G-549 - 01/24/1995 - ZONING - Ordinances ORDINANCE 95-ZO-G-549 AN ORDINANCE AMENDING ORDINANCE G-510-93-ZO AND REPEALING THE RESTRICTED USE OF OFF-SITE "OPEN HOUSE" AND "FOR SALE" SIGNS IN THE PUBLIC RIGHT-OF-WAY WHEREAS, the Village President and Board of Trustees of the Village of Oak Brook have heretofore enacted Ordinance G-510-93-ZO, which ordinance, among other provisions, permits certain "Open House" and "Fore Sale" signs to be placed within the public right-of-way under specified conditions; and WHEREAS, after the passage of Ordinance G-510-93-ZO, it was pointed out that Section 9-6 of the Code of Ordinances of the Village of Oak Brook prohibits all signs in the public right-of-way except legal notices; and WHEREAS, the Village of Oak Brook applied for a text amendment to delete the provisions in Ordinance G-510-93-ZO which permit the placement of "Open House" and "Fore Sale" signs in the public right-of-way under specified conditions; and WHEREAS, the Plan Commission, on November 21, 1994, reviewed said application and has recommended the repeal of the "Open House" and "For Sale" sign provisions; and WHEREAS, a public hearing on the application has been conducted on December 6, 1994 by the Zoning Board of Appeals of the Village of Oak Brook pursuant to due and appropriate legal notice, and said Board has recommended approval of the amendment; and WHEREAS, the President and Board of Trustees have reviewed these recommendations and concur with the recommendations and deem the passage of this ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 4 of Ordinance G-510-93-ZO is hereby repealed. Section 3: That all other sections of Ordinance G-510-93-Zo are and shall remain in full force and effect. Section 4: That Section VII(B) (2) (d) (3) (i. through viii. ) of the Zoning Ordinance of the Village of Oak Brook be and is hereby repealed. Section 5: That this ordinance shall be in full force and effect from and after its passage, approval and publication as required by law.
