locations and depths as determined by the Vii- loge Engineer. 80 Locations of or reference to locations of existing monuments or survey markers used in preparation of survey and grade elevation of each monument and marker. C. SUBDIVISION DESIGN FEATURES 1 o The preliminary plat shall be in substantial accord with the Official Plan as amended from time to time. — 20 Layout of streets showing right-of-way widths and street names (not duplicating the name of any street heretofore used in the Village or its environs unless street is an extension of or in line with an already named street in which event that name shall be used) and showing proposed through streets extended to boundaries of subdivision. 3. Location and width of alleys, pedestrian ways, and utility easements. A. Layout, total number of lots, and dimensions of the lot containing the minimum width and depth and the lot containing the maximum width and depth. 5> Minimum front and side street building setback lines — indicating dimensions. 60 The Village of Oak Brook zoning districts proposed for the subdivisions to be annexed. 7. Areas (other than those I isted in C®2, C-3, and Cm4,above), if any, intended to be dedicated or reserved for nonresidential purposes — indicating in each the approximate acreage. Such areas shall be designated by letter or number. 8. Proposed location of sewers and storm drains and proposed method of sewage and waste disposal, w _ q — _ .37 9e if deemed necessary by the Plan Commission, proposed detailed grading plans of blocks and lots. No land will be approved for subdivision which is subject to periodic flooding or which contains 'inadequate drainage facilities, unless the subdivider agrees to make improvements which will, in the opinion of the Vil- lage Engineer, make such land safe for residential occupancy and provide ade- quote drainage. SECTION V PLANS AND SPECIFICATIONS FOR LAND, IMPROVEMENTS After the approval of the preliminary plot and prior to filing an application for approval of a final plat, the subdivider shall submit to the Village Engineer and other public officials having jurisdiction, preliminary plans and specifications — prepared by a registered engineer for re- quived land improvements, and if required by the Plan Commission, detailed grading plans of lots and blocks. The Village Engineer and other public officials having jurisdiction shall ap- prove such preliminary plans acid, specifications or set.,forth,the 'revisions, necessary for approv- al . Based upon the conditions of approval of the preliminary plans and specifications the sub- divider shall have prepared by a registered engineer final plans and specifications covering - such required land improvements. Such plans and specifications shall be approved by the Vil- lage Engineer and,other public officials having jurisdiction and such approval certified on the final plat. SECTION V1 FINAL PLAT SHALL SHON FOLLOWING A9 GENERAL All information required on the preliminary plat, except that required in Section IV, B-2 to B�8 inclusive, andC- , C-:S, C-6, is to be shown accurately and drown with black waterproof drawing irk on transparent linen tracing cloth, or equal, in a manner that clear and legible transparent or contact prints or photostatic copies can be made. �. ADDITIONAL DELINEATION 1 . Accurate angular and lineal dimensions for all lines, angles, and curvatures, with functions used to describe all boundaries including perimeter of survey of tract, streets, alleys, easements, areas to be reserved for public use, and other important features. Error of closure of boundary-line surveys shall not exceed one �.. in ten thousand (one foot for each 10,000 feet of perimeter survey) . Angular at- ror shall not exceed plus or minus 20 seconds, Lot lines to show dimensions in feet and hundredths, and when an angle occurs in any lot line between lot corners, the measurement of the angle shall be shown in degrees, minutes, and seconds. The final plat shall show accurately the location of all .permanent lot markers as actually installed 2, An identification system for all blocks and lots using consecutive numbers for lots within a block . - 10 .m s 3. True angles and distances to the nearest established street lines and official monuments (not less than three), which shall be accurately described in the plat by location, size, and elevation. A. Municipal, township, or section lines accurately referenced to the limes of the subdivision by distances and angles. a 5. Accurate location of all monuments which shall be placed at all block corners, angle points, and at intermediate points as shall be required by the Village En- gineer, and installed in such a manner that they may be located by a licensed surveyor. All U.S.G.S., State, County, Village, or other official bench- marks, monuments, or triangulation stations in or adjacent to the property shall be preserved in precise position. 