G-375 AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 14 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK RELATIVE TO VILLAGE RECREATIONAL FACILITIES WHEREAS, the Village President and Board of Trustees have heretofore adopted rules and regulations for the Sports Core, Oak Brook Golf Club, and Bath and Tennis Club, codified as Article II of Chapter 14 of the Code of Ordinances of the Village of Oak Brook; and WHEREAS, the Village President and Board of Trustees deem further amendment of said rules and regulations to be in the best interest and in furtherance of the general welfare of the citizens of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 14-11(a) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: Section 14-11. Sports core open fields; utilization. (a) Scheduling: Requests to utilize the open field or show field areas for recreational sporting events shall be made at least thirty (30) days in advance and shall be reviewed and scheduled by the Sports Core Manager. Any proposed event involving concessions will not be scheduled until approval of any licenses required from the Village. Reservations for field use will be on a first-come, first-serve basis and confirmed only upon receipt of any required deposit. Use of the sports core for recreational sporting events which involves spectator admission fees or concessions shall be limited to nonprofit amateur organizations. Any nonsport open field or show field use shall be scheduled only after issuance of a permit by the Village. Section 3: That Section 14-11(e) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (e) Rental insurance. Any person renting outdoor sports core facilities shall be required to provide proof of insurance for the proposed activity as required by the Sports Core Manager. Section 4: That Section 14-12(a) (6) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (6) Junior. A minor child seventeen (17) years of age or younger. Junior members may play without payment of additional greens fees any time except: a. Wednesdays: b. Weekends or holidays before noon; c. If thirteen (13) years of age or under after 3:45 p.m. on weekdays unless accompanied by an adult. Members may play during the excepted times in a, b and c above by paying the prevailing greens fees. � . - , -� , , -� -� 5 Ordinance No o. G- 375 Amending Article II of Chapter 14 Relative to Village Recreational Facilities Page two Section 5: That Section 14-12(x) (7) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (7) Senior. Any person sixty (60) years of age or older. Senior members may play without payment of additional greens fees any time except weekends or holidays before noon. Members may play during these excepted times by paying the prevailing greens fee. Section 6: That Section 14-12(b) (2)(c) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (c) All accounts will be payable upon receipt of statements. Any balance not paid within thirty (30) days of the statement date shall be charged an interest fee of one and five tenths (1.5) per cent (eighteen (18) per cent annual rate) . Charging privileges on any accounts with unpaid balances over sixty (60) days old will be cancelled. Memberships will not be renewed until any balance from previous seasons has been paid in full. Section 7: That Section 14-12(b) (3) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (3) Identification cards. A resident of Oak Brook who does not hold a current Golf Club season membership card or a current Bath and Tennis Club membership card must obtain an annual resident identification card to qualify for resident greens fee rates. Junior or senior residents must obtain an annual junior or senior identification card to qualify for discount rates as applicable. Such cards shall be issued through the Village Hall withou-t charge upon application and verification of residency and/or age. Section 8: That Section 14-12(b) (5) entitled "Golf Leagues" is deleted. Section 1�4-12(b) (5) through (8) are hereby amended to read as follows: (5) Golf outings. A golf outing may be arranged through the golf pro/manager if, in the pro/manager's judgment, such a function will not significantly affect daily fee play. (6) Golf lessons. Lessons will be available for a fee through the Oak Brook Golf Club Pro/Manager. (7) Golf season. The Oak Brook Golf Club and Driving Range will be open between April lst and November 1st weather permitting. The course and driving range shall not be open during the one week annual period of the Western Open Golf Tournament. (8) Attire. Appropriate attire, including shirts, shall be worn at all times by persons utilizing the golf club. Section 10: That Section 14-12(e) (2) and 14-12(e) (3) of the Code of Ordinances of the Village of Oak Brook be and are hereby amended to read as follows: (2) The permanent reserved weekend starting time draw will be held annually in the spring after the brochure is mailed. Application for this drawing must be made in writing on forms provided by the Village. The order of drawing will be as follows: a. Unlimited resident season members; b. Unlimited corporate resident employee season members; c. Unlimited nonresident season members; d. Limited resident season members; e. Limited corporate resident