ORDINANCE NO . G- 297
AN ORDINANCE AMENDING ARTICLE 1 .II OF CIIAPTER 12 Oh THE-
CODE OF ORDINANCES OF THE VILLAGE OF OAK BIZOOK REGARDING
CONSTRUCTION REGULATIONS FOR PUBLIC WORKS AND ESTABLISHI'';G
PLAN REVIEW AND INSPECTION FEES FOR CERTAIN 1%'01U
WITHIN STREET RIGI-iTS-OF-WAY
WHEREAS, Section 12- 37 of the Code of Ordinances of the Village
of Oak Brook requires that all construction , alteration , excavation ,
maintenance and repair within public street or alley ri.ghts -of-uray ,
other public ways or in public easements shall. be under the di-rection
of and subject to the approval and inspection of the Village Engineer ;
and
WHEREAS, Section 12- 38 of said Code of Ordinances requires a ner
mt therefor ; and
1;'HEREAS, Section 11- 80 - 2 of Chapter 24 of the Illinois Revised
Statutes authorizes the corporate authorities to regulate the use of
streets and other municipal property ; and
WHEREAS , the corporate authorities deem it advisable to establish
reasonable fees relating to the services of the Village Engineer rendered
pursuant to the permit and inspection provisions in Sections 12- 37
and 12-38 of said Code of Ordinances ;
NOW, THEREFORE, BE IT ORDAINED BY THE PRIESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DII PAGE AND COOK COUNTIES ,
ILLINOIS as follows :
Section 1 : That Section 12 - 87 (A) of the Code of Ordinances of
the Village of Oak Brook be and is hereby amended to read as follows :
Any street , drainage or traffi-c i.mpro-cement in-
volving any construction , alteration, excavation ,
maintenance , or repair within public street or
alley rights -of-way , other public ways or in
easements granted to the Village shall be subject
to the following engineering pl-an ,review and in-
spection fees prior to the i.ssuance of any permit
for such work :
1 . Plan Review - Actual hours of rep-i.ew
x $20 . 00 per hour . MiniflIUM, fee: $30 .00
2 . Inspection :

Said fees shall serve as partial reimbursement to the Village for
those services rendered in accordance with Sections 12-37 and 12- 3S of
this Code .
Notwithstanding , no fee shall. be charticd under th is Section 1-2 - ,;? (A') to:
(a) any municipal corporation , or (h) any public Util -itr franchi-red 1,,r

Section 2 : That all ordinances or parts thereof in confl. i-ct
with the provisions of this Ordinance be and the same are hereby re -
pealed to the extent of such conflict .
Section 3 : That this Ordinance shall be in full force and
effect from and after is passage , approval and publication in pamphlet
form as required by 1aw .
Section 4 : That the Village Clerk is hereby authorized and
directed to publish this Ordinance in pamphlet form in the manner pro
vided by law.