6. Accurate outlines and legal descriptions of any areas to be dedicated or reserv- ed for public use or for the exclusive use of property owners within the sub- division. a - 7. Protective covenants, or filed as an accompanying document. 8. In subdivisions containing 20 acres or more in area, a declaration creating and establishing scope of activities for an architectural control committee. C. CERTIFICATES The application for approval of the final plat shall not be deemed completed until the following certificates, other than the Village Clerk Certificate, have been duly executed: 1 . B. A completion bond shall be posted by such owner or subdivider with the Village Clerk prior to recording of the final plat. Such completion bond shall be in a penal sum suf- ficient to cover the cost of the land improvements required by Section XI hereof or, in lieu of a bond, a deposit of cash, or other security or undertaking acceptable to the Vil loge Board. If a mo pletion bond or other guarantee is posted, there should be good and sufficient surety thereon, approved as to form by the Village Attorney and con- ditioned upon the installation of said improvements and payment of inspection fees, with- _ in three years following the approval of the final plat. If cash or other security is de- posited, it is to be used insofar as it is sufficient to defray the cost of making such im- provements, including inspection fees. Any unused bolonce will be returned to the _ depositor. There shall be no reduction of that portion of the bond or other guarantee or deposit applying to a particular improvement, unless and until that improvement is complete and accepted or approved by the Village Board, except that upon the comple- tion of the subgrade, base course and one-half of the thickness of the wearing surface course of a street, alley, or parking area, the Village Board may reduce that amount of that portion of the bond or other guarantee or deposit covering such land improvements, but such reduction shall not be more than an amount equal to 90 percent of the estimated cost of installation of the subgrade and base course. _ Ce The completion bond shall be acknowledged before a notary public by the principal and surety and shall be in substantially the same form. SECTION VIII SUBDIVISION DESIGN STANDARDS A. STREET PLAN The arrangement, character, extent, width, grade, and location of all streets shall conform to the official plan, and shall be considered in their relation to existing and planned streets; to reasonable circulation of traffic within the subdivision and adjoin- ing lands; to topographical conditions;to runoff of storm water; to public convenience and safety; and in their appropriate relations to the proposed uses of the area to be served. B. STREETS 1. All right-of-way widths shall conform to the following minimum dimensions: Residential Manufacturing or Type of Street Subdivision Business Subdivision a. Thoroughfares — including freeways, expressways, parkways, major and �.. secondary thoroughfares, shall be in accordance with those designated on the official Plan of the Village of Oak Brook and Environs, or by Federal, State, or County authorities having jurisdiction, whichever has the greater width and design standard requirements . * A collector street may be required by the Plan Commission: (1) in a resi- dential subdivision containing 20 acres or more in area and where the lots are one-quarter acre or less in area; (2) in any subdivision as an extension of a collector street in an adjacent subdivision; and (3) in any manufactur- ing or business subdivision. _ - 17 _ r7 2. Where there is a deflection in horizontal center lines within a given block at any given point in excess of ten degrees, a curve shall be inserted with a radius of not less than: Col lector Streets 300 feet Minor Streets 100 feet 3. Different connecting street gradients shall be connected with vertical curves . Minimum length in feet of these curves shall provide a stopping sight distance of not less than 300 feet, measured from an eye level four feet high, with a clear view of an obstacle not over two feet high . 4. Minor streets shall be so aligned that their use by through traffic will be dis- couraged. 5, Street jogs with center-line offsets of less than 150 feet should be avoided. 6. It must be evidenced that all street intersections and confluences encourage safe and efficient traffic flow and, in general, be at or near right angles avoiding acute angles. An intersection of more than two streets shall be avoided unless specific conditions of design indicate otherwise. 7. Alleys are not permitted in residential subdivisions unless deemed necessary by the Plan Commission and alleys may be provided in business or manufacturing ' subdivisions. 