G- 4 ll AN ORDIN`"iCE AMENDING SECTION 12-87 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK; ILLINOIS AND ADJUSTING WATER CHARGES WHEREAS, the President and Board of Trustees of the {tillage of Oak Brook, Illinois have heretofore, by ordinance established rates, fees, and service charges for water usage; and WHEREAS, the Water Commission Act of 1985 sets forth certain regulations and financing procedures for the proposed Lake Michigan water distribution system within DuPape County; and WHEREAS, until such time as Lake Michigan water is available, the Village will serve its water customers in accordance with the Water Commission Act; and WHEREAS, the President and Board of Trustees deem a revision of the water rates, fees, and charges, and the passage of this Ordinance to be in the best interest and in pursuance of the general welfare of the Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section -1: That the provisions of the above preamble are hereby adopted as though fully set forth herein. Section 3: That Section 12-87(C)(12) of the Code of Ordinances of the Village of Oak Brook, Illinois be and is hereby amended to read as follows: (12) Construction Water. Unmetered water during construction as provided in Section 12-70(D) hereof: (a) 1" service or smaller.........................$ 70.88 (b) 1-112" to 3" service inclusive.............. ..$141.75 (e) 4" or larger...........................:........$283.50 Water used in excess of sixty (60) days and water used on a temporary basis, whether metered or not, will be billed at the rate of $2.80 per 1,000 gallons. Section 4: All ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 5: If any section, sub-section, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. Section 6: This Ordinance shall be in full force and effect from and after its pasz_se, approval and publication in pamphlet form provided, however, that the water consumption charges as set forth in Section 1 hereof amending j Section 12-87(C)(9)(i) and (ii) shall only be effective as to water consumed subsequent to January 3, 1989 and: (1) billed � commercial customers after February 19, 1989. (2) billed to residential customers after February 26, 1989. Any water consumption billings prior to said respective dates shall be at the rates heretofore established pursuant to ordinance. All other rates, fees and charges established or amended herein shall be in full force and effect upon the passage, approval and publication in pamphlet form of this Ordinance. Section 7: The Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form as required by law. PASSED this 13th day of December , 1988. G-421 AN ORDINANCE AMENDING SECTION 12-87 OF THE CODE OF ORDYNANCE3 OF THE VILLAGE OF OAK BROOK ILLINOIS AND ADJIISTYHG WATER CHARGES: Proposed ordinance increases the present rate of $1.33 per 1000 gal. to $1.40 per 1000 gal. which is an increase of 5.26x. If approved, this new rate would be in effect as of January 3, 1989. Trusty? Imrie moved, seconded by Trustee Bartecki... To continue the policy of adjusting the water rate upward by 5% each year and pass Ordinance No. G-421 which increases the present water rate by 5.26$ effective January 3. 1989 and waive the full reading thereof.
