G-740 - 02/10/2004 - TEXT AMENDMENT - OrdinancesORDINANCE 2004- ZO -TA -G- 740 PAMPHLET FRONT OF PAMPHLET AN ORDINANCE AMENDING TITLE 13 (ZONING REGULATIONS) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS BY AMENDING SECTION 13 -3 -6 (ACCESSORY USES AND STRUCTURES) PUBLISHED IN PAMPHLET FORM THIS 11th DAY OF February_, 2004, BY ORDER OF THE CORPORATE AUTHORITIES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS. illage Clerk y \l� ,U I4 T`i!./ ORDINANCE 2004- ZO -TA -G- 740 AN ORDINANCE AMENDING TITLE 13 (ZONING REGULATIONS) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS BY AMENDING SECTION 13 -3 -6 (ACCESSORY USES AND STRUCTURES) WHEREAS, the Planning Commission and Zoning Board of Appeals have recently recommended that the height of single family homes as required by the Zoning Ordinance be amended, and the Village Board has accepted that recommendation and increased that structure height in the Zoning Ordinance, and WHEREAS, the Planning Commission and Zoning Board Appeals have recommended and the Village Board directed that the Zoning Ordinance be further amended with respect to detached garage heights in order to make that Section of Chapter 3 of the Zoning Ordinance consistent with the newly determined residential structure height, and WHEREAS, the Zoning Board of Appeals has held the required public hearing concerning the hereinafter ordained changes to Chapter 3 of the Zoning Ordinance and presented findings and recommendations concerning same to the President and Board of Trustees, NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois, as follows Section 1 That subsection d(1) of Section 13 -3 -6 of the Village Code is hereby deleted and replaced with the following (1) Be not more than fifteen feet (15) in height except for detached garages that are not constructed with a continuous flat roof (See sub - section (h) of this Section A for detached garage heights ) Section 2 That the following new sub - section (h) be added after the existing sub - section (g) (h) Detached garages, that are not constructed with a continuous flat roof, constructed in the "buildable" area of a lot will be permitted to be built to the same height as the principal structure. However, detached garages constructed in a required rear yard of a single - family home shall be limited to the following heights R -1 District - 25 feet R -2 District (lots one acre or larger) - 22 5 feet R -2 District (lots less than one acre and R -3 District - 20 feet R -4 District - 17.5 feet Any detached garage located in a required rear yard, that is over fifteen feet in height, shall be required to increase the setback one foot for every one foot of increased height over 15 feet Detached garages constructed with a continuous flat roof will be limited to a maximum height of fifteen (15) feet Section 3 All ordinances, rules, regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed Ordinance 2004- ZO -TA -G- 740 Amending Chap 3 of Zoning Reg Page 2 of 2 Section 4. This Ordinance shall be in full force and effect from and after its passage and publication as provided by law.