8. Cul-de-sac streets in single-family residential districts shall be not more than 500 feet in length, measured along their center lines from the streets of origin to the ends of their rights-of-way, or may be longer than 500 lineal feet pro- vided not more than 15 lots abut upon their rights-of-way lines. In multiple- - family residential districts, such streets shall not exceed 400 feet in length. Each cul-de-sac street shall have a terminus of nearly circular shape with a minimum diameter of 120 feet, except a cul-de-sac street that has not more than five lots fronting on its right-of-way, or a temporary cul-de-sac street may have a terminus of the "T" type or other variation of the circular shape as approved by the Plan Commission . 9. Half streets shall be prohibited except where essential to the reasonable develop- ment of the subdivision in conformity with the other requirements of these regu- lations; and where the Village Board finds it will be practicable to require the dedication of the other half when the adjoining property is subdivided. Where- ever an existing or dedicated half street is adjacent to a tract to be subdivided, the other half of the street shall be platted within such tract. A half street, where included, shall be graded at one level, and the regrading or new con- struction of any half street shall conform to the grade and pavement of the ad- '" jacent half street. 18 - G-T - S ' 10. Provisions shall be made for vehicular and pedestrian access to residential property abutting thoroughfares either by providing- (a) frontage roads; or (b) by backing Lots to the thoroughfare and providing access by a collector, minor, or cul-de-sac street one lot depth removed and with a no-access strip along the rear lot line, These standards are established for the purpose of providing protection to residential properties and to separate through and local traffic. 11.e Gradients of streets shall be at least 0.4 percent and not exceed ono Collector Streets 5 percent Minor Streets 7 percent Co ALLEYS AND PEDESTRIAN WAYS 1 . Alleys, when permitted in residential subdivisions shall be not less than 20 feet wide and alleys in commercial and manufacturing subdivisions shall be not less than 22 feet wide. 2. Pedestrian ways when required by the Plan Commission shall be not less than 12 feet wide. D. EASEMENTS 1.. Utility distribution or transmission installations serving the subdivision, and when required, storm water drainage ways shall be located in easements as designated on the subdivision plat of record. Such easements shall be locat- ed along the rear lot lines or side lot lines at locations of extensions of utility installations between blocks or continuity of drainage way. They shall oc- cupy not less than the rear six feet of lot depth or six feet of lot width adjoin- ing the applicable side lot line. Additional easements at other locations on the lot or additional widths may be required for specific conditions by the Village Engineer. 20 Where a subdivision is traversed by a natural drainage way, channel, or stream, there shall be provided a drainage easement, conforming substan- tially with the flood plain areas bordering such water course. The flood plain areas shall be as designated by the Village Engineer. ® 19 E. BLOCK STANDARDS 1 , In residential subdivisions, the maximum length of blocks containing lots less than 150 feet in width shall be 11800 lineal feet, and the maximum length of blocks containing lots 150 feet and over in width shall be 2-,640 lineal feet. No blocks shall be less than 900 lineal feet in length unless approved by the Plan Commission. Pedestrian ways leading to schools, parks, or other common destinations may be required by the Plan Commission. 2, In manufacturing and business subdivisions, maximum length of blocks shall be as approved by the Plan Commission . 3. The shape of blocks shall be determined by topographical features, the basic street system and traffic pattern, lot depths, and areas designated for public and other non-residential land uses. 4. Where a subdivision borders upon or is traversed by a railroad right-of-way or thoroughfare, the Plan Commission may require a street (on one or both sides of such right-of-way or street) approximately parallel to and at a distance re- moved suitable for the appropriate use of the intervening land, i .e. park pur- poses, deep residential lots fronting on it with a no-access strip along the rear lot lines, and off-street parking, business, or other uses as permitted by the zoning ordinance. F. LOT STANDARDS 1 . In general, lots should be as nearly rectangular in shape as practicable. '2. Width and area of lots shall conform with lot width and area requirements set forth in the Zoning Ordinance of the Village of Oak Brook or that of DuPage County in the unincorporated areas beyond the village limits. In the case of corner lots, the Plan Commission may make variations to encourage the proper development of intersection design and traffic safety, and corner lots shall be increased in width by 20 percent over the width of typical interior lots, ex- cept that corner lots need not exceed 90 feet in width, if the 90 feet in width is greater than the width of the typical lot. 3. Depth of lots shall be not less than 120 feet for interior lots, and not less than 110 feet for corner lots, provided the width is increased to give equivalent area . 