G-335 - 04/26/1983 - LICENSE AGREEMENT - Ordinances ORDINANCE NO. G- 335 AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 3 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS WHEREAS, certain amendments have been proposed to Article II of Chapter 3 of the Code of Ordinances of the Village of Oak Brook; and WHEREAS, the President and Board of Trustees have reviewed said proposed amendments and concur in the propriety of the same; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That Section 3-19 of the Code of Ordinances of the Village of Oak Brook, Illinois is amended to read as follows: Insurance prerequisite to issuance. No license shall be granted to any applicant until he has furnished evidence satisfactory to the liquor control commissioner that he is covered by a policy of dram shop insurance by a responsible insurance company authorized and licensed to do busines in the state insuring such applicant against liability for any injury or death which such applicant may incur under the provisions of Illinois Revised Statutes in the amount of one hundred thousand dollars ($100,000.00) to three hundred thousand dollars ($300,000.00) for bodily injury and death; fifteen thousand dollars ($15,000.00) for property damage liability; and twenty thousand dollars ($20,000.00) for loss of means of support. This section shall not be applicable to those licenses where the sale of liquor does not include any on-site consumption and is strictly package liquor sales only. Section 2: That Section 3-21 (a) of the Code of Ordinances of the Village of Oak Brook, Illinois regarding Class D licenses is amended to read as follows: License fees for Class D licenses be and is hereby amended to note a maximum fee of four thousand dollars ($4,000.00) per license. Section 3: That Section 3-21 of the Code of Ordinances of the Village of Oak Brook is amended by adding thereto subsection (d) which shall read as follows: The license fee for multiple date Class D licenses of 8 days or more made on a single application shall be subject to refund for any day thereof wherein alcoholic liquor is not sold or offered for sale upon presentation to the Village of proof thereof. Section 4: That all ordinances or parts thereof in conflict with the provisions of this Ordinance be and the same are hereby repealed to the extent of such conflict. Section 5: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form in the manner provided by law. Section 6: That this Ordinance shall be in full and effect from and after its passage, approval and publication in pamphlet form, all as required by law.
