G-203 - 12/14/1976 - ZONING - Ordinances ORDINANCE NO. AN ORDINANCE AJIENDING SECTION V, VI, VII, X, XI, XIII AND XIV OF ORDINANCE G-60, AS MIENTED, THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUITIES, ILLINOIS. WHEREAS, the President and Board of Trustees of the Village of Oak Brook adopted Ordinance No. G-60, the Zoning -Ordinance of the Village of Oak Brook, in order to regulate and limit the height and bulk of structures; to regulate and limit the intensity of the use of lot areas, and to regulate and determine the areas of open space within and surround- ing such structures; to classify, regulate and restrict the location of trades and , iidust.ries-, and the location of struct res designed for specified industrial, business, residential, and other uses; to divide the entire Village into districts for the purpose of the ordinance; to fix standards to which structures shall conform; to prohibit uses or structures incompatible with the character of such districts respectively; and to prevent additions %o and alterations or remodeling of existing structures in such a way as to avoid the restrictions and limitations lawfully imposed thereby., and to provide penalties for violations thereof; and WHEREAS, certain amendments to the aforesaid Zoning Ordinance have been proposed by the Plan Commission of the Village of Oak Brook to clarify and amend certain provisions of the aforesaid Zoning Ordinance, and WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has held a public hearing, pursuant to statutory notice, on the proposed amendments and has recommended approval of said amendments by the President and Board of Trustees. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois that: SECTION 1: The provisions of the preamble hereinabove set - forth are hereby restated herein as though herein fully set forth. SECTION 2: Section V.G.3.d. (3) of Ordinance No. G-60, as `'mended, is hereby amended to read as follows: (3) be located not less than five (5) feet from the side or rear lot line. SECTION 3: Sections V.G.3.h. (13) and (23) of Ordinance No. G-60, as amended, are hereby amended as follows: ;(13) Open off-street parking spaces may be permitted in a required yard adjoining a street, as regulated in this ordinance. (23) Trees, shrubs, and other plants - except on corner lots, where no such material shall be permitted to obstruct a clear path of motorists' vision of approaching vehicles within the area enclosed by any two intersecting curb lines or edges of pavement, as extended to their point of inter- section if necessary, whichever is applicable, and a straight line connecting those two lines at points sixty (60) feet from their point of intersection. .r SECTION 4: Section VI .A. of Ordinance No. G-60, as. amended, .s hereby amended to delete the following phrase: R 5 Single-family Detached Residence SECTION 5: Section VII .B.2d. (2) of Ordinance No. G-602 as amended, is hereby amended to read as follows: (2) Each sign shall not be more than six (6) square feet in area and it shall be located not closer than eight (8) feet from a side or rear lot line and not closer than one-half the depth of the required front yard from a front lot line . SECTION 6: Section VII .E.3 of Ordinance No. G-60, as amended, is hereby amended by the addition of the following sentence at the end there- of: 1 � The dedicated land shall be appropriate for park or recreational uses, and shall not include wet drainage ways in excess of 25% of the total dedicated area. SECTION 7: Section VII .F.3 of Ordinance No. G-60, as amended, As hereby amended by the addition of the following sentence at the end there- of: The dedicated:Aand shall be appropriate for park or recreational uses, and shall not include wet drainage ways in excess of 25% of the total dedicated area. SECTION 8 Section X.B. I.d of Ordinance No. G-60, as amended, is hereby amended to delete the phrase "the district" from the end of the first sentence thereof and insert in its place the phrase "the lot on which the accessory use is located. " E SECTION 9: The second sentence of Section XI .D.l. of Ord 3 inance No. G-60, as amended, is hereby amended to delete the phrase "in rear yards" and to substitute therefore the phrase "at the rear of the building . " SECTION 10: Section XI .E. 12.a. of Ordinance No. G-60, as amended, is hereby amended by deleting subparagraph (2) thereof, and renumbering the remaining subparagraphs to conform thereto. Sections XI . '. 