4. Width, area, and depth of lots in a manufacturing or business subdivision shall be as approved by the Plan Commission. 5. All lots shall abut upon a street. 20 - -3 '7 64 Side lines of lots shall be at right angles or radial to the street line, or sub- stantially so. 7. Double-frontage lots are not permitted, except where lots back upon a thorough_ fare, upon a body of water in separate or undivided ownership, or as specifical- ly approved by the Plan Commission in manufacturing and business subdivisions. 8. Lots abutting upon a water course, drainage way, channel, or stream, shall _ have an additional depth or width as required by the Plan Commission in order to provide acceptable building sites. 94 In the subdividing of any land, due regard shall be shown for all natural features such as tree growth, water courses, historic spots, or similar conditions. SECTION IX PUBLIC USE AREAS When an area of land for public use (in addition to streets, alleys, pedestrian ways, and utility -- easements) shall be required by the Plan Commission to be located in whole or in part in a sub- division, the subdivider shall designate on the Preliminary Plat and Final Plat that such land is reserved for public use. If such land is not acquired or arrangements made for acquisition by — the Village of Oak Brook, a school board, or other governmental body within one year after the date of recordation of the final plat, such land may thereafter be used by the subdivider for a use permitted at its location by zoning regulations or, if applicable, in accordance with more restrictive protective covenant requirements. SECTION X ACCEPTANCE OF STREETS If any plat of subdivision contains public streets or thoroughfares which are herein dedicated as _ such, whether located within the corporate limits of the Village of Oak Brook, or in part out- side thereof, or contains existing streets located outside of said corporate limits, the approval of the plat by the Village Board or the subsequent annexation of the property to the Village _ shall not constitute an acceptance thereon or therein, irrespective of any act or acts by an officer, agent, or employee of the Village with respect to such streets or improvements. The acceptance of such streets or thoroughfares shall be made only by the adoption of a resolution by the Village Board, after there has been filed with the Village Clerk a certificate by the Village Engineer certifying that all improvements required to be constructed or installed in or upon such streets or thoroughfares, in connection with the approval of the plat of subdivision `. by the Village Board, have been fully completed and the construction or installation thereof has been approved by him. SECTION XI REQUIRED LAND IMPROVEMENTS Before a,final plat of subdivision may be approved by the Village Board, -- the owner or subdivider shall submit to the Village Engineer completed plans and specifications, prepared by a registered engineer, covering the improvements and utilities described in the sub- m 21 11-� Gs — .3 r7 %� divider's plat, and the Village Engineer shall certify in writing to the Village Board that such improvements and utilities meet the minimum requirements of the Village, County, State, and other authorities having jurisdiction, and comply with the following: A. SEWERS 1 . Public or community sanitary sewerage systems, including sewer stub terminals at the outside of curb line or edge of pavement for each lot, shall be installed in accordance with Village standards and specifications to serve all lots in a sub- division. Subdivisions containing no lots less than one acre or more in area and located in the unincorporated areas within one and one-half miles of the corpor- ate l imits of the Village or such subdivisions located in the Village may be serv- ed with individual sewage-disposal systems conforming with standards approved by DuPage County Health Department and other applicable governmental author- ,,, ities, except that individual sewerage disposal systems shall be permitted in such subdivisions located within the Village only after specifically approved by the Village Board when it is determined that connection with a public or com- munity system is not practicable. 2. Storm water drainage systems shall be designed to service the entire subdivision to carry off water from all inlets, catch basins, or open drainage ways, and be connected with an adequate outfall . The storm-water drainage system shall be separate and independent of the sanitary sewer system. —` 3. Where sewer mains of larger capacity than necessary are required, as directed by the Village Board to serve the subdivision as delineated in the preliminary plat, the subdivider shall be required to pay for the proportionate benefit of the instal- " lation to his subdivision, as established by the Village Board. B. WATER SUPPLY 1 . Public or community water supply and distribution systems, including water stub terminals to each lot, shall be installed in accordance with Village standards and specifications to serve all lots within a subdivision. 