employee season members; f. Limited nonresident season members; g. Residents; h. Nonresidents. (3) The drawing will be held under the following conditions: a. One person of a foursome can qualify for a drawing category; b. One person of a foursome must be present at the drawing; c. Only foursomes may apply for the drawing; d. A person may apply as a member of only one foursome; e. If all tee times are filled the drawing will continue to establish a standby list of golfers. These standby foursomes will be used to fill in any times that are cancelled before the golf course opens or for those times that are cancelled during the playing season. Section 11: That Section 11-12(f) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (f) Golf leagues. A golf league is any group of golfers of significant size for which a standard block of starting times is reserved on a consistent basis, normally weekly. There will be at most two (2) golf league categories, twilight golf leagues and morning golf leagues. Twilight golf leagues will be assigned to Oak Brook businesses or Oak Brook organizations on a first-come, first-serve basis. Morning leagues will be assigned annually first to those leagues who had times the previous year and then to all other groups on a first-come, first-serve basis. The golf league schedule times listed below may be extended for an Oak Brook organization or business golf league, provided the golf manager, with the concurrence of the Sports Core Manager, determines that such an extension is into a time period with a low level of play where daily fee use would not be significantly affected. Section 14: That Section 14-12 of the Code of Ordinances of the Village of Oak Brook is hereby amended by adding Section 14-12(i) to read as follows: ~' (i) Driving range. The cost of a bucket of 60 balls is $3.50. The driving range rules and regulations are as follows: 1. Keep bags and golf carts behind rope. 2. Return pails to ball dispenser. 3. Practice only between tee markers. 4. Aim at flag poles only. 5. Do not retrieve balls in front of tee markers. 6. Driving ranges only at Field 1 (lower Field front 9) and Field 2 (upper range back 9) on days opened. 7. Range open April 1 to October 31, 7 days a week, weather permitting. Hours are 7:30 a.m. to 1 1/2 hours before dusk. 8. Purchase tokens in Pro Shop for range balls in ball dispenser. 9. Practice only at South end of Field 1 and at North end of Field 2. 10. Users of the range may not walk across the Golf Course. 11. Parking for driving ranges will only be in the Golf Course parking lot. 12. Shirts must be worn on the driving range. Persons paying the family, individual or social fee shall be know as season members. Section 17: That Section 14-13(c) (2) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (2) Individual season member: Will be an individual at least eighteen (18) years of age. Membership will entitle the participant to utilize all the facilities at no additional charge, except for food, beverage, and special charges for private service throughout the season. Section 18: That Section 14-13(d) (2) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (2) All accounts will be payable upon receipt of statements. Not more than sixty (60) per cent of the lockers shall be rented. You must supply your own lock. The Club will not be held responsible for any lost or stolen items. Section 20: That Section 14-13(e) (1) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (e) Operation of clubhouse: The Clubhouse will be open to members beginning the �.- Saturday, immediately before the federally observed Memorial Day, and continuing through the Monday, observed as Labor Day. Section 22: That Section 14-13(f) (2) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (2) The pools will be open beginning on the Saturday immediately before the federally observed Memorial Day and closing the day after Oak Brook Day, as determined by the Board of Trustees. The Pool Manager shall determine the dates of the swim team season. Section 23: That Section 14-13(f) (5) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (5) The Oak Brook Bath and Tennis Club Swimming Pool and Canoeing Rules and Regulations are as follows: a) No inner-tubes, non-safety flotation devices, or pool toys will be allowed in the pool areas. b) Non-swimmers who can't stand in the shallow area must have someone over the age of 13 in the water with them at all times. c) There will be no cut-off shorts, or gym shorts allowed in the pools. All swimmers must be wearing a swimsuit. d) There will be absolutely no one allowed in the pool area unless a lifeguard is on duty. e) There will be no diving in the shallow area of the pools. f) There will be no running, pushing, or towel snapping. g) There will be only one person on the diving board at a time - no double bouncing will be permitted. h) Bathers will stay off of the pool divider ropes. i) The diving boards are restricted to those able to meet the deep water requirements. j) Children under the age of 8 must be accompanied by an adult at all times. k) There will be no canoeing permitted on the lake unless a lifeguard is on duty. Persons using the canoes must be wearing a lifejacket at all times. G -375 S%W Ordinance No. G- 