AN ORDINANCE AMENDING TITLE 13 ( "ZONING REGULATIONS ")
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS
BY AMENDING SECTION 13 -3 -14 ( "DRIVEWAY GATES ")
WHEREAS, an application has been filed requesting that the text of Section 13 -3 -14 ( "Driveway
Gates ") of Title 13 ( "Zoning Regulations ") of the Village Code be amended, and
WHEREAS, the Plan Commission has reviewed the request and has unanimously recommended
the approval of the zoning text amendment, and
WHEREAS, the Zoning Board of Appeals, on January 6, 2004, conducted a public hearing on the
application pursuant to due and appropriate legal notice, and has recommended approval of the proposed
text amendment to Section 13 -3 -14 of the Village Code, and
WHEREAS, the President and Board of Trustees have reviewed the recommendations of the
Plan Commission and Zoning Board of Appeals and deem the requested text amendment as set forth
below to be in the best interest of the Village of Oak Brook
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows -
Section 1 - That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein.
Section 2: That Subsection A of Section 13 -3 -14 ( "Driveway Gates ") of the Zoning Regulations of
the Village Code of the Village of Oak Brook is deleted in its entirety and replaced as follows
A Required Acreage No driveway gate may be installed on a lot of less than two acres, unless
the front yard of said lot abuts a thoroughfare Any driveway gates previously approved and
constructed in accordance with applicable law at that time, shall be treated as a permitted
and legally conforming use.
Section 3 That this ordinance shall be in full force and effect from and after its passage,
approval and publication as required by law
Section 4- That the Village Clerk is hereby authorized and directed to publish this ordinance in
pamphlet form in the manner provided by law
Section 5• That all ordinances or parts thereof in conflict with the provisions of this ordinance be
and the same are hereby repealed to the extent of such conflict.
