AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE VILLAGE OF OAK BROOK
AND PROVIDING FOR A DAY CARE CENTER AS
AN ADDITIONAL AUTHORIZED SPECIAL USE IN THE ORA-1
OFFICE RESEARCH ASSEMBLY DISTRICT
WHEREAS, an application has been filed requesting a text amendment to
create a Day Care Center as an authorized special use and the issuance of such
special use; and
WHEREAS, the Plan Commission, on May 21, 1990, considered such
application and forwarded its report thereof to the Zoning Board of Appeals,
recommending approval of the requested text amendment; and
WHEREAS, the Zoning Board of Appeals conducted a public hearing on the
application pursuant to due and appropriate legal notice on June 5, 1990; and
WHEREAS, the said Zoning Board of Appeals recommended approval of the
text amendment to create a new Special Use Category in the ORA-1 Office
Research Assembly District for a Day Care Center; and
WHEREAS, the Village President and the Board of Trustees have reviewed
the recommendations of the Zoning Board of Appeals and the report of the Plan
Commission and concur with the same;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That Section XIV(B) of the Zoning Ordinance of the Village of
Oak Brook be and is hereby amended by adding thereto the definition of Day Care
Center, which definition shall read as follows:
"A day care center is a facility in which are received three or
more children, not of common parentage, apart from their parents
or guardian, for part or all of the day, but not later than 9:00
p.m. The term 'Day Care Center' includes, but is not limited to,
nursery schools, child care centers, day nurseries, and play
groups, but does not include kindergartens or nursery schools
operated by public or private elementary or secondary school
systems."
Section 3: That Section X(B)(2) of the Zoning Ordinance be and is hereby
amended by adding thereto subsection (h) entitled 'Day Care Centers' , which

provision shall read as follows:
"Day Care Centers, provided such facility complies with all
licensing requirements of the State of Illinois and maintains a
direct alarm hook-up to the Oak Brook Police Department."
Section 4: That this Ordinance shall be in full force and effect from
and after passage and approval as provided by law.
