AN ORDINANCE AMENDING CHAPTER 5 OF TITLE 8, "PUBLIC WORKS ",
AND CHAPTER 7 OF TITLE 9, "STORMWATER MANAGEMENT"
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS
AND ADJUSTING FEES AND CHARGES
WHEREAS, the President and Board of Trustees of the Village of Oak Brook, Illinois have
heretofore, by ordinance established rates, fees, and service charges within the Public Works and
Stormwater Management titles of the Village Code, and
WHEREAS, the Village Manager has recommended a fee increase and clarifying language for
plan review /inspection work within public ways or public utility easements or any water service extension
construction and permit fees for stormwater management, and
WHEREAS, the Village President and Board of Trustees have reviewed these proposed
amendments and have approved the change recommended by the Village Manager;
WHEREAS, the President and Board of Trustees deem the suggested amendments to Chapter 5
of Title 8, "Public Works" and Chapter 7 of Title 9, " Stormwater Management' of the Village Code to be in
the best interest and in pursuance of the general welfare of the Village;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1: That the provisions of the above preamble are hereby adopted as though fully set forth
herein
Section 2 That Section 8 -5 -2A, "Plan Review And Inspection Fees ", of the Village Code of the
Village of Oak Brook, Illinois be and is hereby amended to read as follows-
"A Plan Review And Inspection Fees Any work within public ways or public utility easements
or any water service extension construction shall be subject to the following plan review
and inspection fees prior to the issuance of any permit for such work
1 Plan Review. Actual hours of review multiplied by forty dollars ($40 00) per hour
Minimum fee: forty dollars ($40 00) "
In addition to the above fees, all applicants shall reimburse the Village for any outside
consulting review charges within thirty (30) days of the date the Village seeks
reimbursement for such charges.
2 Inspection-

In addition to the above fees, all applicants shall reimburse the Village for any outside
consulting inspection charges within thirty (30) days of the date the Village seeks
reimbursement for such charges.
3 Serve As Reimbursement Said fees shall serve as reimbursement to the Village for
services rendered.
4 Exceptions, Notwithstanding the above, no plan review or inspection fee, except for
outside consulting charges, shall be required under this Section for:
a Any municipal corporation; or
b Any homeowners' association organized as a not - for - profit corporation, or
c Any public utility whose franchise agreement states otherwise, or
d Any telecommunications retailer that is paying a telecommunications infrastructure
maintenance fee; or
e Tree or shrub installation "
Section 2 That Section 9 -7 -8, Permit Fees, of the Village Code of the Village of Oak Brook,
Illinois be and is hereby amended to read as follows:
"PERMIT FEES:
Storm water management permits shall be subject to the following plan review and inspection
fees prior to the issuance of said permit.

C Reimbursement To The Village- Said fees shall serve as reimbursement to the Village for
services rendered
D Fees Not Required. Notwithstanding the above, no plan review or inspection fee, except for
outside consulting charges, shall be required under this section for:
1 Any municipal corporation; or
2 Any homeowners' association organized as a not - for - profit corporation, or
3. Any public utility whose franchise agreement states otherwise, or
4 Any telecommunications retailer that is paying a telecommunications infrastructure
maintenance fee."
Section 4, All ordinances, rules and regulations of the Village of Oak Brook which are in conflict
with the provisions of this Ordinance are hereby repealed to the extent of such conflict
Section 5. If any section, subsection, sentence, clause or phrase of this Ordinance is for any
reason held to be invalid, such determination shall not affect the validity of any remaining portion of this
Ordinance.
Section 6- This Ordinance shall be in full force and effect from and after its passage, approval
and publication in pamphlet form
Section 7- The Village Clerk is hereby authorized and directed to publish this Ordinance in
pamphlet form as required by law