2. Where water mains of larger capacity are required, as directed by the Village Board to serve the future growth in the vicinity of the subdivision, the subdivid- er shall be required to pay for the proportionate benefit of the installation to his subdivision, as established by the Village Board. Subdivisions containing `- no lots less than one acre or more in area and located in the unincorporated areas within one and one-half miles of the corporate limits of the Village or such sub- divisions in the Village, may be served with water supply from individual wells conforming with standards approved by DuPage County Health Department and other applicable governmental authorities, except individual wells shall be per- mitted in such subdivisions located within the Village only after specifically ap- proved by the Village Board when it is determined that connection with a public or community water supply system is not practicable. 22 - - 3. Fire hydrants shall be installed at locations designated by the Village Engineer and in accordance with standards and specifications of the Village. C. STREET GRADING 1 a All stumps, trees that cannot be saved, boulders, and similar items shall be re- moved. 2. The full width of the right-of-way shal I be graded, including the sub-grade of the areas to be paved. D. STREET IMPROVEMENTS 1 . Thoroughfares In accordance with Federal, State, County or local re- qu irements. 2e Roadway pavements in cul-de-sac street turn-arounds shall have a minimum dia- meter, measured from faces of the outside curb or outside edges of roadway pave- ment of 80 feet for residential subdivisions and 100 feet for manufacturing and business subdivisions, and roadway pavements in "T" type or other variations of the circular type terminus shall be as approved by the Plan Commission, L 3. Roadway pavement shall be installed in accordance with the Village standards W ; and specifications. 4. Roadway pavements in alleys shall be not less than 20 feet in residential sub- divisions and not less than 22 feet in business or manufacturing subdivisions, and shall be installed in accordance with Village standards and specifications. 5e Curbs or curbs and gutters when required shall be installed in accordance with the Village standards and specifications, except curbs or curbs and gutters are - 23 - w - a -" not required, unless requested by the Plan Commission, in residential sub- divisions where lots are one-half acre or more in area. 6. Paved sidewalks shall be installed in accordance with Village standards and specifications on both sides of the street or on one side of a street if approved by the Plan Commission in residential subdivisions containing lots less than one- - half acre in area and in all business and manufacturing subdivisions . Such pav- ed sidewalks may be required by the Plan Commission on one side or both sides of a street in subdivisions containing lots one-half acre or more in area. Side- - walks in residential subdivisions shall not be less than five feet wide, and in manufacturing and business subdivisions width of sidewalks shall be as approved by the Plan Commission . 7. Street lighting . When required by the Village Board, the subdivider shall install a street lighting system in accordance with Village standards and specifications as established specifically for areas within each of the zoning district classifications. Such street lighting system shall be installed within three years after the date of approval by the Village Board, of the Final Plat, or in the event 75 percent of '- the lots are not built upon within this three-year period, the Village Board may extend the time to six months after 75 percent of the lots have been developed. 8. Street signs shall be erected so as to identify every street within the subdivision and shall be so designed and constructed as to conform with existing street signs. They shall be installed at a height not less than seven feet and shall be placed not less than one foot nor more than ten feet from the edge of the pavement. 9. Storm-water inlets and catch basins shall be provided at locations and of the de- sign and specifications as required by the Village Engineer. 10. All curb or roadway pavement corners shall have a radius of not less than 25 feet. 11 . All side-strips within a street right-of-way shall be graded and seeded in accord- ance with Village standards and specifications. 12. Trees shall be planted along all streets where trees do not exist. Trees shall have a trunk diameter, measured 12 inches above the ground, of not less than _ two and one-half inches, and shall be spaced not more than 50 feet apart. This requirement will be satisfied if an equivalent number of trees of the same size or larger are planted in a naturalistic manner in the front yards of the adjoining lots. The plantings shall be restricted to thornless honey locusts, sugar maples, hackberries, pin oaks, sycamores, ginkgos, and/or any other trees approved by the Village Board . Chinese elm, box elder, willow, poplar, and similar fast- growing brittle-wood species are prohibited. E. PEDESTRIAN WAYS Paved walks shall be installed to a width of not less than five feet, in accordance with the Village sidewalk specifications. 