G-650 - 12/14/1999 - POLICE DEPARTMENT - Ordinances ORDINANCE 1999-PL-G-650 AN ORDINANCE CREATING THE POSITION OF DEPUTY POLICE CHIEF IN THE VILLAGE OF OAK BROOK POLICE DEPARTMENT WHEREAS, the General Assembly recently passed Public Act 91-615 (the"Act")which amends Section 5/10-2.1-4 of the Illinois Municipal Code entitled, "Fire and police departments—Appointment of members—Certificates of appointments". The Act provides that a non-home rule municipality of 130,000 or fewer inhabitants, through its council or board of trustees, may, by ordinance, provide for a position of deputy chief to be appointed by the chief of the police department; and WHEREAS, the Villager Manager and Chief of Police have recommended that the Village establish the position of Deputy Chief who would be appointed by the Chief of Police; and WHEREAS, the Village Board finds that it is in the best interest of the Village to accept the Village Manager and Chief of Police's recommendation by approving certain amendments to the Code of Ordinances of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 11-1 of Article I of Chapter 11 of the Code of Ordinances of the Village of Oak Brook, Illinois is amended to read as follows: "Sec. 11-1. Composition of Department. The police department shall consist of the following members: Police Chief Deputy Police Chief Police Lieutenants Police Sergeants Police Patrol Officers" Section 3: That Article I of Chapter 11 is amended by adding Section 11-2A, which section shall read as follows: "Section 11.2A. Deputy Chief; Appointment. (a) There is hereby created in and for the Village the office of Deputy Chief of Police. (b) The Deputy Chief of Police shall be appointed by the Chief of Police. (c) The Deputy Chief may be appointed from any rank of sworn, full-time officers of the Village's Police Department and must have at least five years of full-time service as a police officer in the Oak Brook Police Department. Ordinance 1999-PL-G-650 Creation of Position of Deputy Police Chief Page 2 (d) The Deputy Chief of Police position shall be an exempt rank subordinate exclusively to the Chief of Police. Said Deputy Chief of Police shall serve at the discretion of the Chief, and, if removed from the position, shall revert to the rank held immediately prior to the appointment to the Deputy Chief position." Section 4: That this ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. Section 5: That the Village Clerk is hereby authorized and directed to publish this ordinance in pamphlet form in the manner provided by law. PASSED THIS 14th day of December, 1999.
