AN ORDINANCE AMENDING SECTION 9-12
OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK
RELATING TO ANIMAL CONTROL
WHEREAS, the Village of Oak Brook is concerned with controlling the
nuisance of barking dogs, other unnecessary animal noise, and stray cats; and
WHEREAS, the corporate authorities of the Village of Oak Brook have
heretofore passed Ordinance G-332, codified as Section 9-12 of the Code of
Ordinances of the Village of Oak Brook; and
WHEREAS, the President and Board of Trustees deem it advisable and in the
best interest and in furtherance of the general welfare of the citizens of the
Village that said Section 9-12 be amended;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That Section 9-12 of the Code of Ordinances of the Village of
Oak Brook be and is hereby amended by adding a new subsection (e) to read as
\.. follows:
"(e) Disturbing the peace.
No owner shall keep, harbor, own, or otherwise maintain any animal
in the Village which disturbs the peace or quiet of any
neighborhood by habitual or regular barking, howling, whining,
meowing, or other noise making, or any female animal in heat which
causes other animals to disturb the peace or quiet of any
neighborhood by barking, howling or whining."
Section 2: That Section 9-12(b) be and is hereby amended to read as
follows:
"(b) Running at large prohibited. It shall be unlawful:
1) For any dog or cat to go upon the lawn or other private property
of anyone but the owner thereof, without the express or implied
permission of the owner of said property or of the person in lawful
possession thereof;
\.. 2) For any dog or cat to run at large. For the purposes of this
paragraph, any dog or cat not upon the premises of its owner or
such other person having custody, possession or control over any
such dog which is not on a leash and under the control of a person
physically able to control it shall be deemed to be running at
large;

3) To bring, or cause to be brought, any dog or cats into any
shop, store or retail place of business wherein the public is
invited to do business during such hours as the public is so
invited; or to bring, or cause to be brought, into any public
building at any time any dog or cat, unless said dog or cat is
under a person's control and is brought for the purpose of
conducting business wherein the physical presence of the dog or
cat is required."
Section 3: That Section 9-12(c)(2) of the Code of Ordinances of the
Village of Oak Brook be and is hereby amended to read as follows:
"(c) Penalty:
2) Impoundment. Any dog or cat found to be running at large or
otherwise in violation of the provisions of this section and any
animal exhibiting signs of rabies or coming into contact with
animals exhibiting signs of rabies shall be taken up by the
police department or other village personnel and placed and
`. impounded in an approved pound.
Section 4: That this Ordinance shall be in full force and effect from
and after passage and approval pursuant to law.
Section 5: That the Village Clerk is authorized and directed to publish
this Ordinance in pamphlet form.
Section 6: That this Ordinance shall be in full force and effect from
and after its passage, approval and publication in pamphlet form in the manner
required by law.

SUBJECT: Amended Animal Control Ordinance
RECOMMENDATION: That the Village Board approve the attached Ordinance
amending Section 9-12 of the Code of Ordinances of the
Village of Oak Brook relating to Animal Control
In General:
\.. Two recent occurrences have identified the need for the recommended ordinance
amendment:
The police responded to several complaints of a barking dog disturbing
the peace. The owner of the dog was warned but the problem continued.
The police were going to cite the dog owner when it was discovered that
none of the ordinances applied to noise caused by a barking dog.
In a second situation, the police impounded a stray cat. Upon further
examination of the Animal Control Ordinance, it was discovered that the
Ordinance does not prohibit cats from running at large and only provides
for the impoundment of dogs.
The recommended ordinance amendment should correct these problems

MEETING CALL:
The Regular Meeting of the Board of Trustees was called to order by President
Cerne in the Samuel E. Dean Board Room of the Village Commons at 7:42 P.M.
I. ROLL CALL:

II. APPROVAL OF MINUTES:
Trustee Maher moved, seconded by Trustee Bartecki. ..
That the Minutes of the Regular Meeting of November 14, 1989 be approved as
presented and waive the full reading thereof.
VOICE VOTE: All present, in favor. So ordered.
In conformance with the Open Meetings Act, President Cerne read in its entirety a
press release from the Village Board of Oak Brook regarding the Elmhurst Levee
Project that had been discussed in Executive Session.
Trustee Payovich moved, seconded by Trustee Bushy. . .
That the Village Board will not oppose through legal action the
construction by the City of Elmhurst of a system of levees on Salt Creek
and that the Village Board will continue to support regional efforts to
provide storm water storage to mitigate the regional problem of flooding.
ROLL CALL VOTE: Ayes: Trustees Bartecki, Bushy, Maher, Payovich, Rush
and President Cerne.
Nays: Trustee Winters.
Absent: None So ordered.
