O /% �- -z4e4 y /Village Clerk e&4 - ..,. � ORDINANCE 2004- ZO -TA -G -750 AN ORDINANCE AMENDING SECTION 7 (A) (2) OF CHAPTER 12 (OFF STREET PARKING AND LOADING) OF TITLE 13 (ZONING REGULATIONS) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK RELATIVE TO SCREENED LOADING BERTHS WHEREAS, an application has been filed requesting an amendment to Section 7 of Chapter 12 of Title 13 of the Village Code of the Village of Oak to allow loading berths in the B -2 District to be screened, instead of enclosed; and WHEREAS, on April 19, 2004, the Plan Commission reviewed the request for a text amendment and unanimously recommended its approval; and WHEREAS, on May 4, 2004, the Zoning Board of Appeals conducted a public hearing on the request for a text amendment, pursuant to due and appropriate legal notice, and recommended its approval; and WHEREAS, in recommending the proposed text amendment, the Zoning Board of Appeals and the Plan Commission found that the petitioner satisfactorily addressed the factors required for approval of a text amendment to the Zoning Regulations and found that the proposed amendment is both reasonable and consistent with the goals of the B -2 Zoning District; and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of the Plan Commission and Zoning Board of Appeals and deem the requested text amendment as set forth below to be in the best interest of the village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1: The recitals above are hereby incorporated into and made a part of this ordinance. Section 2: Chapter 12 (Off Street Parking and Loading) of Title 13 (Zoning Regulations) of the Village Code is hereby amended by deleting subsection (A) (2) of Section 13 -12 -7 in its entirety and replacing it with the following: 2. In the B -2 zoning district, off street loading berths may face perimeter or boundary streets if said loading berths are screened by a stone or masonry wall at least eight feet (8') in height. No off street loading berths shall be permitted within five hundred feet (500') of a boundary street, unless such loading berths are screened and are located at the rear of the building. Section 4: This ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. Section 5: All ordinances or parts thereof in conflict with the provisions of this ordinance be and the same are hereby repealed to the extent of such conflict. APPROVED THIS 8th day of June, 2004.
