G-289 - 03/24/1981 - ZONING - Ordinances ORDINANCE NO. G- 289 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK OF 1966 AND THE SUBDIVISION ' REGULATIONS OF THE VILLAGE OF OAK BROOK AND ESTABLISHING FEES FOR ZONING AMENDMENTS, SPECIAL USES, VARIATIONS AND APPEALS, BLOOD PLAIN VARIATIONS AND SPECIAL USES AND SUBDIVISIONS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows : Section 1 : That the Code of Ordinances of the Village of Oak Brook be and is hereby amended by adding to Chapter 2 thereof Article VII entitled "Fees" .. which shall read as follows : ARTICLE VII - FEES Section 2- 225 Fees :. The fallowing fees are hereby established and shall be payable upon submission of an application (ex- cept as otherwise specifically noted herein) for the following: (1) Application for Amendment or Special Use under the Zoning Ordinance - $150 . 00 (2) Application for Variation under the Zoning r Ordinance - $150 . 00 (3) Application for Appeal under the Zoning Ordinance $50 . 00 (4) Application for Special Use or Variation in flood plain - $150. 00 (5) Application for Subdivision : a) Preliminary Plat - $20 . 00 per lot , minimum fee of $25. 00; b) Final Plat - $100 . 00 c) Plans and Specifications : The following fees for the review of engineering plans and specifications shall be paid to the Village Clerk at the time the documents are submitted for review: Estimated Cost of Construction of Land Improvements Basic Minimum Fee No improvements -0- Less than $10,000 $ 275. 00 $10 ,000- $20,000 3.0% $20, 000-$50 , 000 2 . 5$ $50, 000- $100 , 000 2 . 25 $100 ,000 and over 2. 0 Ordinance G- 289 Amending Zoning 0rd. of 1966 & Sub . Uses , Variations & Subdivisions d) Engineering Inspection: At the time the subdivision plat is presented for final approval a fee for inspection of the improve- ment shall be paid to the Village in the amount indicated by the following table : Estimated Cost of Basic Minimum Fee Construction of Land (As a Percentage Improvements of Estimated Cost) Less than $10 , 000 $ 250 . 00 $10,000- $20 ,000 2 . 25a $20 , 000- $50 ,000 2 . 0% $50 ,000 and over 1. 500 Said fees shall be for the periodic inspection of the improvements which are to be within public rights-of-way or easements and not covered by other inspection departments of the Village. Section 2- 226 Waiver of Fees : Any governmental unit or any charitable organization as defined in "an act to regulate solicitation and collection of funds for charitable purposes , providing for violations thereof and making an appropriation therefor" , Chapter 23 Illinois Revised Statutes 1979 , Sections 5101, et sequitur, may request waiver of any fees established in this Article . Upon such request the President and Board of Trustees may, in its discretion, waive any such fees imposed pursuant to the terms of this Article . Section 2- 227 Other Fees : The fees established herein shall be In addition to any other fees or charges otherwise establish- ed by Ordinances of the Village . Section 2 : That Section XIII (K) of the Zoning Ordinance of the Village of Oak Brook of 1966 be and is hereby amended to read as follows : "Fees for any relief under this Ordinance shall be as otherwise established by separate ordinance" . Section 3 : That Article IX , Section 1 of the Subdivision Regulations of the Village of Oak Brook be and is hereby amended to read as follows : "Section 1 - Preliminary Plat Filing Fee : Fees for Preliminary Plats shall be a otherwise established by separate ordinance" . Section 4 : That Article IC , Section 3 of the Subdivision Regulations of the Village of 0ak Brook be and is hereby amended to read as follows : "Section 3 - Engineering Review and Inspection Fee : Fees for Village Engineer in review and inspection of improvements shall be as otherwise established by separate ordinance" . 1. Uses , Variations Subdivisions Section 5 : That Article VI -A, Section 2(I) (1 ) of the Subdivision Regulations of the Village of Oak Brook be and is hereby amended to read as follows "The Village Engineer shall review the land improvement plans and specifications , confer with the owner' s engineers and make periodic inspections furing con- struction of all required land improvements to assure compliance with the requirements of this ordinance. The fee for this work will be paid by the owner in accordance with the resume of fees established by separate ordinance of the Village The fees shall be due and payable following approval of the improvement plan prior to certification of the plan by the Village Clerk" . Section 6: That Article VI , Section 4 of the Subdivision Regulations of the Village of Oak Brook be and is hereby amended by amending the first paragraph thereof to read as follows ; "The Village Engineer shall review the improvement plans and specifications , confer with the subdivider' s engineers and make periodic inspections during construction of all required land improvements to assure compliance with the requirements of this ordinance . The fee for this work will be paid by the owner or subdivider in accordance with the resume of fees as otherwise established by separate ordinance by the Village. The fees shall be due and payable following approval of the final plat and prior to recording of the final plat" . - Section 7 : That all ordinances or parts thereof, including Appendix "B" of the Subdivision Regulations of the Village of Oak Brook, in conflict with the provisions of this Ordinance be and the same are hereby repealed to the extent of such conflict . , Section 8 : That the Village Clerk is hereby directed and authorized to publish this ordinance in pamphlet form in the manner provided by law. Section 9 : That this Ordinance shall be in fuli force and effect from and after its passage , approval and publication in pamphlet form, all as provided by law. Passed this 24th day of March 1981 .
