G-516 - 07/27/1993 - PERSONNEL RULES & REGS - Ordinances ORDINANCE 93-PL-G- 516 AN ORDINANCE AMENDING ARTICLE VI OF THE PERSONNEL RULES AND REGULATIONS OF THE VILLAGE OF OAK BROOK RELATING TO LEAVE OF ABSENCE PURSUANT TO THE FAMILY AND MEDICAL LEAVE ACT OF 1993 WHEREAS, the corporate authorities have heretofore approved certain policies for Leave of Absence as embodied in the Personnel Rules and Regulations of the Village of Oak Brook; and WHEREAS, the corporate authorities deem the revision of the leave of absence policies of the Village of oak Brook to be appropriate pursuant to the Family and Medical Leave Act of 1993, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Article VI, Section 9, be and is hereby amended to read as follows: "Section 9. Certain Village employees may be covered by the Family and Medical Leave Act ("FMLA") of 1993, wherein up to twelve (12) work weeks of unpaid leave during any calendar year (including 1993) may be taken for: (1) The birth of a child, or to care for such newborn child; or (2) Placement with the employee of a child for adoption or foster care; or (3) Care for the employee's seriously ill spouse, child or parent; or (4) A serious health problem which makes the employee unable to perform his or her job function. Eligible employees are those who have worked for the Village at least 1,250 hours during the twelve-month period preceding the leave. Leave shall be taken in accordance with the provisions of the Act. The Village shall maintain the employee's health insurance coverage during FMLA leave on the same conditions as coverage would have been provided if the employee was working. All FMLA leave shall be coordinated with the employee's department head and the Village Manager. If the FMLA leave is foreseeable, the employee shall give not less than 30 days advance notice to his or her department head before the FMLA leave begins. If 30 days ORDINANCE 93-PL-G- 516 Amending Article VI Relating to Leave of Absence Pursuant to the Family and Medical Leave Act of 1993 Page 2 is not practicable, notice must be given as soon as practicable. Any request for FLMA leave based on a family member's or employee's own serious health condition must be supported by certification of a health care provider. This certification shall be in accordance with the FLMA." Section 3: That Article VI, Section 10, be and is hereby deleted. Section 4: That any ordinance, rule or regulation of the Village in conflict with any provision or regulation contained in this ordinance or the federal Family and Medical Leave Act of 1993 shall be and is hereby repealed insofar as it is in conflict herewith. Section 5: That this ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. Section 6: That the Village Clerk is hereby authorized and directed to publish this ordinance in pamphlet form in the manner provided by law. PASSED THIS 27th day of July , 1993.
