G-554 - 05/09/1995 - ZONING - Ordinances ORDINANCE 95-ZO-TA-G-554 AN ORDINANCE AMENDING SECTION X(B) (5) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK WHEREAS, an application has been filed requesting an amendment to Section X(B) (5) of the Zoning Ordinance of the Village of Oak Brook to clarify yard setback requirements for future redevelopment of lots generated by resubdivision; and WHEREAS, the Plan Commission of the Village of Oak Brook recommended approval of the requested text amendment; and WHEREAS, the Zoning Board of Appeals conducted a public hearing on the request on April 4, 1995, pursuant to due and appropriate legal notice and has recommended approval of the requested text amendment; and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of its Plan Commission and Zoning Board of Appeals and deem the requested text amendment as set forth below to be in the best interest of the Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section X(B) (5) be and is hereby amended to read as follows: "(5) Yards. (a) Front: Not less than 100 feet in depth--except: 1) when adjacent to a residence district boundary line not less than 150 feet in depth. (b) Side: Not less than 30 feet in depth--except: 1) that portion of a side yard when abutting a residence district shall not be less than 150 feet in depth, 2) a side yard abutting a street shall conform in depth to the front yard depth of a contiguous lot abutting on such street, and 3) side yards abutting 22nd Street and York Road shall have a depth of not less than 100 feet. (c) Rear: Not less than 40 feet in depth--except that portion of a rear yard abutting a residence district shall be not less than 150 feet in depth and except that a rear yard abutting an alley or service drive may be reduced by 20 feet in depth, provided, however, that when a developed zoning lot which contains two or more principal buildings is subdivided the yards required along the Ordinance 95-ZO-TA-G-554 Amending Section X(B) (5) Page 2 new lot lines created by the subdivision shall be not less than 30 feet in depth and the depth of all required yards for each lot shall be shown on the subdivision plat; provided that existing parking stalls and aisles and access and service drives shall be permitted to continue within said yards and within the yards along the boundaries of the original zoning lot required by the foregoing subparagraphs (a) , (b) and (c) as modified by paragraph (E)7 of Section XI; and provided further that upon redevelopment of any part of a lot, other than for resurfacing or for utility replacement, which development requires removal of existing parking stalls or aisles located in whole or in part within areas where such accessory uses are not permitted by said subparagraphs as so modified, no new stalls or aisles shall be constructed in such areas except as permitted by said subparagraphs as so modified, and any landscaping therein required by this ordinance shall be promptly installed and properly maintained." Section 3: That this ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. Section 4: That the Village Clerk is hereby authorized and directed to publish this ordinance in pamphlet form in the manner provided by law. PASSED THIS 9th day of May, 1995.
