OF OAK NG BROOK, ILLINOIS, }ZI �;1lRI —--LINO--- _-4-- N G PERMITS FOR THE DRILLING - OF WATER hELLS AND PROk'1DING STAND_;TZDS TIIEREI:OIZ 11.111.iREAS, pursuant: to Section 11 - 20- 5 of the Illinois Municipal Code , Chapter 24 of the Illinois Revised Statutes , the corporate authorities may do all. acts and make all regulations for the promo- tion of heal.th ; and WHEREAS, Section 11-20-10 of said Illinois Municipal Code authorizes the corporate authorities to regulate the construction, repair and use of cisterns , hydrants , pumps , culverts , drains , and sewers , as well as the covering or sealing of wells ; and WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem it appropriate and consistent with the enhancel:lent of the public health) safety and welfare to create rules , regulations and procedures for the dril-ling of private hater wel.is 'xvithin the Village of Oak Brook ; NOW, THEIZEFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE V ILLAGI OF OAR BROOK, I)U PAGE AND COOK COUNTIES, ILLINOIS as follows : Section l : That Article VI of Chapter 12 of the Code of Ordin ances�be avid is here])), amended by adding thereto Division 3 entitled "Eater Wells", Sections 1.2-407 through 12--410 , inclusive, which shall read as fol-lows Section 12-407 Permit Required_- No person shall co:istruct or drill_ an), water, well. without first having obtained a permit from the Village pursuant to the procedures required herein . All words and terms used herein, except as otherwise defined shall. be as defined in the "Water Well and Pump Installation Cont: : ; tors License Act", Chapter 111 , Paragraph; 7103 of the Illiliois Revised Statutes , Section 12-408 Li.mitati.on of Permits : A) Auxiliary IJolls : No permit may be issued by the Vi.11ape for an auxiliary zaater wc-1 .1 where a suitable surface urater source is available . For purposes of this Section "auxiliary water well." micans a water well intended and used e._c lus ivel y for i rr i g.►t ion C and watering of crops or landscaping . In addition to the other standards and requirements of this Division the following concliti.ons shall be applicable to any auxili:ry well permit issued hereunder . 1 No interconnection of the auxiliary water v.ell system sha1.1 be "lade with any public or private water system serving; the propert)t for domestic use or huru!rl consumption . 2 . Wel.I construction .5ha1.7 be performed by a licensed con- tractor , licensed pursuant to the "1:atcr Well. and Pump Installation Contractors License Act" , Chapter 111 , Sections 7101 , et sequitur , of the Illinois Revised Statutes , and per£of-mcd pursuant to the standards there- in and any standards of the State of Il.linoi.s Depart- ment of Public licalth pro-mul.gated pursuant to the "Water Well Construction Code", Chapter 1112j Paragraphs 116 . 111 , et sequitur , of the Illinois Revised Statutes . 4 . The applicant shall- obtain any other necessary permits issued by the State of Illinois , -including any required Permit of the Department of Mines and 'Hinerals of the State of Illinois pursuant to Chapter 962, Para-graphs 5405 and 5420 of the Illinois Revised Statutes . E. Wells for Domestic Service and Potable Water: No permit may be issued for a water well intended to - pro- vide water for domestic use or- human consumption if the property intended to be served thereby is located within 250 feet of a Village public water distribution system. In addition to the other standards and requirements of this Division, the following conditions shall be applicable to any such permit issued hereunder . 1 . The applicant shall. execute a covenant , binding capon and running with the land, agreeing : a) to disconnect , abandon and seal the well to be in- stalled within six (6) months of the actual availability of a Village public water distribution system within 250 -feet of the property ; and b) to connect to said Village public water distribu- tion system at that time . 2 . Well construction shall be performed by a licensed contractor , licensed pursuant to the "Water Well and Pump Installation Contractors License Act", Chapter 1.11 , Section 7101 , et sequitur , of the Illinois Revise; Statutes and performed pursuant to the standards therein and any standards of the State of Illinois Department of - Public Health promulgated pursuant to the "hater Well Construction Code", Chapter 1112, Paragraphs 116 . 111 , et sequitur, of the Illinois Revised Statutes . 3 . The applicant shall obtain any other necessary permits issued by. the State of Illinois , including any required permit of the Department of Mines and Minerals of the State of Illinois pursuant to Chapter 962, Paragraph 5405 and 5420 of the Illinois Revised Statutes . Section 12- 409 Eater Well Specifi.cat.ions : A. Well Site : 1 . The well site shall have good surface drainage and if possible be hi-gh.cr than surrounding sources of pollution such as privies , cesspools , septic tanks and seiers . - 2 . Privy pits or seepage pits . . . . . . . . . . . . 100 feet g. Cesspools . . . . . . . . . . . . . . . . . . . . . . . . . . . . . 