AN ORDINANCE AMENDING SECTION X(B) (2) (a)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATING TO STANDARDS FOR HELIPORTS
WHEREAS, the corporate authorities of the Village of Oak Brook have
considered the request of Reed Elsevier Inc. to amend Section X(B) (2) (a) (8) of
the Zoning Ordinance of the Village of Oak Brook regarding certain minimum
standards for heliport special uses; and
WHEREAS, the Plan Commission considered the proposed ordinance amendment
on January 16, 1995 and recommended approval of the same; and
WHEREAS, the Zoning Board of Appeals conducted a public hearing on the
proposed amendment on February 7, 1995 pursuant to due and appropriate legal
notice and has recommended approval of the proposed amendment;
WHEREAS, the President and Board of Trustees have reviewed these
recommendations and concur with the recommendation of the Plan Commission and
the Zoning Board of Appeals and deem the passage of this Ordinance to be in
the best interest and in furtherance of the general welfare of the Village of
Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section X(B) (2) (a) (8) of the Zoning Ordinance of the
Village of Oak Brook, which pertains to certain minimum standards for heliport
special uses, be and is hereby amended to read as follows:
11(8) Special use shall only be applicable to the applicant
therefor and for only so long as the applicant is
occupying the subject property, provided, however,
that pursuant to a special use permit application
identifying a specific user occupying property
adjacent to the subject property, the special use also
may be made applicable to such user for so long as
such user occupies adjacent property."
Section 3: That this ordinance shall be in full force and effect from
and after its passage, approval and publication as required by law.
Section 4: That the Village Clerk is hereby authorized and directed to
publish this ordinance in pamphlet form in the manner provided by law.
