G-427 - 05/09/1989 - ZONING - Ordinances ORDINANCE G- 4 2 7 AN ORDINANCE AMENDING SECTION V(G) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK RELATIVE TO FENCES WHEREAS, an application has been filed by the Village of Oak Brook seeking an amendment to Section V(G) of the Zoning Ordiance relating to fences; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of the Village of @ffik Brook on February 8, 1989, pursuant to due and appropriate legal notice; and WHEREAS, at its meeting of March 20, 1989 the Plan Commission recommended to the Village Board that the requested amendment remain unchanged; and WHEREAS, at its meeting of April 4, 1989, the Zoning Board of Appeals recommended to the Village Board that the requested amendment be granted; and WHEREAS, the President and Board of Trustees deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section V(G)(3)(h)(6) of the Zoning Ordinance of the Village of Oak Brook is hereby amended to read as follows: "(6) Fences, open, and gates - not more than six (6) feet in height may be erected only adjacent to patio or terrace areas and private swimming pools, and shall be not (a) less than five (5) feet from the nearest lot line, or (b) in No-Access Strips." Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED THIS 9th day of May 1989.
