AN ORDINANCE AMENDING SECTION 2-225, "FEES" OF
THE CODE OF ORDINANCES
OF THE VILLAGE OF OAK BROOK
WHEREAS, the Village of Oak Brook is located almost entirely within
DuPage County, which has adopted a Countywide Stormwater and Flood Plain
Ordinance, (the "County Ordinance") , on September 24, 1991, in accordance with
Illinois Revised Statutes, Chapter 34, paragraph 5-1062; and
WHEREAS, the County Ordinance was intended to provide certain minimum
standards with regard to the regulation of storm water and flood plains within
the County; and
WHEREAS, pursuant to the County Ordinance, the Village of Oak Brook, on
November 12, 1991, by Resolution R-544, petitioned to be designated a complete
waiver community for the enforcement of the County Ordinance; and
WHEREAS, as a complete waiver community, the Village of Oak Brook is
required to have certain experts available to review and approve applications
for development in all areas under its jurisdiction; and
WHEREAS, the Village of Oak Brook desires to obtain the services of
outside consultants from tine to time to review and approve applications for
development, including developments in the flood plain and developments which
are pursuant to a subdivision plat or subdivision improvement agreement; and
WHEREAS, the Village of Oak Brook desires that an applicant for
development in the flood plain or any other area under the Village's
jurisdiction reimburse the Village for any outside consulting review charges.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section 2-225(b) of the Code of Ordinances of the
Village of Oak Brook is amended to read as follows:
"(b) Application for special use permit:
(1) Zoning ordinance, special use . . . . . . . . . . 400.00
(2) Special use in flood plain . . . . . . . . . . . . . 675.00

In addition to the above fees, all applicants shall reimburse the
Village for any outside consulting review charges within thirty (30)
days of the date the Village seeks reimbursement for such charges."
Section 3: That Section 2-225(c) of the Code of Ordinances of the
Village of Oak Brook is amended to read as follows:
"(c) Application for variation under the
zoning ordinance, or in a flood plain . . . . . . 300.00
In addition to the above fees, all applicants shall reimburse the
Village for any outside consulting review charges within thirty (30)
days of the date the Village seeks reimbursement for such charges."
Section 4: That Section 2-225(e) (3) of the Code of Ordinances of the
Village of Oak Brook is amended to read as follows:
11(3) Engineering Review of Plans and Specifications. The following
fees for the review of engineering plans and specifications shall
be paid to the village clerk at the time the documents are
submitted for review:

Construction of Land (as a Percentage
Improvements of Estimated Cost)
Less than $10,000 $275
$10,000 to $20,000 3.00%
$20,000 to $50,000 2.50%
$50,000 to $100,000 2.25%
$100,000 and over 2.00%
In addition to the above fees, all applicants shall reimburse the
Village for any outside consulting review charges within thirty
(30) days of the date that the Village seeks reimbursement for
such charges."
Section 5: That this ordinance shall be in full force and effect from
and after its passage, approval and publication as required by law.
Section 6: That the Village Clerk is hereby authorized and directed to
publish this ordinance in pamphlet form in the manner provided by law.
