G-44 - 03/12/1963 - STREETS - Ordinances JEB:KM 3-12-63 1 & 9 cc. - �'sTi4,8 SHMNT 19143 AN ORDINANCE ESTABLISHING LOAD LIMITS ON CERTAIN STREETS, ROADS AND PUBLIC WAYS WITHIN THE VILLAGE OF OAK BROOK, DU PAGE COUNTY, ILLINOIS WHEREAS, there are certain streets , roads and public ways within the Village of Oakbrook which are under the jurisdiction of and maintained by the Village of Oakbrook; and WHEREAS, it is found and determined by the President and the Board of Trustees of the Village of Oakbrook that during the late winter and spring season between the 15th day of February and the 15th day of May such streets , roads and public ways are parti- cularly susceptible to damage because of use by heavy vehicles ; and WHEREAS, in order to protect the public welfare, safety and health it is deemed necessary to establish a gross limit to the weight of vehicles using such streets, roads and public ways; NOW, THEREFORE, BE IT ORDAINED by the President and the Board of Trustees of the Village of Oakbrook: Section 1. That from and after the effective date of this ordinance to and including the 15th day of May, 1963, and between the 15th day of February and the 15th day of May of each year there- after there is hereby established a gross weight limit of twenty L thousand (20,000) pounds on all streets , roads and public ways within the Village of Oakbrook which are under the jurisdiction of and maintained by said Village of Oakbrook. Section 2. That no person., firm or corporation shall operate, maintain, or permit to be operated or maintained, any vehicle under his control upon, over or across such streets , roads or public ways upon which a limit has been established by this ordinance, the gross weight of which, including load, if any, and vehicle, shall exceed twenty 'thousand (20,000) pounds. Section 3. The Village President of the Village of Oakbrook is hereby authorized and directed to cause to be erected upon the Gr -44 entrance to all such streets, roads or public ways an appropriate sign posting the weight limits herein established during the appropriate times of the year. Section 4. No person, firm or corporation violating the provisions of this ordinance shall, upon conviction thereof, be fined not less thnFive Dollars nor more than Two Hundred Dollars for each such offense provided that no person, firm or corporation shall be convicted for the violation of the terms of this ordinance until the signs mentioned in Section 3 hereof shall have been erected. BE IT FURTHER ORDAINED that this ordinance shall be in full force and effect from and after its passage and approval as in such cases made and provided.
