G-830 - 04/10/2007 - BOARD - OrdinancesORDINANCE 2007- BD- CL- REC -D -G -830 AN ORDINANCE AMENDING TITLE 1, CHAPTER 4, ARTICLE B, SECTION 6 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS TO ESTABLISH PROCEDURES TO AUTHORIZE THE DESTRUCTION OF THE VERBATIM RECORD OF CLOSED MEETINGS OF THE VILLAGE OF OAK BROOK BOARD OF TRUSTEES WHEREAS, the Open Meetings Act (5 ILCS 120/1, et seq.) (the "Act ") requires governmental bodies to keep a verbatim record of closed meetings by audio or video tape; and WHEREAS, the Board of Trustees of the Village of Oak Brook (the "Board ") has complied with such requirement by providing for the Village Clerk to keep a verbatim record of all closed meetings by audio tape, and WHEREAS, the Act also permits governmental bodies to destroy the verbatim record of closed meetings, no less than eighteen (18) months after the completion of the meeting recorded, without notification to or approval of a records commission or the State Archivist under the Local Records Act, but only after i) the public body approves the destruction of a particular recording, and ii) the public body approves written minutes that meet the requirements of the Act for the closed meeting recorded, and WHEREAS, the Board has determined that it is appropriate to establish procedures for the destruction of the verbatim record of particular closed meetings in a manner consistent with the Act, NOW, THEREFORE, BE IT ORDAINED by the Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois, as follows Section I. That Section 6 (Recording of Closed Sessions) of Article B (Board of Trustees) of Chapter 4 (Elected Village Officials) of Title 1 (Administration), is hereby amended by deleting divisions C and D and substituting the following. C Semiannually, at the second regular board meeting of the corporate authorities, in January and July, the agenda shall include the following item- "Review of the minutes of all closed meetings that have not yet been released for public review and determination of which, if any, may then be released." Minutes shall not be released unless the corporate authorities of the Village of Oak Brook find that it is no longer necessary to keep them confidential to protect the public interest or to protect the privacy of an individual, and no verbatim record shall be released As to any minutes, or portions thereof, not released, the corporate authorities of the Village of Oak Brook shall find that the "need for confidentiality still exists" as to those minutes, or portions thereof The corporate authorities may require the village attorney's opinion regarding the release or non - release of the respective minutes Minutes of closed meetings shall be kept indefinitely D The Board may consider the destruction of the verbatim record of any particular closed meeting at any regular meeting The Board shall consider whether to authorize destruction of the verbatim record of a particular closed meeting as part of its consent agenda, which shall include the following item for consideration, as an omnibus vote "Authorization for destruction of the verbatim record of the closed meeting held on date as no less than eighteen (18) months have passed and minutes have been Ordinance 2007- BD- CL- REC -D -G -830 Establishing Procedures for Destruction Of the Verbatim Record of Closed Meetings Page 2 of 2 approved for such meeting A favorable vote shall be deemed to authorize the village clerk to destroy the verbatim record of such closed meeting in a suitable manner Section 2 That this ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law. Section 3- That all ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict.
