S-988 - 03/13/2001 - FPSU - Ordinances11�'- �4 1 ORDINANCE 2001- ZO- SU -FP -S- 988 AN ORDINANCE GRANTING A FLOOD PLAIN SPECIAL USE PURSUANT TO SECTION 9 -1 -8 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, IL ( RIGHT -OF -WAY ROADWAY TIMBER TRAILS, OAK BROOK, IL 60523) (No Permanent Index No.) WHEREAS, the Village of Oak Brook has petitioned for a Flood Plain Special Use unde+ Section 9 -1 -8 of the Village Code of the Village of Oak Brook, relating to flood plain and wetland regulations; and WHEREAS, a public hearing on such petition has been conducted by the Zoning Board Appeals of the Village on February 6, 2001, pursuant to due and appropriate legal notice; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its recommendation to the Zoning Board of Appeals and the President and Board of Trustees; and WHEREAS, the Plan Commission and Zoning Board of Appeals have recommended approval of the petition since the proposed use is consistent with the best use of the flood plain; and WHEREAS, the proposed use satisfies the requirements of and is consistent with each of the factors set forth in Section 9 -1 -8 of the Village Code of the Village of Oak Brook; and WHEREAS, the corporate authorities of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows. Section 1. That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2. Pursuant to Section 9 -1 -8 of the Village Code of the Village of Oak Brook, IL,1 a flood plain special use is hereby granted to allow roadway and drainage construction improvements on the property commonly known as Timber Trail Subdivision, Oak Brook, IL, as described in the engineering plans for the improvements contemplated for the 2001 Paving and Drainage Project, said plans prepared by James J. Benes and Associates, Inc. and entitled 2001 Paving and Drainage Project, which plans are not attached hereto, but are within the official files of the Village Section 3* That this Ordinance is limited and restricted to the property generally descnb'ed as the Timber Trails Subdivision area located along Salt Creek, east of Spring Road, north of Harger Road and legally described as follows: The rights -of -way of the following subdivisions: Timber Trails Estates Unit 1 recorded a Document No. 508928, Timber Trails Estates Unit 2 recorded as Document No. 53398; Trails Estates Annex recorded as Document No 601607, Lake Doran Estates recorded Document No 678192; Merry Lane Subdivision recorded as Document No R64 -04679 Gruner's Division recorded as Document No. R65- 027892, Felber's Subdivision recordE Document No. R83- 079449, and Timber Trails Assessment Plat recorded as Document 158910, all within the East half of Section 23, Township 39 North, Range 11 East of the Principal Meridian, DuPage County, IL. ; Timber a as No. R90- Third Ordinance 2001- ZO- SU -FP -S- 988 Granting a Flood Plain Special Use Timber Trails Subdivision, Page 2 Section 4: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law.
