G-360 - 05/14/1985 - TRAFFIC - Ordinances © i RAFFi C.j ORDINANCE NO. G- 360 �- AN ORDINANCE AMENDING ORDINANCE NO. G-177, THE TRAFFIC CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS, AS AMENDED (Handicapped Parking) WHEREAS, the President and Board of Trustees of the Village of Oak Brook have heretofore enacted Ordinance G-177 being an Ordinance regulating traffic within the Village of Oak Brook, which Ordinance has from time to time been amended, and WHEREAS, the Illinois Legislature recently amended the Illinois Vehicle Code to permit local law enforcement agencies to enforce the handicapped parking regulations on private property and further mandated a $50.00 court fine if a person is found guilty of violating local handicapped parking legislation; and WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem it advisable and in the best interests and in furtherance of the general welfare and safety of the citizens of the Village that said Ordinance G-177 be further amended to conform with the recent amendments to the Illinois Vehicle Code which pertain to handicapped parking and to increase the payment in the event that a person wishes to settle a parking notice for an alleged handicapped parking violation; and WHEREAS, the proposed amendments are made pursuant to authority set forth in the Illinois Vehicle Code, Chapter 95 1/2 of the Illinois Revised Statutes as adopted by the Village of Oak Brook in Ordinance G-177. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby incorporated herein as though fully set forth herein. Section 2: That Section 1-1301.1 of Ordinance G-177 be and is hereby amended to read as follows: 1-1301.1 Unauthorized Use of Parking Places Reserved for Handicapped Persons. No person shall use any area for the parking of any motor vehicle on public or private property where an official sign controlling such area specifically prohibits parking at any time or during certain hours and reserves such areas as parking for handicapped persons only. It shall be prohibited to park any motor vehicle in such areas, except those vehicles: (a) Bearing registration plates or decals issued to a physically handicapped person pursuant to the provisions of the Illinois Vehicle Code, Chapter 95 1/2 of the Illinois Revised Statutes; or (b) Bearing registration plates or decals issued to a disabled veteran pursuant to the Illinois Vehicle Code, Chapter 95 112 of the Illinois Revised Statutes; or (c) Otherwise bearing such parking card or other device as approved by the Village of the type as referred to in Section 11-1301.2 of said Illinois Vehicle Code that the vehicle is operated by or for a handicapped person or disabled veteran, provided such approved parking card or other approved device must be prominently displayed on the dashboard or visor and be visible through the front windshield. Ordinance No. G 360 Amending Ordinance G-177, the Traffic Code (Handicapped Parking) `�- Page two Any person found guilty of violating the provisions of this Section shall be fined $50.00 in addition to any costs or charges connected with the removal or storage of any motor vehicle, where said removal or storage is authorized pursuant to Section 11-1301.3(b) of the Illinois Vehicle Code. Section 3: That Section 1-1320 of Ordinance G-177 be and is hereby amended to read as follows: 1-1320 Procedure in handling parking violation. The Police Department is authorized to place violation notices on every vehicle parked in violation of this Division and to cause summonses or warrants to be issued to commence prosecution against violators, except that the Police Department need not cause such proceedings to commence against any person for any violation of the provisions of this Division if such person renders payment to the Village according to the following schedule within the prescribed time limits as follows: Within 30 Days After 30 Days Provision of Violation of Violation Violated Notice Notice Sections 1-1301 through 1-1303, except Section 1-1301.1 $10.00 $20.00 Section 1-1301.1 $25.00 $50.00 All other violations under this Division XIII $ 5.00 $10.00 If said payments are not made within the time periods and in the amounts as prescribed above, the Police Department is authorized to issue appropriate summonses, warrants or notices to appear so as to commence proceedings in the Circuit Court for the Eighteenth Judicial Circuit, DuPage County, Illinois, and proceed with the matter in the same manner as other violations of this Ordinance �- pursuant to the penalty provisions set forth in the applicable section, or where no penalty is specifically set forth, pursuant to the general penalty provisions of Section 1-8 of the Code of Ordinances of the Village of Oak Brook. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form. Section 5: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form as required by law. PASSED this 14th day of May , 1985.
