G-440 - 11/28/1989 - PURCHASING - Ordinances ORDINANCE G- 4 4 0 AN ORDINANCE AMENDING SECTIONS 2-53 AND 2-182 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK REGARDING PROCEDURES FOR BIDDING AND AWARDING OF CONTRACTS WHEREAS, the Village President and Board of Trustees have heretofore passed an ordinance codified as Sections 2-53 and 2-182 of the Code of Ordinances of the Village of Oak Brook regarding bidding and contract procedures; and WHEREAS, Public Act 86-576, effective September 1, 1989, amends the provisions of Section 8-9-1 of Chapter 24 of the Illinois Revised Statutes increasing from five thousand dollars ($5,000) to ten thousand dollars ($10,000) the minimum amount of any contract which requires prior competitive bidding; and WHEREAS, the Village President and Board ofTrustees upon1review ooftsaid statutory amendment deem the amendment of Sections Code of Ordinances be appropriate; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1• That Section 2-53 of the Code of Ordinances of the Village of Oak Brook Illinois, entitled "Purchase Authority" be and is hereby amended to read as follows: "Section 2-53. Purchasing Authority. (a) All purchase orders and contracts for supplies, materials or equipment, or for contractual services, including printing and publication, and all work or other public improvement contracts in olvauthore zed expenditure of not more than five thousand dollars ($5,000) by the Village Manager. (b) All purchases, orders or contracts for supplies, materials, equipment or contractual services, and all work orasse other public improvement special contracts which are not to be paid for by taxation, involving the expenditure of more than five thousand dollars (5,000) shall be let or awarded in the manner provided in section 2-182 of this Code." Sect_ io_ n 2: That Section 2-182(b) of the Code of Ordinances of the Village of 0ak Brook, Illinois, entitled "Formal Contract Procedure" be and is hereby amended to read as follows: "Section 2-182. Bidding and Contract Procedures. (b) Formal Contract Procedure. All work or other public improvement Ordinance G- 440 Amending Sections 2-53 and 2-182 Regarding Procedures for Bidding and Awarding of Contracts Page 2 which is not to be paid for in whole or in part by special assessment or special taxation, and all purchases, orders or contracts for supplies, provided materials, equipment or contractual services shall except dollars herein, when the estimated cost thereof ($10,000) , shall be purchased from the lowest responsible bidder, after due notice inviting bids, unless competitive bidding is waived by a vote of two-thirds of the trustees then holding office." Sect- That Section 2-182(j) of the Code of Ordinances of the "Open Village of Oak Brook, Illinois, entitled Open Market Procedure" be and is hereby amended to read as follows: Open Market Procedure. All work and purchases of supplies, materials and services of less than the estimated value of ten thousand dollars ($10,000) shall be made in the open market, without newspaper advertisement and without observing the procedure prescribed by this section for the award of formal contracts. Sect 4: That this ordinance shall be in full force and effect from and after passage and approval as provided by law. PASSED THIS 28_ th day of November 1989.