375 Amending Article II of Chapter 14 Relative to Village Recreational Facilities Page seven 1) Swimming is not allowed in the lake at any time. ~ m) DuPage County Health Department Regulations require: 1) That admission to the pool is refused to all persons having a contagious disease, infectious conditions such as colds, fever, ringworm, foot infections, skin lesions, carbuncles, boils, inflamed eyes, ear discharges, or any other condition which has the appearance of being infectious. Persons with excessive sunburn, abrasions which have not healed, corn plasters, bunion pads, adhesive tape, rubber bandages, or other bandages of any kind are not to be permitted. A person under the influence of alcohol or exhibiting erratic behavior shall not be permitted in the pool area. 2) That no food, drink, gum or tobacco will be allowed in other than a specially designated and controlled section of the pool area. 3) That all persons will be required to take a shower in the nude with soap and warm water before being allowed in the pool area. 4) That bathers who leave the pool area for any reason, are required to shower before returning to the pool. 5) That the pool manager or pool facility shall have the authority to adopt requirements which would require swimmers with long hair to wear bathing caps. 6) That personal conduct within the pool facility must be such that the safety of self and others is not jeopardized. No running, boisterous or rough play, except supervised water sports, is permitted. 7) That people in street shoes, and other spectators, are not allowed in the pool, on the pool deck, and in the "wet" areas of the bathhouse. 8) That spitting, spouting of water, blowing the nose or otherwise introducing contaminants into the pool is not permitted. 9) That glass, soap, lotion or other material which might create hazardous conditions or interfere with efficient operation of the swimming pool shall not be permitted in the swimming pool or on the pool deck. 10) That all apparel worn in the pool shall be clean. 11) That diving in shallow water is not permitted. 12) That caution shall be exercised in the use of diving boards. Section 24: That Section 14-13(g) (2) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (2) The tennis courts will be supervised by club staff from May 1st to October 1st (weather permitting) . The nets will be up and the courts will be open on a first-come first-serve basis from April 1st to November lst on the asphalt courts and from about May 15th to October 1st on the clay courts (weather permitting) . The courts will be open seven (7) days a week from dawn until dusk. G- 375 Amending Article II of Chapter 14 Relative to Village Recreational Facilities Page eight and in its place, inserting the following language (formerly Section 14- 13(g) (4)(a) through (o) : 4 (3) The Oak Brook Bath and Tennis Club's Tennis Courts Operating Rules and Regulations are as follows: a) All members must sign in and register for use of the courts at the Pro Shop. b) All members must sign in their guests and pay the guest fee in the Pro Shop prior to use of the courts. c) Courts may be taken out of service due to moisture or dryness or any other reason at the direction of the Tennis Professional. d) Club sponsored activities have the use of the courts over general play. Activities are controlled by the Tennis Professional and staff and are listed in the monthly calendar of events. e) Play is limited to one hour when people are waiting for a court. You may specify a preference as to type of court you desire to play on (clay or hard) and may wait for that particular type of court to become available. f) You may not be on a court and be signed up on the waiting list for another court. g) There are no priorities. Everyone has an equal right to use the courts. h) All members are kindly requested to sign their charge slips before an event starts, or lesson begins, or at the time of purchase. i) Tennis attire and tennis shoes must be worn at all times at the tennis courts. No running shoes, cut off shorts, or bathing suits are allowed. Swimmers are required to wear a cover-up when visiting the tennis courts. j) Children, under the age of 14 and unaccompanied by an adult, are not to be around the Pro Shop area or the tennis courts unless they are participating in a game. Children may congregate in the B.B.Q. area. k) Children, under the age of 8, shall not be left unattended by an adult at the tennis courts. 1) All bicycles shall be stored in the bike rack, not on the sidewalks next to the Pro Shop. m) Quiet is requested so that players can concentrate on their games. Absolutely no horse-play will be tolerated at the courts. n) All trash shall be deposited in trash containers. Section 26: That Section 14-13(g) (4)(o) is deleted in its entirety. Section 27: That Section 14-14 entitled "Hiring Policy" is deleted in its entirety. Section 28: That all ordinances or parts that are in conflict with the provisions of this Ordinance be and the same are hereby repealed to the extent of i`- such conflict. Section 29: That the provisions of this Ordinance are deemed severable and the validity or invalidity of any portion thereof shall not affect the validity of the remaining portions thereof.
