AN ORDINANCE. AMENDING ARTICLE VII OF THE SUBDIVISION
REGULATIONS OF THE VILLAGE OF OAK BROOK, ORDINANCE
G- 140 , AS AMENDED, RELATIVE TO WATER WELLS
WHEREAS, the President and Board of Trustees have heretofore
;gassed and approved Ordinance G- 293 , codified as Sections 12-407
through, 12-410 , inclusive , of the Code of Ordinances of the said
Village ; and
WHEREAS, said Ordinance purports to regulate the drilling of
water wells and provides standards therefor within the said Village ;
and
WHEREAS, the provisions of said Ordinance in past conflict with
prior provisions of the Subdivision Regulations necessitating amend-
ment thereof; and
WHEREAS, the Village has filed an application for an amendment
to certain provisions of Article VII of said Subdivsion Regulations ;
and
WHEREAS, a public hearing thereon has been conducted on July 20 ,
1981 by the Plan Commission of the Village of Oak Brook pursuant to
due and appropriate legal notice ; and
WHEREAS, a recommendation has- been made by the said Plan Com
mission that the proposed amendments to the Subdivision Regulations
be made; and
WHREAS, ' the President and Board of Trustees concur with the re-
commendation of the Plan Commission and deem the passage of this Ordin-
ance to be in the best interest and in furtherance of the general
welfare of the Village of Oak Brook;
NOW, THEREFORE-, BE IT ORDAINED By TILE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUN'T'IES,
ILLINOIS as follows :
Section 1_: That Section 3(B) (3) of Article VII of the Subdivision
Regulations be and is hereby amended to read as follows :
Section "3 (B) (3) :
Subdivisions containing no lots less than one (1)
acre in area may be served with water supply from
individual wells . Within the corporate limits
of the Village such wells shall conform with
Village standards established by ordinance . In
unincorporated areas such wells shall conform with
all applicable standards of those governmental
authorities having jurisdiction for such wells .-
Individual wells shall be permitted in such sub-
divisions located within the Village only after
specifically approved by the Village Board when
it is determined that connection with a 'public
or community water supply system is not practicable .
Section 2 : That Section 2 (B) (4) of Article VII of the Sub-
division Regulations of the Village of Oak Brook be and is hereby
amended to read as follows :

Relative to Water Wells
' shall conform to the provisions of the Zoning
Ordinance for the district in which the subdivision
is located within the corporate limits of the
municipality. Lot sizes in those areas outside
the corporate limits shall be in conformance with
applicable ordinance regulating lot sizes outside
the corporate boundaries Where a water supply
system or sanitary sewer system is not available .,
the minimum lot area shall meet the requirements
set forth in Section 3 (B) (3) of this Article VII.
Section 3: That this Ordinance shall be in full force and
effect from and after its passage , approval and publication as pro-
vided by law.
Section 4 : That the Village Clerk is hereby authorized and
directed to publish this Ordinance in pamphlet form in the manner
provided by law.
Section 5 : That all ordinances in conflict with the provisions
of this Ordinance be and the same are hereby repealed to the extent
of such conflict.
