AN ORDINANCE AMENDING SECTION 12-67(D) (1) (d)
"WATER SERVICE APPLICATIONS - OTHER AREAS OUTSIDE OAK BROOK"
OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK
WHEREAS, the Village of Oak Brook (the "Village") operates a public
potable water supply system (the "System") serving substantially all of the
Village as well as certain areas outside the Village; and
WHEREAS, in 1978 the Village purchased the waterworks and other fixed
assets of the Oak Brook Utility Company, which formerly operated a potable
water supply system within the Village and certain areas outside the Village;
and
WHEREAS, the Village serves those areas outside the Village limits which
are located within the accredited area formerly served by the Oak Brook
Utility Company (the "Accredited Area") on essentially the same basis as the
area within the Village limits; and
WHEREAS, pursuant to separate contracts previously approved by the
President and Board of Trustees (the "Village Board") , the Village also serves
certain areas outside the Village limits and outside the Accredited Area; and
WHEREAS, Section 12-67 of the Oak Brook Code, "Water system
connections", prescribes procedures for application for the furnishing of
water from the System and specifically provides that applications for
furnishing water to areas outside the Village and not within the Accredited
Area are subject to the approval of the Village Board; and
WHEREAS, the President and Board of Trustees have passed and approved
Ordinance 94-WA-S- which establishes the Policy of the Village with respect
to provisions of water service to areas outside the Village of Oak Brook and
outside the Accredited Area; and
WHEREAS, the President and Board of Trustees wish to amend Section 12-67
(D) (1) (d) entitled, "Other areas outside Oak Brook" by referencing this Policy
and eliminating inconsistent provisions; and
WHEREAS, it is in the best interest of the Village that Section 12-67
(D) (1) (d) of the Code be amended as set forth below.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section 12-67(D) (1) (d) of the Code of Ordinances of the
Village of Oak Brook be amended to read as follows:

"(d) Other areas outside Oak Brook. Applications for furnishing
water to areas outside Oak Brook not within the Accredited
Area of the Oak Brook Utility Company shall be considered
pursuant to the Village's Policy with respect to provision
of water services to areas outside the Village of Oak Brook,
as may be amended from time to time."
Section 3: That this ordinance shall be in full force and effect from
and after its passage, approval and publication as required by law.
Section 4: That the Village clerk is hereby authorized and directed to
publish this ordinance in pamphlet form in the manner provided by law.
