G- 345 AN ORDINANCE AMENDING SECTION 12-87 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS AND ADJUSTING WATER CHARGES - -- WHEREAS, the President and Board of Trustees of the Village of Oak Brook, Illinois have heretofore, by ordinance established rates, fees, and service charges for water usage; and WHEREAS, the President and Board of Trustees deem a revision of such rates, fees , and charges, and in the passage of this Ordinance to be in the best interest and in pursuance of the general welfare of the Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That Section 12-87(C)(9) of the Code of Ordinances of the Village of Oak Brook, Illinois be and is hereby amended to read as follows: (9) Water Consumption Charges (i) Minimum Monthly Billing Minimum Monthly Billing Minimum Size of Meter (in) Min.Gal. Private fire protection connections: Up to and including 6" diameter, per month . . . .. . .......... . .. . .. ...... . .... . .$13.50 Over 611, per month . ... .... ... .. .. ... ... ...... .$27.00 Fire Hydrant, per hydrant, per month ... ....... ..$ 2.75 Provided that none of said charges shall be applicable to properties paying fire protection water supply charges pursuant to Section 18-87(C)(10) of this Code. Unmetered water during construction (for water used prior to meter being installed within sixty (60) days in accordance with Section 12-70(d) : Up to and including 1" service. .. . ... ... ..... . .$ 58.25 1-112" to 3" service, inclusive. . . ... ... . .... . .$116.50 4" and larger service.. . . .. .. . . . . . ... .. . .. ... . .$233.00 When billing occurs other than on a monthly basis, the minimum rate shall be prorated proportionately to the period billed and the gallonage charges shall be based on actual usage proportionately increased for the period billed. Section 2: That Section 12-87(C) (12) of the Code of Ordinances of the Village of Oak Brook, Illinos be and is hereby amended to read as follows: (12) Construction Water. Unmetered water during construction as provided in Section 12-70(D) hereof: (a) 1" service or smaller. . . . .. .. .. . . . ... . .$ 58.25 { (b) 1-1/2" to 3" service inclusive. .. . . .. . .$116.50 (c) 4" or larger. . .. .... . . . . . .. .. . . . . . . .. . .$233.00 Ordinance No. G- 345 Page 2 Ordinance Adjusting Water Charges Water used in excess of sixty (60) days and water used on a temporary basis, whether metered or not, will be billed at the rate of $2.30 per 1 ,000 gallons. Section 3: That Section 12-87(C) of the Code of Ordinances of the Village of Oak Brook, Illinois be and is hereby amended by adding subsection 14 as follows: (14) Due date of charges and fees; statements. If any statement for charges and fees required by Section 12-87, except the watermain expansion and connection fees set forth in Section 12-87(C) (11 ) , has not been paid in full within twenty-one (21) days of the date it was rendered, ten percent ( 10%) of the unpaid balance shall be added in the next statement as a late payment charge. There shall be charged a fee of fifteen dollars ($15.00) for all payments returned by the maker's bank for nonsufficient funds, regardless of date payment was attempted. Section 4: All ordinances, rules, and regulations of the Village of Oak Brook which are i.n conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 5: If any section, sub-section„ sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. Section 6: This Ordinance shall be in full force nd effect from and after its passage, approval, and publication in pamphlet form as provided, however, that the water consumption charges as set forth in Section 1 hereof amending Section 12-87(C) (9)(i) and ( ii) shall only be effective as to water consumed subsequent to May 1, 1984 and: (1) billed to commercial customers after June 26, 1984. (2) billed to residential customers after June 30, 1984. Any water consumption billings prior to said respetive dates shall be at the rates heretofore established pursuant to ordinance. All other rates, fees, and charges established or amended: herein shall be in full force and effect upon the passage, approval and publication in pamphlet form of this Ordinance. Section 6: The Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form as required by law. PASSED this 24th day of April , 1984.
