G-367 - 10/08/1985 - VILLAGE CODE - Ordinances ORDINANCE NO. G- 367 AN ORDINANCE AMENDING SECTION 12-47 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK WHEREAS, recent technology has produced a machine which accurately and economically cuts the top portion of curbs to obtain a depressed curb and gutter section without having to remove and replace the entire existing curbs and gutters; and WHEREAS, the structural and drainage qualities of the original curb and gutter remain if only the curb is cut and the entire original section is not removed and replaced; and WHEREAS, it is in the best interests of the Village that this new - technology be permitted in the construction standards set forth in Section 12-47 of the Code of Ordinances of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That Section 12-47 of the Code of Ordinances of the Village of Oak Brook, Illinois be and is hereby amended to read as follows: Section 12-47. Portland cement concrete curbs and combination curb and gutters. Curb height shall be six (6) inches. - Curb width shall be seven (7) inches. Combination curb and gutter width shall be nineteen (19) inches. Curb shall be type B and combination curb and gutter shall be type M-6.12 conforming to Illinois Department of Transporation Standard #2130 as revised from time to time. All curbs shall either be depressed across driveways during construction or shall be saw cut from the house side as a depressed section at the time of driveway construction. (Ord. No. S-305, Sec. 1 , 5-28-74) Section 2: All ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 3: If any section, sub-section, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. Section 4: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. Section 5: The Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form as required by law. PASSED this 8th day of October , 1985.
