G- 334 AN ORDINANCE AMENDING SECTION 12-87 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS AND ADJUSTING WATER CHARGES WHEREAS, the President and Board of Trustees of the Village of Oak Brook, Illinois have heretofore, by ordinance established rates, fees, and service charges for water useage; and WHEREAS, the President and Board of Trustees deem a revision of such rates, fees, and charges, and the passage of this Ordinance to be in the best interest and in pursuance of the general welfare of the Village; NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That Section 12-87 (C) (9) of the Code of Ordinances of the Village of Oak Brook, Illinois be and is hereby amended to read as follows: (9) Water Consumption Charges (i) Minimum Monthly Billing Minimum Monthly Billing Minimum Size of Meter (in) Min. An additional charge of ten (10) per cent is hereby added to bills not paid within twenty-one (21) days of billing date. There shall be charged a fee of fifteen dollars ($15.00) for all payments returned by the maker's bank for nonsufficient funds, regardless of date payment was attempted. Private fire protection connections: Up to and including 6" diameter, per month. . . . . . . . . . . . .. .. . . . .. . . . . . . .. . . . $ 12.75 Over 611, per month. .. . . . . . . . . . . . . . . . . . . . .. . . . . 25.50 Fire hydrant, per hydrant, per month. . . . . .. . . . . . . 2.50 Provided that none of said charges shall be applicable to properties paying fire protection water supply charges pursuant to Section 18-87 (C) (10) of this Code. Ordinance No. G- 334 Page 2 Ordinance Adjusting Water Charges Unmetered water during construction (for water used prior to meter being installed within sixty (60) days in accordance with Section 12-70 (d) Up to and including 1" service . . . ... .. . . ...$ 55.50 1-1/2" to 3" service, inclusive. . . .. . .. .. . ... 111.00 4" and larger service. . . . . . . ... .. . .. ... . .. . 222.00 When billing occurs other than on a monthly basis, the minimum rate shall be prorated proportionately to the period billed and the gallonage charges shall be based on actual usage proportionately increased for the period billed. Section 2: That Section 12-87 (C) (12) of the Code of Ordinances of the Village of Oak Brook, Illinois be and is hereby amended to read as follows: (12) Construction Water. Unmetered water during construction, as provided in Section 12-70 (D) hereof: (a) 1" service or smaller. .. . . . .. . $ 55.50 (b) 1-1/2" to 3" service inclusive. . . . . . . ... . . 111.00 (c) 411 or larger. . . . . . . . . . 222.00 Water used in excess of sixty (60) days and water used on a temporary basis, whether metered or not, will be billed at the rate of $2.20 per 1,000 gallons. Section 3: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 4: If any section, sub-section, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not . affect the validity of any remaining portion of this Ordinance. Section 5: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided, however, that the water consumption charges set forth in Section 1 hereof amending Section 12-87 (C) (9) (i) and (ii) shall only be effective as to water consumed subsequent to April 1, 1983 and: (1) billed to commercial customers after May 3, 1983 (2) billed to residential customers after June 7, 1983. Any water consumption billings prior to said respective dates shall be at the rates heretofore established pursuant to ordinance. Ordinance No. G- 334 Page 3 Ordinance Adjusting Water Charges All other rates, fees and charges established or amended herein shall be in full force and effect upon the passage, approval and publication in pamphlet form of this Ordinance.
