G-420 - 12/13/1988 - ZONING - Ordinances ORDINANCE G- 420 AN ORDINANCE AMENDING PORTIONS OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60, AS AMENDED CONCERNING GATES WHEREAS, an application has heretofore been filed by the Village of Oak Brook requesting certain text amendments to the Zoning Ordinance of the Village of Oak Brook relative to gates; and WHEREAS, the Plan Commission'of the Village of Oak Brook has submitted Its report on the subject petition to the Zoning Board of Appeals and the President and Board of Trustees and has recommended the approval of the proposed zoning amendments regarding gates; and WHEREAS, a public hearing on the application has been conducted on November 1, 1988 by the Zoning Board of Appeals of the Village of Oak Brook pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by the said Zoning Board of Appeals that the proposed zoning amendments be approved; and WHEREAS, the President and Board of Trustees have reviewed these recommendations and concur with the recommendations and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section l: That the provisions of the preamble hereinabove set forth are hereby incorporated herein as though fully set forth herein. Section 2: That Section RIV(B) of the Oak Brook Zoning Ordinance, Ordinance G-601 as amended be and is hereby amended by adding thereto defini- tion 61.1: "Gate - A structure that may be swung, drawn or lowered to block an entrance or passageway. A gate may be part of a fence or may exist separately." Section 3: That Section V(G)(3)(h)(5) of said Oak Brook Zoning Ordinance be and is hereby amended to read as follows: "Fences, open and gates, whether or not connected to a fence - not more than 42 inches in height F S R " Section 4: That Section V(G)(h)(10) of said Oak Brook Zoning Ordinance be and is hereby amended to read as follows: "Gates, Driveway F" Present subsections 10 through 23 are hereby renumbered as 11 through 24. Section 5: That Section V be and is hereby amended by adding thereto Subsection (R) entitled "Driveway Gates" which section shall read as follows: "Driveway gates are permitted as accessory structures in 'f::nt yards, or side yards adjoining a street provided that they conform with the following criteria: (1) No driveway gate may be installed on a lot of less than two acres unless the front yard of said lot abuts a thoroughfare as defined in the Village's subdivision regulations. (2) The height of a driveway gate may not exceed 42 inches. 1. (4) The minimum width for a gate structure shall be 12 feet for openness of gate. All driveway gates shall be greater than 50% open in design when viewed from a 90° angle, except that the required open space in louver-type gates may be viewed from any angle, and excluding metal gates with more than 75% of its surface area open space. (5) Location of Gates: Gates shall be located a minimum distance of 30 feet from the nearest edge of pavement on a four, or more, lane road or 30 feet from the right-of-way of a two-lane road to allow adequate room for automobile and truck access to the property. Section 5: That this Ordinance shall be in full force and effect from and after passage and approval as provided by law.
