G-649 - 12/14/1999 - VILLAGE CODE - Ordinances ORDINANCE 1999-CD-BC-EXI-G-649 AN ORDINANCE AMENDING CHAPTER 5 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK RELATING TO BUILDINGS AND BUILDING REGULATIONS WHEREAS, the Village President and Board of Trustees have heretofore established rules and regulations for the construction, alteration, repair and conversions of building within the Village of Oak Brook; and WHEREAS, said provisions have been codified as Chapter 5 of the Code of Ordinances of the Village of Oak Brook; and WHEREAS, the Village President and Board of Trustees deem the amendment of said regulations to be in the best interest of the public health, safety and welfare; and WHEREAS, 65 ILCS 5/1-3-2 specifically authorizes the adoption of codes and public records by reference; and WHEREAS, the codes and portions thereof herein adopted have been filed in the office of the Village Clerk and available for public use and inspection and have been on file for a period in excess of 30 days prior to the passage of this ordinance as required pursuant to the provisions of Section 5/1-3-2 of Chapter 65 of the Illinois Compiled Statutes; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 5-1(a)of the Code of Ordinances of the Village of Oak Brook be and is hereby amended by adding a new(6)which shall read as follows: "(6) The International Property Maintenance Code, First Edition, 1998, as published by the Building Officials and Code Administrators International, Inc." Section : That Section 5-1(b)of the Code of Ordinances of the Village of Oak Brook be and is hereby amended by adding a new(9)which shall read as follows: "(9) The International Property Maintenance Code adopted pursuant to Section 5-1(a)(6) hereof is amended as follows: Chapter 1 Administration Subsection 101.1 Title. Is amended by inserting the words"Village of Oak Brook, IL." Section 102.7 Referenced codes and standards. Is amended to read as follows: Ordinance 1999-CD-BC-EX-1-G-649 Amending Chapter 5 of the Code Relating to Buildings & Building Regulations, Page 2 "The codes and standards referenced in this code shall be those that are listed in Chapter 8 and considered part of the requirements of this code to the prescribed extent of each such reference. Where differences occur between provisions of this code, the referenced standards and the Village Codes, the more restrictive provisions apply. Section 103 Department of Property Maintenance Inspection. Is amended to read as follows: "Administration and Enforcement". Subsection 103.1 General. Is amended to read as follows: "The official responsible for administration and enforcement of this Code shall be known as the Building Official. Where references are made to the Chief Code Official throughout the Code, the title Building Official shall be substituted." Subsection 103.2 Appointment. Is deleted in its entirety. Subsection 103.3 Deputies. Is amended to read as follows: "The Building Official is authorized to designate one or more employees as deputies who may exercise all powers of the Building Official under direction of the Building Official." Subsection 103.6 Fees. Is deleted in its entirety. Subsection 104.4 Right of Entry. Is amended to read as follows: "The Building Official or his/her designee is authorized to enter the structure or premises during reasonable times to conduct an inspection. Prior to entering into a space not otherwise open to the general public, the Building Official or his/her designee shall make a reasonable effort to locate the owner or other person having charge or control of the structure or premises, present proper identification and request entry. If requested entry is refused or not obtained, the Building Official or his/her designee shall pursue recourse as provided by law including, but not limited to, the obtaining of a warrant". Subsection 106.1 Unlawful Acts. Is amended to read as follows: "It shall be unlawful for any person, firm or corporation to erect, construct, alter, extend, repair, remove, demolish, maintain, fail to maintain, provide, fail to provide, occupy, let to another or occupy or permit another person to occupy any premises, property, structure or equipment regulated by this Article, or cause same to be done, contrary to or in conflict with or in violation of any of the provisions of this Article, or to fail to obey a lawful order of the Building Official or his/her designee, or to remove or deface a placard or notice posted under the provisions of this Article." Subsection 111.2 Membership of board. Is amended to read as follows: "For the purposes of this Code, all appeals of decisions relative to this Code shall be referred to the Circuit Court of DuPage County." Subsection 111.2.1 Alternate members. Is deleted in its entirety. Ordinance 1999-CD-BC-EX-1-G-649 Amending Chapter 5 of the Code Relating to Buildings & Building Regulations, Page 3 Subsection 111.2.2 Chairman. Is deleted in its entirety. Subsection 111.2.3 Disqualification of member. Is deleted in its entirety. Subsection 111.2.4 Secretary. Is deleted in its entirety. Subsection 111.2.5 Compensation. Is deleted in its entirety. Subsection 111.3 Notice of meeting. Is deleted in its entirety. Subsection 111.4 Open hearing. Is deleted in its entirety. Subsection 111.4.1 Procedure. Is deleted in its