S-1256 - 02/10/2009 - ZONING - OrdinancesORDINANCE 2009- ZO- V -EX1 -S -1256 AN ORDINANCE GRANTING VARIATIONS FOR THE CONSTRUCTION OF A GROUND SIGN AT 2122 22ND STREET IN THE VILLAGE OF OAK BROOK (PIN 06 -22- 308 -025) WHEREAS, an application has been filed by J.P Morgan Chase Bank (the "Petitioner') requesting two variations to Section 13 -11 -7A 5 of the Zoning Ordinance to allow the construction of an off -site premises ground sign at 2122 22nd Street, Oak Brook, Illinois, and WHEREAS, on January 6, 2009 the Zoning Board of Appeals conducted a public hearing on the request for the variations, pursuant to due and appropriate legal notice, and recommended approval of the variations subject to certain conditions, and WHEREAS, the Zoning Board of Appeals found that the Petitioner satisfactorily addressed the factors required for approval of the requested variations and made specific findings, including that the variations will not endanger the public health, safety and welfare, and that there will be no substantial injury to other property in the neighborhood, and WHEREAS, the Village President and Board of Trustees have reviewed the recommendation of the Zoning Board of Appeals and deem the variations, as set forth below, to be in the best interests of the Village NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1 The foregoing preambles are restated and incorporated herein by reference as though fully set forth herein Section 2 The Petitioner is hereby granted a variation to Section 11-7A5 of the Zoning Ordinance to allow the construction of a ground sign on a parcel containing less than three (3) acres subject to the following conditions The ground sign is to be constructed in substantial conformance to the revised proposed signage details and elevation drawings as shown on pages 19 a of the case file 2 The sign shall meet all provisions of the Zoning Ordinance relative to off -site premises ground signs including landscaping and lighting. 3 The Petitioner shall meet all Village Code requirements existing as of the time that the building permit application is submitted to the Village except as specifically varied or waived by this ordinance Section 3 The Petitioner is hereby granted a variation to Section 11 -7A 5 to allow a ground sign to be placed not less than two (2) feet from the lot line subject to the following conditions: The ground sign is to be constructed in substantial conformance to the revised proposed signage details and elevation drawings as shown on page 19 a of the case file and located at the approximate location shown on page 31 of the case file 2 The sign shall meet all provisions of the Zoning Ordinance relative to ground signs including landscaping and lighting.
