G-407 - 01/26/1988 - AGREEMENT - Ordinances ORDINANCE NO. G- 407 AN ORDINANCE AMENDING SECTION 2-98 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK RELATING TO CUTTING OF NOXIOUS WEEDS WHEREAS, Sections 11-20-6 and 11-20-7 of Chapter 24 of the Illinois Revised Statutes specifically authorize appropriate authorities of municipalities to provide for the destruction of weeds at the expense of the owners of the premises on which the weeds are growing and to collect from the owners of such private property the reasonable cost of such weed cuttings; and WHEREAS, pursuant to said statutory authority, the President and Board of Trustees of the Village of Oak Brook have heretofore adopted ordinances codified as Sections 2-94 through 2-98, inclusive, of the Code of Ordinances of the Village of Oak Brook; and WHEREAS, the President and Board of Trustees of said Village deem the amendment appropriate of the amendment of charges previously established pursuant to Section 2-98 to provide for appropriate reimbursement to the Village for the cutting of weeds on larger lots where the cost exceeds the charge presently imposed by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereiaabove set forth are hereby restated 'herein as though fully set forth herein. Section 2: That Section 2-98(b) of the Code of Ordinances of the Village of Oak Brook entitled "Abatement, charges for weed cutting" be and is hereby amended to read as follows: (b) The charges hereby imposed upon the owner of any property on which the Village performs or authorizess weed cutting in the amount of one hundred twenty five dollars ($125.00) for each such weed cutting on each lot or parcel of land of one acre or less. The charge for lots over one acre will be one hundred twenty five dollars ($125.00) per acre or part thereof on which such service is performed. Such charge shall be due and payable to the Village no later than thirty (30) days from the date of the invoice evidencing such cost and expense. If said charge is not paid within said thirty-day period, an additional charge of seventy five dollars ($75.00) shall be added to the initial charge and likewise billed to the owner of the affected property. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in a manner required by law. Section 4: That the Village Clerk is hereby authorized and directed to publi3h this ordinance in pamphlet form in the manner provided by law.
