AN ORDINANCE AMENDING SECTION 12-9
OF THE CODE OF ORDINANCES
RELATING TO TREE REMOVAL
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1. That Section 12-9 of the Code of Ordinances be and is hereby
amended to read as follows:
Section 12-9. Tree Removal
(a) The Superintendent of Public Works shall be responsible for the
control of Dutch Elm disease and the removal of any trees on Village
property physically damaged to the extent that they cannot be saved.
(b) Dutch Elm disease. All trees infected with the disease known and
designated as Dutch Elm disease are hereby declared to be a nuisance. A
representative designated by the Village Superintendent of Public Works,
is authorized to enter onto any public or private property to remove any
tree infected with Dutch Elm disease when the owner of such property
refuses or neglects to test and remove such tree.
(c) If it is determined that any tree is infected with Dutch Elm
disease, the Superintendent of Public Works shall notify the owner of
the premises upon which the tree is located in writing and remove such
tree if the owner does not cause the same to be removed and destroyed
within ten days of receipt of such notification. Any costs or expenses
incurred by the Village in removing any tree diseased with Dutch Elm
disease shall be charged to the owner, and if not paid, become a lien
upon the real estate affected, provided the Village files a Notice of
Lien in the Office of Recorder of Deeds in the county in which the real
estate is located.
(d) Any person who violates any of the provisions of this Section shall
be subject to penalties provided in Section 1-8 of this Code of
Ordinances.
Section 2: That this ordinance shall be in full force and effect from
and after its passage, approval and publication in pamphlet form as required
by law.
Section 3: That the Village Clerk is hereby authorized and directed to
publish this ordinance in pamphlet form.
