G-186 - 05/25/1976 - ZONING -VARIATION - Ordinances ORDINANCE NO. AN ORDINANCE GRANTING A. VARIATION FROM SECTION X, B, 5, a OF ORDINANCE NO. G-60, THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, TO THE LIONS INTERNATIONAL PROPERTY AT THE INTERSECTION OF YORK AND 22ND -STREET, OAK BROOK ILLINOIS. WHEREAS, the territory described in Section 3 hereof is located within the Village of Oak Brook, DuPage and Cook Counties, Illinois; and WHEREAS, said territory is within an ORA-1 District as established by the Zoning Ordinance of the Village of Oak Brook, Ordinance No. G-60, as amended; and WHEREAS, the owner of said territory, The International Association of Lions Clubs, has petitioned for a variation to said Ordinance No. G-60, Section X, B, 5, a, said petition having been presented pursuant to Section XIII, G of said Ordinance; and WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook held a public hearing on May 4, 1976, pursuant to the statutory public notice, to hear testimony concerning the aforesaid petition; and WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has recommended that the requested variation be granted based on findings of fact that a similar variation was previously granted to the said territory, the plight of the owner is due to unique circumstances because of the earlier actions of the Village in granting a building permit and variation and the present variation will not alter the essential character of the locality because of the decorative function of the proposed improvement. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees, of the Village of Oak Brook, DuPage and Cook Counties, Illinois, that: SECTION 1: The provisions of the preamble hereinbefore set forth are hereby restated herein as though herein fully set forth. SECTION 2: A variation from Section X, B, 5, a, is hereby granted to allow construction of a fountain with a pool in the front yard of the below described territory pursuant to the plans and rendering by Joseph Legat Architects dated March 31, 1976. SECTION 3: The territory granted the variation pursuant to this Ordinance is legally described as follows: Lot 4 in Butler Company-M-1 Inc. Assessment Plat-No. 4, being a Subdivision of part of the Southeast Quarter of Section 24, Township 39 North, Range 11, East of the Third Principal Meridian according to plat thereof, recorded July 8, 1964 as Document No. R64-24071 in DuPage County, Illinois. and commonly known as Lions International, York and 22ND Street, Oak Brook, Illinois. SECTION 4: All ordinances, rules and regulations, of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict and only as they apply to the property here- inbefore described. Ordinance No. S-316 of the Village of Oak Brook is hereby specifically repealed. SECTION 5: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. SECTION 6: This Ordinance shall be in full force and effect from and after its passage, approval, and publication as provided by law. This Ordinance shall be published in pamphlet form.
