AN ORDINANCE ANIE'NDING SECTION I2- 87 OF THE CODE OF
ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLMIS AND. ADJUSTING
WATER SUPPLY AND INSPF:c,rlON FEES, CONNECTION FEES AND
WATER CONSUMPTION CHARGES
WHEREAS, the President and Board of Trustees of the Village of Oak
Brook, Illinois have heretofore , by ordinance established rates , fees ,
and service charges for water useage ; and
WHEREAS, the President and. Board of Trustees deem a revision of
such rates , fees , and charges , and the passage of this Ordinance to be
in the best interest and in pursuance of the general welfare of the
Village;
NOW, THEREFORE,- BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS
as follows :
Section 1 : That Section 12- 87 (C) (1) through (9) inclusive , of
the Code of Ordinances of the Village of Oak Brook, Illinois be and is
hereby amended to read as follows :
. (C) Water Supply and- Inspection Fees:
(1) Water supply construction not• built as part of the
required improvements of a new subdivision, as
follows :

(b) Water supplied by Oak Brook. This fee in-
cludes a connection fee and a fee for inspection
of all lines . The meter charge includes the
cost of the meter and installation to con-
nections installed by owner. There shall be
a fee for a water meter based on the- actual
costs for time and materials incurre.d .by the
Village. It does not include the actual cost
of the installation of the lines or fittings .

issuance of occupancy permits determined
in the manner provided in paragraph. (ii)

(ii) The fee determined pursuant to paragraph (i)
above shall be recomputed by the Village upon
the expiration of a period of thirty-six (36)
months after the first full month of usage
as determined . above , as follows :
$2 . 28 x gallons used per meter reading for

The fee so recomputed shall then be adjusted by
the amount determined and paid pursuant to para-.
graph (i) above , and any additional amount re-
sulting from said recomputation shall be paid
when billed and any reduction resulting therefrom
..shall be reimbursed by the Village .
(iii) In the event there is a substantial change in
the use of the premises subject to the fee
hereinabove provided at any time during the
thirty.-six month term described above, the fee
Provided in paragarph (i.) hereof shall be re-
computed in accord with paragraph (.ii) hereof
as though the month in which the change in use
occurs were the last month of the thirty-six
month term provided in paragraph (ii) hereof.

($1 . 00) per one thousand (1000) gallons .
An additional charge of ten (10) percent is hereby
added to bills not paid within twenty-one (21) days of
billing date.
There shall be charged a fee of Ten Dollars ($10 . 00)
for all payments returned by the maker ' s bank for non-
sufficient funds , regardless of date payment was at-
tempted.
Private Fire Protection Connections:

Unmetered water during construction (for water used prior to
meter being installed within sixty (60) days in accordance
with Section 12- 70 (d) ) :

When billing occurs other than on a monthly basis the
minimum rate shall be prorated proportionately to the
period billed and the gallonage charges shall be based on
actual usage proportionately increased for the period billed.

Section 2 : That Section 12- 87(C) ( 12 ) of the Code of Ordinances of
the Village of Oak Brook , Illinois be and is hereby amended to read as
follows :
( 12) Construction Water. Unmetered water during
construction ,. as provided in Section 12- 70 (D) hereof:
(a) 1" service or smaller . . . . . . . . . . . . . . . . . . . $ 50 . 00
(b) 1Y' to 3" service inclusive . . . . . . . . . . . . . $100 . 00

Water used in excess of sixty (60) days and
water used on a temporary basis, whether metered
or not , will be billed at the rate of $2 . 00 per
1, 000 gallons .
Section 3: All ordinances , `rules , and regulations of the Village
of Oak Brook which are in conflict with the provisions of this Ordinance
are hereby repealed to the extent of such conflict .
Section 4: If .any section, sub-section, sentence, clause, or phrase
of this Ordinance is for any reason held to be invalid, such determina-
tion shall not affect the validity of any remaining portion of this
Ordinance.

v Section 5 : This Ordinance shall be in full force and effect from
and after its passage, approval , and publication in pamphlet form as
provided by law, provided, however, that the water consumption charges
set forth in Section 2 hereof amending Section 12-87 (C) (9) (i ) and (ii)
shall--only be effective as to water coifsumed subsequent to March 21,
1981 and:
( 1) billed to commercial customers after May 1 , -1981 ; or
(2) billed to residential customers after June 1 , 1981 .
Any water consumption billings prior to said respective dates shall be
at the rates heretofore established pursuant to ordinance.
All other rates , fees and charges established or amended herein shall be
in full force and effect upon the passage , approval and publication in
pamphlet form of this Ordinance.
Section 6: The Village Clerk is hereby. authorized and directed to
publish this Ordinance in pamphlet form as required by law.