12.b. (1) (2) (4) (6) (7) (8) (9) (a) (b) , c. (1) (2) (3) and d. (3) (4) k5) (8) (10) (11) of Ordinance No. G-60, as amended, are hereby amended and subsections c. (4) and (5) are hereby added to read as follows: b. (1) Theaters, Auditoriums and other places of Public Assembly accessory to schools and other institutional establish., ments - One Parking space for each 2.5 seats. (2) Churches, Chapels, Temples and Synagogues -- One parking space for each 4 seats. (4) . Clubs, Lodges and Fraternities -- One parking space for every 100 sq. ft . of floor space, or part thereof. (6) Hospitals -- One parking space for every 500 sq. ft . of floor area, or part thereof. (7) Libraries, Museums, and Art Galleries One parking space for every 500 sq. ft . of floor area, or part there- of. (8) Sanitariums, Health Resorts, Institutions for Care of Aged or Children and Nursing Homes -- One parking space for every 1, 000 sq. ft . of floor area, or past thereof. -2- (9) Schools (a) Commercial or Trade, Music, Dance and Business - - One parking space for every 250 sq. ft. of floor area, or part thereof. (b). High: One parking space for each six students plus one for each faculty member and one for each other full time employee. c. (1) Bowling Alleys -- One parking space for every 200 sq. ft. of floor area, or part thereof. (2) Health Salons and Skating Rinks -- Commercial One parking space for every 100 sq. ft. of floor area, or part thereof. (3) Parks, Playgrounds, Outdoor Recreation and Indoor Recreation -- One parking space for every 10,000 sq. ft. of area. (4) Swimming Pools -- Commercial -- One parking space for every 75 sq. ft. of surface water area when filled. (5) Golf Courses -- 100 parking spaces for every 9 holes plus 11 parking spaces for each hole not included in a set of 9 holes. d. (3) Banks and other Financial Institutions -- One parking space for every 250 sq. ft. of floor area, or part thereof. (4) Barber Shops and Beauty Parlors -- Three parking spaces for each operator' s chair. (5) Furniture and Appliance Stores; Motor Vehicle Sales Establishments, and Establishments for repair of Household Equipment and Furniture -- One parking space for every 200 sq. ft. of floor area, or part thereof. (10) Restaurants -- not including drive-in establishments One parking space for every 100 sq. ft. of floor area, or part thereof. (11) Theaters, except Open Air Drive-Ins -- One parking space for each 2. 5 seats. SECTION 11: Section XIII.D. of Ordinance No. G-60, as amended, is hereby amended to delete the phrases "Two Dollars" and "Fifty Cents" from the last line thereof and to add in their place the phrases "Ten Dollars" and "One Dollar" respectively. SECTION 12 : Section XIV.B. 4. , 76 and 89 of Ordinance No. G-60, as amended, are hereby amended, and Sections XIV.B. 63. 2 and 155. 1 are hereby added, to read as follows: B. 4. Adjoining - touching, as distinquished from lying near 63. 2 Health Club - the meeting place of a group of persons organized for the purpose of improving the general condition of their health through exercise. _3_ 76 . Lot - a parcel of land consisting of adjoining parts which (at the time of filing for a building permit) is designated by its owner or developer as a parcel to be used, developed, or built upon as a unit, under single ownership or control. Therefore, a "lot" may or may not coincide with a lot of record. 89. Lot Width - the length of a line parallel to the street measured at the front lot line, except on a curvilinear street where it shall be a line parallel to. the street measured at the setback line. 155, 1 Wet Drainage Way - Any stream, creek, brook, branch, natural or artificial depression, slough, gulch, reservoir, lake, pond or natural or man-made drainage way in, or into which, storm water runoff or floodwaters flow regularly. SECTION 13: The Village Manager is hereby directed to arrange the words and phrases defined in Section XIV.B. of Ordinance No. G-60, as amended, in alphabetical order and number them consecutively in the next edition of the Oak Brook Zoning Ordinance to be printed for distribution. Such revised reference numbers shall be effective upon approval of said "ext edition by the President and Board of Trustees of the Village of Oak�- rook. SECTION 14: The following general modifications are hereby adopted to Ordinance No. -U-60, as amended; A. All references to 22nd Street or Cermak Road shall be revised to read as follows: 22nd Street (Cermak Road) B. All references to 31st Street or Oak Brook Road shall be revised to read as follows: Oak Brook Road (31st Street) - C. All references with respect to setbacks along 22nd Street (Cermak Road) shall also apply to Butterfield Road and such references shall be amended by adding "and Butterfield Road" after "22nd Street (Cermak Road) " in each such reference . SECTION 15: All ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance t re hereby repealed solely to the extent of the conflict. SECTION 16: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance . SECTION 17: This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. This ordinance shall be published in pamphlet form.