150 feet C. Construction and Installation : 1 . Well Drilling: a. The well driller shall at all times exercise care preventing contamination of ground water supplies .. b . Water used in the drilling operation shall be from a potable source. C . Every completed well. shall be immediately sealed against entry of contamination , either by installation of the pump and appurtenances as provided herein, or by capping the casing in a water-tight manner. .2 . Well Casings a . The minimum standard of well casing shall be welded or seamless steel pipe manufactured and marked in accordance with the specifications contained in bulletin number ASTM: 120- 61 .T9 issued by the American Society for Testing and Materials in 1957 and revised 1961 . ;Used pipe is not permitted. Inside diameter of the well casing shall be a minimum of five (5) inches c . The well casing shall extend not less than eight (8) inches above the adjacent floor or ground surface or , if the well is located in *a basement offset , not less than eighteen (18) inches above the basement floor . The top of the casing shall be sealed eater-tight . A pitless adapter , or pressure tank mounted on top of the l.el.l casing sliall. be ' considered an integral part of the casing . d . Casing joints shall be threaded or welded . All welding shall be clone by certified welders . e . A drive-shoe shall be used on the first length of casing . The entire length -of the drive-shoe shall. be driven into the limestone stratum . 3 Pumps a . The well pump may be installed in , directly over, or off-set from the well casing in accordance i.ith the type of pump used , but shall not be located in a crawl space or other inaccessible location. In all cases all openings into the wel_I casing except the vent pipe shall be used and its end shall be turned down , screened with non-corrosive 24 mesh screen , and s}iall terminate at least 12 inches above the top of the well casing. 4 . Pressure Storage : a . The pressure storage tank may be installed directly over the urell casing and attached to the casing by- means of a water- tight joint , or installed in a pro- tected, easily accessible location not subject to flooding . Tank location and/or method of connecting to the well casing shall be subject to the approval of the Superintendent of Public -horks . S . Protection Against Freezing : a . All parts of tile. water supply systerl sha11 be adequately protected from freezing . 6 . Pitless Adapters : a . Adapters and method of attachment to the casing shall be subject to the approx•a; of the Superintendent of Public lvorl:s . 7 . Well Pits R . Well pits shall not be permitted . S .- Steril.i.zation: a . Newly constructed wells must be disinfected with a chlorine solution of at least 1.00 parts per million , by the person or persons who install. the well seal . b. No well will be approved -until an analysis of a water sample collected by the owner or his agent after disinfection and pumping shows the water to be safe for drinking . Samples shall. be submitted to the laboratory of the Illinois Department of Public Health or any laboratory approved by that agency for water analysis . D. Maintenance - - Abandonment : 1 . Every water well shall be maintained in a safe condition by the owner. 2 . Every abandoned well shall be filled and sealed in accordance with the rules and regulations of the State of Illinois Department of Alines and Minerals . Section 12-410App1i cation—and_ Issuance of Permit : A. . Issuance Any permit as required hereunder shall be issued by the Superintendent of Public �:'orks upon application therefor upon forms provided by the Village, which application shall explicitly detail the location of the proposed well , as well as other information required to evaluate complete-. ness of that application in accordance with the standards and conditions set forth in this Division. All permit applications required hereunder shall be. filed with the Village Department of Building Inspection , v.hich department shall coordinate a.11 processing of such permits . B. Accompanying Documentation: The appl.icati.on shall be accompanied by scale drawings. of. the subject property indicating exact locations of all structures , sewers , septic systems and Proposed well thereon . C. Fee : Applications shall be accoinpanicd by a permit fee of $50 .00 . D. Other Permits : The provisions of this Division shall not waive any require- nlents of the Village for any other permit , boil(] or insurance required for any work associated with the d1-_illing o a weII as provided for hereunder . r Ordinance i\'o . Time Limit On Permits : Any permit issued hereunder shall be explicitly sub ; pct to a condition that substantial. work be commenced under such . permit within 30 days of its issuance and substantially completed i-vi.thin 120 days of its issuance . Section 2 : That all ordinances or parts thereof in con 'Iict- with the provisions of this Ordinance are hereby repealed to . the extent of such conflict . Section 3 : That this Ordinance shall be in full force and cf- feet from and after is passage , approval and publication in pamphlet form in the manner provided. by laid. Section 4 : That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form in the manner provided by law. .Passed this 901 day of _ June ' 1981 .
