G- 3.80�, AN ORDINANCE AMENDING SECTION XI(D)( (a) OF THE ZONING ORDINANCE OF THE VILLAGE 2E OAK BROOK ORDINANCE NO G-60 AS AMENDED WHEREAS, an application has been filed requesting that Section XI(D)(7)(a) of the Zoning Ordinance of the Village of Oak Brook be amended to provide that office buildings with less than 25,000 square feet of floor area not be required to have more than one (1) off-street loading berth; and WHEREAS, at its meeting on April 21, 1986, the Plan Commission recommended approval of the proposed text amendment; and WHEREAS, the Zoning Board of Appeals pursuant to due and appropriate legal notice conducted a public hearing on May 6, 1986, and recommended approval of the proposed text amendment; and WHEREAS, the corporate authorities find that it is in the best interest of the Village of Oak Brook that the amendment set forth below be made. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: �-- Section l: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section XI0)(7)(a) of the Zoning Ordinance of the Village of Oak Brook, Illinois, Ordinance G-60, as amended, be and the same is hereby amended as follows: (7) Required Berths. (a) The minimum number of off-street loading berths accessory to office uses hereafter erected, structurally altered or enlarged in all Business and Office- Research-Assembly Districts shall be in accordance with the following schedule: Gross Floor Area of Establishments Required (square feet) Number 5,000 to 25,000 1 25,001 to 200,000 2 For each additional 200,000 square feet of floor area, or fraction thereof, over 200,000 square feet of gross floor �- area: One additional loading berth. Section j: That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. Dear Chairman Marcy and Members: The text amendment requested by my client, Stone Container Corp. , arises from an unexpected and, I believe, unintended effect of the amendment to the off-street loading provisions contained in Section XI (D) (7) of the Zoning Ordinance which amendment was adopted on November 26 1985. The basic purpose of the amendment was to reduce the number of off-street loading berths required for office uses. However, for office buildings under 25 ,000 square feet the required number was doubled rather than reduced. The Section, prior to amendment, had required all uses from 5,000 to 25,000 square feet to have one off-street loading berth. In simplifying the proposed amendment for offices uses the new re- quirement for office space was two off-street loading berths for office space from 0 to 200,000 square feet. No evidence was presented to indicate that there should. be an increase in the number of required off-street loading berths for small office buildings with less than 25 ,000 square feet. It would, therefore, seem appropriate to modify Section XI (D) (7) (a) to provide that for establishments with 5 ,000 to 25 ,000 square feet the { required number of off-street loading berths should be one and for those with a floor area of 25,001 to 200,000 square feet the required number should be two. Kapff, Assistant to Village Manager SUBJECT: Stone Container - Loading Berth Text Amendment (2021 Swift Drive) Current owners of the property at 2021 Swift Drive plan to add additional building space to the existing structure resulting in a total floor area of 22,000 square feet. Prior to the Village's 1985 amendment of the loading berth regulations, a building of this size would have required only one loading berth. The 1985 amendment, as indicated on the attachment, modified the loading berth requirements by requiring two loading berths for all office buildings having less than 200,000 square feet of 'floor area. Although this amendment reduced the number of required berths for buildings 200,000 square feet in size, it inadvertently increased the number required for smaller buildings such as 2021 Swift Drive. Dave Gooder, in his April 11th letter, also notes correctly that the original intent of this amendment to the Zoning Ordinance was to reduce the number of required loading berths for all sizes of office buildings. Therefore, the current application is for an amendment to the Zoning Ordinance to provide that office buildings with less than 25,000 square feet of floor area not be required to have more than one off-street loading berth. He noted that when the building was originally constructed, only one loading berth was required by the Zoning Ordinance and that under the previous Ordinance, only one loading berth would be required for the total building of 22,000 square feet. Mr. David Gooder was present representing this application. He noted that the above property is leased to Stone Container and has the concurrence of the property owner to submit the two applications noted. He stated that the building was originally constructed in 1967 and at that time received a Front Yard Variation reducing the front yard from 100 feet to 65 feet. He noted that the current application is to construct an addition to the rear of the building resulting in a total of 22,000 square feet of floor area. He stated that the Loading Berth Text Amendment was an attempt to rectify an inadvertent change in the ordinance caused by the 1985 amendment to those standards. Specifically, the 1985 Text Amendment increased the number of loading berths for buildings less than 25,000 square feet in size, whereas the overall intent of the Text Amendment had been to reduce the number of required loading berths for office buildings. He stated that the request for a parking variation was to permit construction of all parking stalls based on the office use dimensions, whereas this building will have mixed uses, although all parking will be utilized by employees. In response to Member Weber, Mr. Gooder stated that the building now contains approximately 25 employees and, following the addition, will hold 35 employees and L- that 54 spaces are proposed to be constructed. In response to Zoning Board members, Mr. Gooder stated the hardship relative to the parking variation was the inability to construct two separate parking areas utilizing two sets of dimensions and that since the parking area is totally for employees, there will be a very low turnover rate and, therefore, similar to the justification Ifor the office use dimensions. In response to Chairman Savino, Mr. Gooder stated that there would be adequate room to add additional parking spaces in the event the entire building was modified to 100 percent office use. The Chairman noted that there were no members of the audience expressing support for or opposition to the proposed applications. A motion was made by Member O'Brien, seconded by Member Crouch to recommend to the President and Board of Trustees approval of the requested Parking Variation based on the following findings of fact: 1) The property cannot yield a reasonable return if permitted to be used only under the conditions allowed by the parking regulations as presently written. 2) The plight of the owner is due to unique circumstances due to the somewhat unusual configuration of the property.
