G-294 - 06/09/1981 - LICENSE AGREEMENT - Ordinances ORDINANCE NO. G- -294 AN ORDINANCE AMENDING SECTION 3-28 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK RELATIVE TO CLOSING HOURS FOR RETAIL LIQUOR LICENSEES WHEREAS, Section 110 of Chapter 43 of the Illinois Revised Statutes authorizes the President and Board of Trustees of a Village to establish regulations and restrictions upon the issuance and opera- tions under local licenses not inconsistent with law as the public good and convenience may require ; and WHEREAS , the corporate authorities of the Village of Oak Brook have heretofore passed Ordinance S= 265 , codified as Section 3- 28 of the ,Code of Ordinances of the Village of Oak Brook; and WHEREAS, the President and Board of Trustees deem it advisable and in the best interest and in furtherance of the general welfare of the citizens of the Village that said Section 3-28 be amended ; NOW, THEREFORE BE IT ORDAINED BY TIIE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTI1-S , ILLINOIS as follows : Section 1 : That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2 : That Section 3-28 of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows : Section 3-28 Closing ; Hours of Business : It shall be unlawful to sell , offer for sale , cause to be sold or to give away in or upon any licensed premises , any alcholic liquor between the hours of 1 : 00 A.M. and 6 : 00 A.M. on weekdays and between the hours of 2 : 00 A.M. and 12 : 00- Noon on Sundays provided that on January lst of each year the hours during which no alcoholic liquor shall be sold at retail and during which the public shall not be admitted to any premises in or on which alcoholic liquor is sold at retail shall be. between 4 : 00 A.M. and 6 :00 A.M. unless such January 1st shall fall on a Sunday in which event such hours shall be from 4 : 00 A.M. to '12:00 Noon. It shall be unlawful to keep open for business or to admit the public to or to permit the public to remain within, or to permit the consumption of alcoholic liquor in or upon any licensed premises during the hours within which the sale of such liquor is prohibited ; provided, however , that in the case of restaurants and hotels , such establishments may be kept open for business during such hours , but no alcoholic liquor may be sold or consumed by the public on .or about such licensed premises . In addition to any other penalties provided by law, any person who violates any of the provisions of this Section shall be subject to a fine of not more than $500 . 00 for each such violation . G- 294 Page 2 Closing Hours Retail Liquor Licensees Section 3 : That all ordinances of parts thereof in conflict with the provisions of this Ordinance be and the same are hereby repealed. Section 4 : That this Ordinance shall be in full force and effect from and after its passage, approval and publication i.n pamphlet form . as required by law.