24 - -37 F. PUBLIC UTILITIES 1 , All utility distribution I ines for telephone, electric and gas service in the sub- - division shall be placed underground . Installation of such facilities shall be made in compliance with the applicable orders, rules and regulations of the Illinois Commerce Commission now or hereafter effective and the subdivider shall be responsible for compliance with rules and regulations, now and here- after effective and filed with said Commission pursuant to the Illinois Public Utilities Act, of any public utility whose services will be required for the sub- division with respect to the provision of such underground facilities . 2. Underground telephone, electric and gas service shall be placed within ease- '- ments or dedicated publ is ways in a manner which will not conflict with other underground services . Further, all transformer boxes shall be located so as not to be unsightly or hazardous to the public. SECTION XII FEE FOR FILING PRELIMINARY PLAT A fee of $ .20 per lot with a minimum fee of $10.00 shall be paid by the subdivider to the Village at the time of filing the preliminary plat with the Village Board at the office of the Village Clerk. SECTION XIII PERMITS FOR UTILITY SERVICES Permits shall be obtained from the governing body for the installation of communication, electric power, gas, and other utility services in public or private rights-of-way or easements, as shown on the final plat, and the required fee paid before any installation is started. SECTION XIV VILLAGE ENGINEER'S SERVICES The cost incurred by the Village for the review of plans and specifications by the Village Engineer shall be paid by the owner or subdivider. Such costs shall be paid to the Village Clerk at the time of application for approval of a final plat. All required land improvements to be installed under the provisions of this ordinance shall be inspected during the course of construction by the Village Engineer or other village employee duly appointed by the Village Board . The cost of such in- spection shall be at a rate fixed by the Village Board and shall be paid by the owner or subdivider to the Village Clerk. -- SECTION XV BUILDING PERMIT No building permit shall be issued by any governing official for the construction of any building, structure, or improvement to land or any lot within a subdivision, as defined herein, which has been approved for platting until all requirements of this ordinance have been fully complied with. SECTION XVI OCCUPANCY PERMIT No occupancy permit shall be granted by any governing official for the use of any structure with- _ in a subdivision approved for platting or re-platting until required utility facilities have been in- stalled and made ready to service the property; and that roadways providing access to the subject lot or lots have been constructed or are in the course of construction and are suitable for vehi- cular traffic. - 25 - -3 '7 SECTION. XVII VARIATIONS The Plan Commission may recommend variations from these requirements in specific cases which, in its opinion, do not affect the Official Plana or intent of this ordinance. Such recommendations shall be communicatedto the Village Board or governing county authorities in writing, substan- tiating the recommended variation. The Village Board may approve variations from these re- quirements for subdivisions within the village limits when, in its opinion, such variations will not adversely affect the Official Plan or the spirit of the ordinance. SECTION XVIII ENFORCEMENT No plat of any subdivision shall be entitled to record in the Recorder's Office or have any _ validity until it shall have been approved in a manner prescribed in this ordinance. SECTION XIX RECORD OF PLATS _ All of such plats of subdivisions, after the same have been submitted and approved as provided in this ordinance, shall be filed and kept by the Village Clerk among the records of the Village of Oak Brook. SECTION XX VALIDITY If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held — to be invalid, such decision shall not affect the validity of the remaining portions of this ordi- nance. SECTION XXI VIOLATION PENALTY Anyone violating any of the provisions of this ordinance shall forfeit, upon conviction, to the Village of Oak Brook not less than $10.00 or more than $200.00 for each violation, plus the costs of the action, and each day that such violation continues shall be deemed to be a sepa- rate offense. SECTION XXIF EFFECT All ordinances or parts in conflict with the provisions of this ordinance are hereby repealed. This ordinance shall be in full force and effect from and after its passage and publication ac- cording to law.
