S-1013 - 04/09/2002 - ZONING - Ordinancesf ORDINANCE 2002- ZO -R -S- 1013 AN ORDINANCE REZONING A CERTAIN PARCEL FROM R -1, SINGLE- FAMILY DETACHED RESIDENCE DISTRICT, TO R -2, SINGLE - FAMILY DETACHED RESIDENCE DISTRICT 3308 Midwest Road, Oak Brook, IL 60523 WHEREAS, an application has been filed requesting that the property commonly known as 3308 Midwest Road, Oak Brook, Illinois, (consisting of approximately 2.81 acres) presently zoned R -1 (minimum lot size: two acres), be rezoned to R -2 (minimum lot size: one acre); and WHEREAS, at its meeting -of February 18, 2002, the Plan Commission unanimously recommended approval of a rezoning to R -2 to the Village Board that the requested rezoning be granted; and WHEREAS, a public hearing on such application was conducted by the Zoning Board of Appeals of the Village of Oak Brook on March 5, 2002, pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by said Zoning Board of Appeals that the rezoning requested be granted and made explicit findings that the rezoning requested meets the applicable standards set forth in Section 13 -6 -1; and WHEREAS, the corporate authorities of the Village of Oak Brook have considered the recommendation of the said Plan Commission and Zoning Board of Appeals concerning the rezoning; and WHEREAS, the Village President and Board of Trustees deem it in the best interest of the Village of Oak Brook that the property be rezoned to the R -2 Single - Family Detached Residence Zoning District as said zoning represents the most appropriate zoning consistent with the highest and best use of the said property; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That the hereinafter described property is hereby rezoned from R -1 to R -2 Single- Family Detached Residence District, which property is legally described as follows: The East 5 chains (330.00 feet) of the North 6 chains (396.00 feet) of the East Half of the Southwest Quarter of the Northwest fractional Quarter of Section 34, Township 39 North, Range 11, East of the Third Principal Meridian, in the Village of Oak Brook, DuPage County, IL. Also known as: 3308 Midwest Road in Oak Brook, IL. Permanent Parcel No. 06- 34- 101 -004 Section 3: That the Village Clerk is hereby directed to amend the official map of zoning districts of the Village of Oak Brook in accordance with the provisions of Section 2 of this Ordinance. l Ordinance 2002- ZO -R -S -1013 Rezoning from R -1 to R -2 3308 Midwest Road, Page 2 Section 4: That all ordinances in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict, but only as they apply to the specific property hereinabove described.