entirety. Subsection 111.5 Postponed hearing. Is deleted in its entirety. Subsection 111.6 Board decision. Is deleted in its entirety. Subsection 111.6.1 Records and copies. Is deleted in its entirety. Subsection 111.6.2 Administration. Is deleted in its entirety. Subsection 111.7 Court review. Is deleted in its entirety. Subsection 111.8 Stays of enforcement. Is deleted in its entirety. Chapter 3 General Requirements Subsection 302.8 Motor Vehicles. Is amended to read as follows: "Except as provided for in other regulations, no unregistered or uninspected motor vehicle shall be parked, kept or stored except in an enclosed structure and no vehicle shall at any time be in a state of major disassembly, disrepair, or in the process of being stripped or dismantled except in an enclosed structure." Subsection 302.10 is added which reads as follows: "Maintenance of Water Features. All existing private and public water features including stormwater retention/detention facilities must be kept clear of garbage and debris, and any such area not occupied by water must be kept mowed in accordance with the provisions of this Code. Facilities designed to hold water on a continuous basis must be maintained so as to prevent such water from becoming a breeding site for mosquitoes or from becoming a nuisance due to odor or stagnation. Whenever any facility in the Village that is designated and approved as a stormwater management facility does not function as was originally designed whether because of damage or because of falling into a state of disrepair, it shall be repaired and brought into compliance with its original design specifications, subject to the approval of the Village Engineer." Subsection 302.11 is added which reads as follows: "Storage of Construction Materials. Ordinance 1999-CD-BC-EX-1-G-649 Amending Chapter 5 of the Code Relating to Buildings & Building Regulations, Page 4 Construction materials including but not limited to bricks, lumber, piles of dirt, stone, aggregate or other debris shall not be stored in any exterior property area except in cases where construction is taking place. In such cases, compliance must be achieved within 30 days of completion of the construction activity." Subsection 303.3 Street Numbers. Is amended to read as follows: "Each structure to which a street number has been assigned shall have such number displayed in a position easily observed and readable from the street addressed to and of a contrasting color from the background. All numbers shall be in Arabic numbers at least four(4) inches high." Subsection 303.15 Insect screens. Is amended to read to read as follows: "Every door,window and other outside opening required for ventilation of habitable rooms, food preparation areas,food service areas, or any areas where products to be included or utilized in food for human consumption are processed, manufactured, packaged or stored, shall be supplied with approved tightly fitting screens of not less than 16 mesh per inch (16 mesh per 25mm)and every swinging door shall have a self-closing device in good working condition. Exception: Screen doors shall not be required where other approved means, such as air curtains or insect repellent fans, are employed." Subsection 305.3.3 Screening of containers. Is added which reads as follows: "With the exception of one and two-family dwellings, all rubbish and garbage containers including commercial dumpsters shall be screened completely from public view by an approved enclosure permitted by the Department of Community Development." Chapter 6 Mechanical and Electrical Requirements Subsection 602.3 Heat supply. Is amended to read as follows: "Every owner and operator of any building who rents, leases or lets one or more dwelling unit, rooming unit, dormitory or guestroom on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period from October 15 to May 15 to maintain a temperature of not less than 65°F. (18 0C.) in all habitable rooms, bathrooms, and toilet rooms. Exception: When the outdoor temperature is below the winter outdoor design temperature for the locality, maintenance of the minimum room temperature shall not be required provided that the heating system is operating at its full design capacity. The winter outdoor design temperature for the locality shall be as indicated in Appendix D of the plumbing node." Subsection 602.4 Occupiable work spaces. Is amended to read as follows: "Indoor occupiable work spaces shall be supplied with heat during the period from October 15 to May 15 to maintain a temperature of not less than 65°F. (18°C.)during the period the spaces are occupied. Ordinance 1999-CD-BC-EX-1-G-649 Amending Chapter 5 of the Code Relating to Buildings & Building Regulations, Page 5 Exceptions: 1. Processing, storage and operation areas that require cooling or special temperature conditions. 2. Areas in which persons are primarily engaged in vigorous physical activities." Chapter 7 Fire Safety Requirements Subsection 702.12 Emergency escape. The exception is amended to read as follows: "Buildings equipped throughout with either an automatic fire suppression system or automatic fire alarm system." Section : The Village Clerk is authorized and directed to publish this Ordinance in pamphlet form. Section 4: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner required by law.
