G-836 - 05/22/2007 - TRAFFIC - OrdinancesORDINANCE 2007- TC- HA -PK -G -836 AN ORDINANCE AMENDING SECTION 7 -1 -1320 ( "PARKING FINES ") OF CHAPTER 1 ( "TRAFFIC CODE ") OF TITLE 7 ( "MOTOR VEHICLES AND TRAFFIC "), AND EXHIBIT C ( "SIGN REQUIRING "$100 - FINE ", ILLINOIS STANDARD R7- 1101 ") OF DIVISION D ( "DIMENSIONS, MARKING AND SIGNAGE OF ACCESSIBLE PARKING SPACES ") OF SECTION 13 -11 -13 ( "SIGNS FOR HANDICAPPED PARKING ") OF CHAPTER 11 ( "SIGN REGULATIONS ") OF TITLE 13 ( "ZONING REGULATIONS ") OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK WITH RESPECT TO MINIMUM PARKING FINES FOR VIOLATION OF REGULATIONS GOVERNING PARKING SPACES FOR PERSONS WITH DISABILITIES WHEREAS, the State of Illinois has modified its laws concerning parking spaces for persons with disabilities, and in particular for certain fines for the following- (i) violation of the prohibition against parking a motor vehicle in a parking place that is reserved, by the posting of an official sign, for persons with disabilities, and (ii) violation of the prohibition against displaying disability registration plates, a decal or other device issued to a qualified person with a disability or to a disabled veteran if the person using such registration plates, decal or other device is not the authorized holder thereof or is not transporting the authorized holder thereof, or if the person is exercising the privileges granted through such registration plates, decal or other device, and WHEREAS, by Ordinance G -825, the Board of Trustees of the Village of Oak Brook (the "Board ") determined that it was necessary and desirable to amend the Village Code to conform with such modifications to State law, and in particular to raise the minimum fine for a violation of regulations governing parking spaces for persons with disabilities; and WHEREAS, Ordinance G -825 amended certain provisions of the Village Code establishing the minimum fine for a violation of regulations governing parking spaces for persons with disabilities, but other pertinent provisions of the Village Code were not amended at the time such Ordinance was adopted; and WHEREAS, the Board has now determined that it is necessary and desirable to further amend the Village Code with respect to minimum parking fines for violation of regulations governing parking spaces for persons with disabilities. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows Section 1 - That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2. That Section 7 -1 -1320 ( "Parking Fines ") of Chapter 1 ( "Traffic Code ") of Title 7 ( "Motor Vehicles and Traffic ") of the Village Code of the Village of Oak Brook is hereby amended by deleting the provision for the fine for a violation of Section 7 -1 -1301 1 in its entirety and substituting the following Within Ten After Ten Days Of Days Of Provision Violation Violation Notice Violation Notice Section 7 -1- 1301.1 $25000 $25000 Ordinance 2007- TC- HA -PK -G -836 Amending Secs 7 -1 -1320 and 13 -11 -14 Disability Parking Fines Page 2 of 2 Section 3: That Exhibit C ( "Sign Requiring "$100- Fine ", Illinois Standard R7- 1101 ") of Division D ( "Dimensions, Marking and Signage of Accessible Parking Spaces ") of Section 13 -11 -14 ( "Signs for Handicapped Parking ") of Chapter 11 ( "Sign Regulations ") of Title 13 ( "Zoning Regulations ") of the Village Code of the Village of Oak Brook is hereby amended by deleting the title of Exhibit C and the wording on the face of the sign depicted therein, and substituting the following EXHIBIT C SIGN REQUIRING "$250- FINE" ILLINOIS STANDARD R7 -1101 $250 FINE Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law. Section 5.
