G-215 - 04/24/1977 - ZONING - Ordinances ORDINANCE NO. AN ORDINANCE AMENDING ORDINANCE NO. G-60, AS AMENDED, THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, AS IT RELATES TO TRAILERS AND HABITABLE VEHICLES= WHEREAS, the President and Board of .Trustees of the Village of Oak Brook have adopted a zoning ordinance pursuant to the Statutes of the State of Illinois and for the purposes set forth therein; and WHEREAS, the President and Board of Trustees of the said Village have adopted a building code pursuant to the Statutes of the State of Illinois and for the pur- poses set forth therein; and WHEREAS, the said Village desires to enforce compliance with the bulk regulations of the aforesaid zoning ordinance; and WHEREAS, the said Village desires to prevent or restrict the use of structures which may not comply with the aforesaid building code; and WHEREAS, the said Village desires to prevent the overcrowding of land within its boundaries; and WHEREAS, the Village desires to protect the scenic beauty and residential ` atmosphere of the Village; and WHEREAS, all public hearings as required by law have been held by the appropriate governmental bodies of the Village pursuant to proper public notice and each has submitted the various reports or recommendations or both required of them; and WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the said Village. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, that: SECTION 1: The provisions of the preamble hereinbefore set forth are hereby restated herein as though herein fully set forth. SECTION 2: Section XIV B. of Ordinance No. G-60, as amended, is hereby amended by addition of the following definitions as subsections 63. 1 and 150. 1 thereof: 63. 1 HABITABLE VEHICLE - a vehicle designed, constru- cted or modified to permit its use as temporary or permanent living,or working quarters. 150. 1 VEHICLE - every device, in, upon or by which any person or property is or may be transported or drawn upon a highway except for devices moved by human power or used exclusively upon stationary rails or tracks. SECTION 3: Subsections 94 and 145 of Section XIV B. of Ordinance No G-60, as amended, are hereby amended to read as follows: Page 2 94. MOTOR VEHICLE - a passenger vehicle, habitable vehicle, truck, truck-trailer, trailer or semi-trailer propelled or drawn by mechanical power, 145. TRAILER - a vehicle or portable structure which may be used as a conveyance on streets and highways by attachment to a motor vehicle. SECTION 4: Section V. H. of Ordinance No. G-60, as amended, is hereby amended to read as follows: H. Trailers and Boats and Habitable Vehicles. 1. Trailers and vehicles shall not be permitted in any district as principal or accessory structures on a lot. 2. Habitable vehicles, utility trailers, horse trailers, boats on boat trailers or blocks, and other trailers shall not be parked or stored in the open on any lot, except when permitted in this Ordinance, or in the operations of a lawfully established trailer or habitable vehicle sales or manufacturing establishment. 3. One habitable vehicle, and one utility trailer, horse trailer, or one boat on a boat trailer or blocks, or one other trailer, owned by the occupant of the dwelling, may be stored or parked only to the rear of said dwelling and not within the side yards or rear yard of a lot containing a single-family detached dwelling, provided no major repair, disassembly, or rebuilding operations are conducted thereon, and provided that no habitable vehicle so stored may be occupied. 4. A habitable vehicle may be parked or stored in the driveway on property within the zoning jurisdiction of the Village for a period of three days without permit, and may be occupied during such period. Thereafter such a vehicle may be parked within the zoning jurisdiction of the Village only after issuance of a permit by the Building Inspector permitting such park- ing. Such a permit may be issued by the Building Inspector for the following purposes if the proposed use is consistent with the purposes of this Ordinance: (a) for parking of habitable vehicles for use as temporary office or storage space incidental to and only for the period of time of construction of a building or series of buildings, provided such habita- ble vehicles are located on the same lot or contiguous lots to the building or series of buildings. (b) for parking and occupancy of a vehicle on a lot containing a dwelling for a period not to exceed 10 days in any consecutive 30 day period and only if the location of said habitable vehicle on such lot does not violate the provisions of this Ordinance in relation to the placement of structures on such lot; except that such temporary parking shall be permitted on existing driveways notwithstanding that said drive- way may be in a sideyard. Page 3 SECTION 5: All ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed solely to the extent of the conflict. SECTION 6: If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. SECTION 7: This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. This Ordinance shall be published in pamphlet form.
