G-828 - 02/27/2007 - LICENSE - OrdinancesORDINANCE 2007- 1-C -AL -G -828 AN ORDINANCE AMENDING TITLE 4 (BUSINESS AND LICENSE REGULATIONS), CHAPTER 1 (LIQUOR CONTROL), SECTIONS 15 (CONDITIONS OF LICENSE) 16 (TEMPORARY LICENSES) AND 23 (AGE RESTRICTIONS) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS WHEREAS, Title 4, Chapter 1, Section 15 of the Village Code of the Village of Oak Brook establishes the conditions for licenses, including closing hours, in the Village of Oak Brook, and WHEREAS, Title 4, Chapter 1, Section 16 of the Village Code of the Village of Oak Brook authorizes temporary licenses and the conditions for such licenses in the Village of Oak Brook, and WHEREAS, Title 4, Chapter 1, Section 23 establishes age restrictions for sale of alcoholic liquor, including requirements for certain warning signs, and WHEREAS, the President and Board of Trustees of the Village deem it advisable and in the best interest and in furtherance of the general welfare of the citizens of the Village that Title 4, Chapter 1, Sections 15, 16 and 23 of the Village Code of the Village of Oak Brook be respectively amended to clarify the closing hours for licensed establishments and to eliminate temporary licenses which are not permitted under State law. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1 That Section 15 (Conditions of Licenses) of Chapter 1 (Liquor Control) of Title 4 (Business and License Regulations) of the Village Code of the Village of Oak Brook, Illinois, be amended by deleting Paragraph F (Closing Hours) and replacing it with the following: F Permitted Hours for Sale and Consumption- The hours during which a licensee shall be permitted to sell, offer for sale, cause to be sold or to be given away, or to permit the consumption in or upon any licensed premises of any alcoholic liquor shall be as follows- Monday Tuesday Wednesday Thursday Friday Saturday Sunday New Year's Eve Day New Year's Eve Day Sunday 6.00 A.M. to 1:00 A M. Tuesday 6 00 A M. to 1 00 A M. Wednesday 6:00 A M to 1:00 A M. Thursday 6:00 A M to 1:00 A.M. Friday 6 00 A.M. to 1:00 A M Saturday 6.00 A.M. to 2:00 A.M Sunday 10:00 AM. to 1.00 A.M Monday 6 00 A.M to 4:00 A M. New Year's Day 10 00 A.M. to 4:00 A.M. New Year's Day It shall be unlawful to keep open for business or to admit the public to or to permit the public to remain within, or to permit the consumption of alcoholic liquor in or upon any licensed premises by any person, including employees of the licensee, other than during the above permitted hours; provided, however, that in the case of restaurants and hotels, such establishments may be kept open for business, but alcoholic liquor may only be sold or consumed in or upon such licensed premises by any person, including the employees of the licensee, during such permitted hours. ORDINANCE 2007- LC -AL -G -828 AN ORDINANCE AMENDING TITLE 4, CHAPTER 1, SECTIONS 15 AND 16 OF THE VILLAGE CODE PAGE 2OF2 Section 2: That Section 16 (Temporary Licenses) of Chapter 1 (Liquor Control) of Title 4 (Business and License Regulations) of the Village Code of the Village of Oak Brook, Illinois, be amended by deleting such Section without replacement. Section 3 That Section 23 (Age Restrictions) of Chapter 1 (Liquor Control) of Title 4 (Business and License Regulations) of the Village Code of the Village of Oak Brook, Illinois, be amended by deleting Paragraph D -1 (Required Warning Signs) and replacing it with the following: 1 In every place in the Village where alcoholic liquor is sold, there shall be displayed at all times, with the liquor license, in a prominent place, a "Proof of Age" sign provided by the Illinois Liquor Control Commission. Section 4 That this ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. Section 5 All ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict. APPROVED THIS 27th day of February, 2007.
