G- 459 AN ORDINANCE AMENDING SECTION 12-87 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS AND ADJUSTING WATER CHARGES WHEREAS, the President and Board of Trustees of the Village of Oak Brook, Illinois have heretofore, by ordinance established rates, fees, and service charges for water usage; and WHEREAS, the Water Commission Act of 1985 sets forth certain regulations and financing procedures for the proposed Lake Michigan water distribution system within DuPage County; and WHEREAS, until such time as Lake Michigan water is available, the Village will serve its water customers in accordance with the Water Commission Act; and WHEREAS, the President and Board of Trustees deem a revision of the water rates, fees, and charges, and the passage of this Ordinance to be in the best interest and in pursuance of the general welfare of the Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the above preamble are hereby adopted as though fully set forth herein. Section 2: That Section 12-87(C) (9) of the Code of Ordinances of the Village of Oak Brook, Illinois be and is hereby amended to read as follows: (9) Water Consumption Charges (i) Minimum Monthly Billing Minimum Monthly Billing Minimum Size of Meter (inches) Minimum Gallons Charge 5/8 & 3/4" 4,000 $ 9.92 1 10,000 24.79 1-1/2 20,000 49.58 2 32,000 79.34 3 64,000 158.68 4 100,000 247.92 6" & over 200,000 495.85 (ii) Consumption above minimum gallons, one dollar and fifty-four ($1.54) per one thousand gallons. Unmetered water during construction (for water used prior to meter being installed within sixty (60) days) in accordance with Section 12-70(D) : Up to and including 1" service . . . . . . . . . . . . . . . . $ 78.14 1-1/2" to 3" service, inclusive . . . . . . . . . . . . . . . 156.28 4" and larger service . . . . . . . . . . . . . . . . . . . . . . . . . 312.56 When billing occurs other than on a monthly basis, the minimum rate shall be prorated proportionately to the period billed and the gallonage charges shall be based on actual usage proportionately increased for the period billed. Section 3: That Section 12-87(C) (12) of the Code of Ordinances of the Village of Oak Brook, Illinois, be and is hereby amended to read as follows: (12) Construction Water. Unmetered water during construction as provided in Section 12-70(D) hereof: (a) 1" service or smaller . . . . . . . . . . . . . . . $ 78.14 (b) 1-1/2" to 3" service, inclusive . . . . . 156.28 (c) 4" or larger . . . . . . . . . . . . . . . . . . . . . . . . 312.56 Water used in excess of sixty (60) days and water used on a temporary basis, whether metered or not, will be billed at the rate of $3.09 per 1,000 gallons. Section 4: All ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 5: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. Section 6: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form provided, however, that the water consumption charges as set forth in Section 2 hereof amending Section 12-87(C) (9) (i) and (ii) shall only be effective as to water consumed subsequent to a) January 1, 1991 for residential customers and b) January 10, 1991 for commercial customers. 459 Ordinance G- 4 5 9 Amending Section 12-87 Adjusting Water Charges Page 3 Any water consumption billings prior to said respective dates shall be at the rates heretofore established pursuant to ordinance. All other rates, fees and charges established or amended herein shall be in full force and effect upon the passage, approval and publication in pamphlet form of this Ordinance. Section 7: The Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form as required by law. PASSED THIS 11th day of December , 1990. Trustee Winters moved, seconded by Trustee Maher to pass Ordinance No. S-707 as presented and waive the full reading thereof. Roll Call Vote: Ayes: 6-Trustees Bartecki, Bushy, Maher, Payovich, Rush and Winters Nays: 0-None Absent: 1-President Cerne Motion carried. C. ORDINANCE NO. G-459 AN ORDINANCE AMENDING SECTION 12-87 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS AND ADJUSTING WATER CHARGES: Proposed Ordinance adjusts water charges increasing the present water rate by 5 percent. Trustee Rush moved, seconded by Trustee Bushy to continue the policy of adjusting the water rate upward by 5 percent each year and to pass Ordinance No. G-459 as presented and waive the full reading thereof.
