AN ORDINANCE AMENDING SECTION 5-4 OF
THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK
RELATING TO CONSTRUCTION ON PROPERTY FORMERLY DESIGNATED AS FLOOD PLAIN
WHEREAS, areas of special flood hazard are areas in a flood plain which
have a special risk of flooding; and
WHEREAS, official maps of the Village designate properties which are
defined as an area of special flood hazard; and
WHEREAS, various drainage and stormwater improvements periodically allow
for property previously designated as those having a special flood hazard as
no longer subject to such hazards; and
WHEREAS, notwithstanding the technical classification of such properties,
certain flood hazard may exist requiring specialized construction techniques
to floodproof such structures;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: Section 5-4 of the Code of Ordinances of the Village of Oak
Brook be and is hereby amended by adding thereto Subsection d, which subsection
shall read as follows:
"Construction on any property designated at any time since 1981 as
an area of special flood hazard (as defined in Section 10-18 of
the Code of Ordinances) shall be in accordance with the provisions
of Article 21 of the BOCA National Building Code (1987) or most
recent revision thereof adopted by the Village, notwithstanding
whether or not the property is designated as an area of special
flood hazard at the time of the application for permit."
Section 3: That this Ordinance shall be in full force and effect from
and after passage and approval as provided by law.
