AN ORDINANCE. AMENDING ARTICLE VII OF THE SUBDIVISION
REGULATIONS OF THE VILLAGE OF OAK BROOK, ORDINANCE—
G-140 , AS AMENDED, RELATIVE TO GRADING AND
LANDSCAPING
WHEREAS, the President and Board of Trustees have heretofore
passed and approved Ordinance G-298 , codified as Sections 10-53
through 10-61 , inclusive, of the Code of Ordinances of the said
Village ; and
WHEREAS, said Ordinance purports to establish regulations
for the control of soil erosion and sedimentation and provides
standards therefor within the said Village ; and
WHEREAS, the provisions of said Ordinance in part conflict
with prior provisions of the Subdivision Regulations necessitating
amendment thereof; and
WHEREAS, the Village has filed an application for an amend-
ment to certain provisi-ons of Article VII of said Subdivision
Regulations ; and
WHEREAS, a public hearing thereon has been conducted August
17 , 1981 by the Plan Commission of the Village of Oak Brook pursuant
t to due and appropriate legal notice ; and
WHEREAS, a recommendation has been made by the said Plari
Commission that the proposed amendment to the Subdivision Regulations
be made ; and
WHEREAS, the President and Board of Trustees concur with the
recommendation of the Plan Commission and deem the passage of this
Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook;
NOW., THEREFORE, BE I`I' ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE Of, OAK BROOK, DU PAGE ANI) COOK COUNTIES,
ILLINOIS as follows :
Section 1 : That Section 3 (I) of Article VII of the Subdivision
Regulations be and is hereby amended by adding thereto a new sub-
section (S) which shall read as follows :
Sub-section 5
No permit shall be issued for any grading or land-
scaping involving any land modification as defined
in Section 10-54 (4) of the Code of Ordinances un-
less such work conforms to the standards set forth
in the "Soil Erosion and Sedimentation Regulations" ,
Article III of Chapter 10 of said Code of Ordinances .
Section 2 : That this Ordinance shall be in full force and
effect from and after its passage , approval and publication a

Section 3 : That the Village Clerk is hereby authorized and
directed to pub-lish this Ordinance in pamphlet form in the manner
provided by law.
Section 4 That all ordinances in conflict witli the pro
