G- 363 AN ORDINANCE AMENDING ARTICLE IX OF APPENDIX D (Personnel Rules and Regulations) OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK WHEREAS, Section. 979(f) entitled "Firemen's Continuance Privilege" of the Illinois Insurance Code (Chapter 73 of the Illinois Revised Statutes) extends certain group health insurance benefits to retired and disabled firemen.; and WHEREAS, the Village of Oak Brook wishes to extend certain group health insurance benefits to certain, retired or disabled employees; and WHEREAS, it is in the best interest of the Village that the Personnel Rules and Regulations reflect these changes. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: `- Section 1: That Section 1(A) of Article IX entitled "General Provisions ar~ .dam Prohibitions" of Appendix D, Personnel Rules and Regulations, of the Code of Ordinances of the Village of Oak Brook is amended to read as follows: ARTICLE IX. GENERAL PROVISIONS AND PROHIBITIONS Section 1: General Provisions. (A) Hospitalization, Insurance - 1) The Village of Oak Brook provides hospitalization insurance for all full-time employees and their dependents. The Village also assumes 100% of the cost for this benefit. The Basic Medical and Major Medical Benefits are described in the Certificate Booklet of Group Insurance. 2) Retired or disabled firemen., as defined in Article 4 of the Illinois Pension Code, may elect to receive Village group hospitalization, insurance for themselves and/or their dependents pursuant to paragraph 979(f) of the Illinois Insurance Code (Chapter 73 of the Illinois Revised Statutes) , provided that the full cost of said insurance shall be paid by the recipient. 3) Retired or disabled police officers, as defined in Article 3 of the Illinois Pension. Code, may elect to receive Village group hospitalization insurance for themselves and/or their dependents under the same terms as retired or disabled firemen., provided that the full cost of said insurance shall be paid by the recipient and provided further that in the evert there is a conflict between the provisions of Article 3 (Policemen's Penison, Fund - Municipalities 500,000 And Under) of the Illinois Pension. Code (Chapter 108 1/2 of the Illinois Revised Statutes) and the provisions of Article 4 (Firemen's Pension. Fund - Municipalities 500,000 And Under) of the Illinois Pension Code, the provisions of Article 3 shall govern. 4) Persons who have ter or more years of continuous full time employment with the Village of Oak Brook and who are eligible to receive an IMRF retirement or disability pension, may elect to receive Village group hospitalization insurance for themselves anal/or their dependents, provided that the full `�- cost of said insurance shall be paid by the recipient. Section 2: All ordinances, rules and regulations of the Village Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Paragraph 8 E, page 2, should be amended. H. Paragraph 11 on page 27, should be clarified. I. The notation of contract specs on page 21 et seq. should be amended to read anticipated frequency. The Village Board directed that these changes be incorporated and that the matter be brought back for the Village Board for approval of authorization to bid with bids due back to the Village no later than 45 days from the date of initial advertisement. The Village Board further directed that Staff bring back for further consideration materials concerning the maintenance building. IV. INSURANCE FOR DISABLED AND RETIRED EMPLOYEES: The Village Board directed Staff to draw up guidelines for the provision of this benefit to all employees based upon the respective retired or disabled employee paying all the premiums related to this benefit. The Village Board directed that the Staff further review the effect of retroactive application of this benefit so that the Board can consider the same when reviewing the proposed language incorporating the provision of such benefit. V. MICRO COMPUTERS: The Village Board reviewed the momorandum and recommendation of Finance Officer Terry Klein and reached a consensus that the Staff be authorized to proceed with the acquisition of three micro computers based upon the recommendation set forth in Mr. Klein's memorandum. VI. STONE SHOULDER POLICY: Discussion of this was deferred due to the absence of Trustee Maher. VII. ADJOURNMENT: Motion made by Trustee Rush, seconded by Trustee Bushy to adjourn. Brechin, Village Manager RE: Ordinance G-363 At a recent meeting with employee representatives, it was brought to my attention that the recently passed ordinance granting retirees insurance benefits (along . with disabled employees) has an inherent inconsistency. Specifically, it grants to fire and police employees the right for a surviving spouse to continue with insurance coverage. It does not, however, allow this contingency for a non-fire `— or police employee. i have discussed the matter with President Cerne and Trustees Rush and Winters. Please draft the appropriate amendment to that ordinance to eliminate this inconsistency at your earliest convenience. John r chin Villag Manager JHB/ko
